AN ORDINANCEENACTINGA NEWCHAPTER17.26 ENTITLED"BINDINGSITEPLAN"IN TITLE 17 OF THEMOSESLAKEMUNICIPALCODE
THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1:There is established within Title 17 of the Moses Lake Municipal CodeChapter17.26 entitled "Binding Site Plan"as follows:
i 17.26.010 Purpose:The procedures regulating Binding Site Plans are establishedtoprovideanoptionalalternativeprocedurefortheorderlyandeffi-cient division of land into lots,tracts,or parcels for the purpose ofleaseforindustrialorcommercialusesofthelanduponwhichnoresidentialstructureswillbeplacedotherthanmobilehomesortraveltrailers,when more than one (1)principal building is to be constructedononelotofrecord;to promote the general health,safety,and wel-fare;and to substantially comply with the provisions of RCWChapter58.17.The procedures specified herein are available in addition toothermethodsforsubdividinglandanduseofthisprocedureandtheBindingSitePlanconceptisoptionalandadevelopermay,but need notelecttoutilizetheconceptandtheproceduresstatedhereinforcommercialandindustrialdevelopment.The Binding Site Plan shall betherequiredmethodofdevelopmentformobilehomeparks.The BindingSitePlanproceduresofthischaptershallhaveprincipalapplicationtocommercialandindustrialparksandmobilehomeparks.
17.26.020 Binding Site Plan Conditions and Requirements:
A.General Conditions and Requirements:
1.Binding Site Plans shall be filed for the record in the CountyAuditor's Office.
I 2.When a commercial or industrial Binding Site Plan authorizes asaleortransferofalot,parcel,or tract.The Binding SitePlanandallofitsrequirementsshallbelegallyenforceableonthepurchaserorotherpersonacquiringownershipofthelot,parcel,or tract.The sale or transfer of such lot,parcel,or tract in violation of the Binding Site Plan,orwithoutobtainingBindingSitePlanapproval,shall be con-sidered a violation of Chapter 58.17 RCWand shall be restrainedbyinjunctiveactionandbeillegalasprovidedinChapter58.17.The sale or other transfer of ownership of a lot,parcel,or tract of a commercial or industrial Binding SitePlanshallbefiledfortherecordintheCountyAuditor'soffice.
3.Mobile home park and recreational vehicle park Binding SitePlansshallnotauthorizethesaleortransferofownership ofalot,parcel,or tract of the Binding Site Plan.
4.Alteration of an approved Binding Site Plan shall be accom-plished by submitting an amended Binding Site Plan to the PlatAdministrator.The amendedBinding Site Plan shall be pro-cessed subject to all the procedures and requirements of thischapter.
5.A Binding Site Plan may be vacated in conformance with theiproceduresofChapter58.11 RCW.
6.The Binding Site Plan shall make adequate provisions for roads,streets,curbs,gutters,sidewalks,street lighting circuits,alleys,the extension of municipal utilities (sewerand water),drainage ways,other public ways,or other municipal improve-ments as deemed necessary in conformance with city CommunityStreetandUtilityStandardsandcityDesignStandardsineffectatthetimeoftheBindingSitePlanapproval.

7.The Binding Site Plan shall front on an existing dedicated
street.There shall be adequate access to all parcels,lots,
or tracts.Streets shall be improved to city standards.
Private streets shall have direct access onto a dedicated
street.
8.The Binding Site Plan shall comply with all zoning and health
regulations.
9.The Binding Site Plan shall be consistent with the cit.y'sComprehensivePlan.
10.The Binding Site Plan shall provide for irrigation water right-of-ways as now enacted or hereafter amended.
11.Environmental information shall be prepared and submitted inaccordancewiththeguidelinesestablishedundertheState
Environmental Policy Act of 1971,as amended.Said information
is a part of and must accompanythe Binding Site Plan Applica-tion.
12.Unless an applicant for a Binding Site Plan requests otherwiseandwherethePlatAdministratoragrees,a Binding Site Planshallbeprocessedsimultaneouslywiththeapplicationfor
rezones,variances,planned unit developments,site plan ap-provals,and similar quasi-judicial or administrative actionstotheextentthatproceduralrequirementsapplicabletotheseactionspermitsimultaneousprocessing.
13.Every decision or recommendation made under this chapter by theCouncilorPlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedeci-sion or recommendation.
14.Binding Site Plans shall be approved,disapproved,or returnedtotheapplicantformodificationwithinninety(90)days from
the date of filing unless the applicant consents to an exten-sion of such time period.Provided,that if an EnvironmentalImpactStatementisrequiredasprovidedinRCW43.210.030.theninety(90)day period shall not include the time spent pre-paring and circulating the Environmental Impact Statement by
the local governmental agency.
15.No Binding Site Plan may be approved unless the city makes aformalwrittenfindingoffactthattheproposedBindingSitePlanisinconformancewithanyapplicablezoningordinances,
or other land use controls which may exist.
B.Specific Conditions and Requirements:
1.Prior to submission of a Binding Site Plan application and map,the subdivider or the subdivider's representative shall schedule
a pre-application conference with the Plat Administrator andrepresentativesofotheraffectedcitydepartments.The sub-divider shall present a conceptual idea of the Binding Site
Plan.The Plat Administrator and representatives of affected
city departments will respond informally and address potential
items of concern to aid the subdivider in preparing the Binding
Site Plan.
2.The Binding Site Plan application and map shall be filed with
the Plat Administrator on forms prescribed by the Planning
Division of the Community Development Department.Said appli-
cation shall be accompanied by eleven (11)copies of the Bind-
ing Site Plan and map.
3.The Binding Site Plan and map (elevensets of prints plus theoriginaltracingandareproducablemylarcopy)shall be a neat
and accurate drawing in black permanent ink prepared,stamped,and signed by a registered professional land surveyor licensed

by the State of Washington.The trimmed size of the BindingSitePlanandmapshallmeasureeighteeninches(18")by twenty-four inches (24")with a one and a half inch (1½")margin onthetoporleftmarginandahalfinch(½")border on theremainingthree(3)margins.The Binding Site Plan and mapshallbedrawnontwo(2)or more sheets if the scale necessarytoaccomodatethemaponone(1)sheet would unduly congest thedrawing.
I 4.The subdivider shall submit a conceptual master developmentplanfortheBindingSitePlan.
5.The subdivider shall submit a list of the names and addressesofallownersofrecordofrealpropertywithinthreehundredfeet(300')of the external boundaries of the proposed BindingSitePlan.In addition,the subdivider shall submit a list ofthenamesandaddressesofallownersofrecordofrealprop•erty within three hundred feet (300')of real property whichliesadjacenttotheexternalboundariesoftheproposedsubdi-vision and is owned by the subdivider.
6.The Binding Site Plan shall bear all inscriptions or attach-ments setting forth appropriate limitations and conditions fortheuseoftheland.
7.The Binding Site Plan shall contain provisions making alldevelopmentsconformwiththeBindingSitePlan.
8.A non-refundable fee of $130shall accompany each and everyapplicationforaBindingSitePlan.
9.Required dedication of all streets,right-of-ways,parks,playgrounds,easements,reservations,irrigation water right-of-ways,and any area to be dedicated to public use,togetherIwithanyrestrictionsorlimitationsthereonshallbesubmittedasapartoftheBindingSitePlan.
10.The Binding Site Plan shall be accompanied by the following:
a.A title report from a title companylicensed to do businessintheStateofWashingtonanddatedwithinthirty(30)days of the date of filing of the Binding Site Plan andapplicationwiththePlatAdministratorconfirmingthat thetitleofthelandsasdescribedandshownontheBindingSitePlanisinthenameoftheownerssigningtheBindingSitePlanorinstrumentofdedication.
b.A certificate from the Grant County Treasurer indicatingthatalltaxesandassessmentsonthepropertyincluded intheBindingSitePlanordedicationhavebeenpaidaccord-.
ing to the provisions of RCW58.08.030 and RCW58.10.040 asnowenactedorhereafteramended.
c.A certificate from the city Finance Director indicatingthattherearenodelinquentspecialassessmentsorliensonthepropertyincludedintheBindingSitePlanordedi-cation.

a.All documents,maps,and survey notes shall clearly showthenameoftheBindingSitePlan,the name(s)of thesubdivider(s)and the name of the registered land surveyorresponsibletothesubdivider(s).

b.The lines and names of all streets or other public ways,parks,playgrounds and easements intended to be dedicatedforpublicuse,or granted for use of inhabitants of theBindingSitePlan,
c.The lines and names of all existing or platted streets orotherpublicways,parks,playgrounds,and easements adja-cent to the Binding Site Plan,or dedication,includingmunicipalboundaries,township lines,and section lines.
d.Block and lot locations including dimensions and numberdesignations.
e.The lengths and bearings of all straight lines,curveradii,arcs,and semi-tangents of all curves.
f.All dimensions along the lines of each lot,with the truebearingsandalsoanyotherdatanecessaryforthelocationofanylotlinesinthefield.
g.Suitable primary control points,approved by the Public
Works Director or descriptions and ties to such controlpoints,to which all dimensions,angles,bearings,andsimilardatagivenontheplanshallbereferred.
h.The location of all permanent monuments.
i.The names of all subdivisions immediately adjacent thereto.
j.The date,true north point,scale,datum plane,and date of
survey.
k.The boundary of the Binding Site Plan,the courses anddistancesmarkedthereon,as determined by a field surveymadebyaregisteredandqualifiedlandsurveyorofthestate,and with an allowable error not to exceed one foot(1')in five thousand feet (5,000')and one foot (1')in
ten thousand feet (10,000')in the Central Business Dis-
trict.
1.The elevations of all corners on the boundaries of thesubdividedtracts.
m.Certification by a licensed land surveyor of accuracy oftheBindingSitePlanmapandsurvey.
n.Statement by the owner dedicating streets,right-of-ways,
and any sites for public use.
o.Location and dimensions of all irrigation water right-of-
ways.
p.All linear dimensions shall be given in feet and decimalsofafoottothenearesthundredth.
q.The scale of the binding site improvement plan shall be onehundredfeet(100')to the inch.
r.If the Binding Site Plan constitutes a redivision,thelots,blocks,streets,etc.,of the original plat shall beshownbydottedlinesintheirproperpositionsinrelation
to the new arrangement of the Binding Site Plan,the Bind-
ing Site Plan being so clearly shown in solid lines as toavoidambiguity.
s.The subdivider's land surveyor shall set all required
monumentsand shall stake all lot corners as shown on the
Binding Site Plan before the Binding Site Plan is submitted
for approval.

t.If any.of the parcels can be further divided or if only aportionofatractisbeingdivided,location of futurestreets,alleys,and lot lines shall be shown by dottedlines.
u.A vicinity map at a scale of not more than four hundredfeet(400')to the inch.The vicinit.y map shall show alladjacentparcels.It shall show howthe streets and alleysintheproposedBindingSitePlanmayconnectwithexisting
i and proposed streets and alleys in neighboring subdivisions
or unplatted propert.y to produce an advantageous develop-ment of the entire neighborhood.
v.Provide street names.
w.United States Bureau of Reclamation horizontal and verticaldataincludingbenchmarks.
x.A site plan on a separate sheet showing the followinginformation:
1)Location and sizing of existing and proposed utilitiesincludingwater,sewer,storm drains,electricity andgas,telephone,and cablevision lines.
2)Existing and proposed structures and natural featuresandallproposedimprovementswithinandadjoiningtheproposedbindingsiteimprovementplan.
3)Utility grades based on datam plane approved by theCityEngineer.As required by the City Engineer,topographyof the area with a maximumof two foot(2')intervals of contours.
I 4)Present zoning classification on and adjacent to theproperty.
5)Public dedications for park land.
6)Name(s)of owner(s)of the proposed binding siteimprovementplan.
7)Location and dimensions of all existing and proposedirrigationwaterright-of-ways on and adjacent to theproposedbindingsiteimprovementplan.
y.Any deed restrictions or covenants existing or proposedshallbedrawnontheBindingSitePlan.
aa.Submit all lot,block,and boundary computations or acertifiedstatementbythesurveyorthattheBindingSitePlanwascomputergenerated.
bb.The Binding Site Plan shall contain the legal descriptionofthesubdivisionandthefollowingdedication,acknowl-edgment,and endorsement statements shall appear in thefollowingsequenceinblackpermanentinkeitherbyhand ormechanicaldevice:

17.26.030 Referral to Other Departments,Agencies,and Offices:
A.Upon receipt of a complete and satisfactory Binding Site Planapplication,the Plat Administrator shall distribute copies of theBindingSitePlantoeachofthefollowingoffices,departments,oragencieswithintwo(2)working days from receipt:
1.Public Utility District
i 2.Gas Company
3.Telephone Company
4.Public Works Department (three copies)
5.Fire Department
6.Building and Planning Divisions of the Community DevelopmentDepartment
7.Grant County Health District
8.Moses Lake Irrigation and Rehabilitation District
B.The Plat Administrator shall further notify the Police Department,Park and Recreation Department,and City Manager that a BindingSitePlanhasbeenreceived.
C.Notice of the filing of a Binding Site Plan located in the city andadjoiningthemunicipalboundariesthereofshallbegiventotheGrantCountyPlanningDepartment.
D.Notice of the filing of a Binding Site Plan located adjacent to theright-of-way of a state highway shall be given to the State Depart-
I ment of Highways.
E.Each office,department,or agency shall file written recommenda-
tions with the Plat Administrator within fifteen (15)calendar daysfromthedateoffilingoftheBindingSitePlanwiththePlatAdministrator.All comments shall be written and shall be returnedtothePlatAdministrator.If any such office,department,oragencyfailstofileawrittenrecommendationwithinthetimelimitation,it may be presumed that such office,department,oragencyhasnorecommendation.
1.Within fifteen (15)calendar days of filing of the Binding SitePlantheCityEngineershallreviewtheBindingSitePlanandsubmittothePlatAdministratorawrittenreportwithrespecttothefollowingconditions:
a.That the proposed Binding Site Plan bears the requiredcertificatesandstatementsofapproval.
b.That a title report furnished by the subdivider confirmsthetitleofthelandandtheproposedBindingSitePlan isvestedinthenameoftheownerwhosesignatureappearsontheBindingSitePlan.
c.That the Binding Site Plan is technically correct as certi-i fied by the land surveyor responsible for the Binding SitePlan.
2.Within fifteen (15)days of filing of the Binding Site Plan thelocalhealthdistrictorotheragencyfurnishingsewagedispo-sal and supplying water shall review the Binding Site Plan andsubmittothePlatAdministratorawrittenreportrecommendingapprovalordisapprovaloftheBindingSitePlanastotheadequacyoftheproposedmeansofsewagedisposalandwatersupply.

3.Within fifteen (15)days of filing of the Binding Site Plan theappropriateirrigationdistrictservingorfromwhichthereal
propert.y is entitled to be served with irrigation water shallreviewtheBindingSitePlanandsubmittothePlatAdminis-
trator a written report recommendingapproval or disapproval oftheBindingSitePlanastotheadequacyoftheproposedmeansofthedeliveryofirrigationdistrictentitlementwaterandastotheadequacyoftheproposedmeansofremovalofirrigation
waste water.
F.If the Binding Site Plan is found to be unacceptable,a certifiedlettershallbemailedtothesubdividerwithintwenty(20)days ofreceiptoftheapplication.
G.The Plat Administrator may determine that a meeting shall be held
to resolve major issues identified as a result of the recommenda-
tions of other offices,departments,or agencies.Such meeting
shall be attended by those offices,departments,or agencies re-sponsible for the recommendations and must include the applicant ortheapplicant's representative and the Plat Administrator.The
proceedings and results of the meeting shall be documented byminutes.
17.26.040 Variances:
A.Any subdivider can make application to the Planning Commission for
a variance of any provision contained in this Chapter provided therequestisreceivedconcurrentlywiththeproposedBindingSitePlanordedication.Such application shall include any and alldetailsnecessarytosupporttheapplication.All variance requestsmustbeforwardedtotheCouncilwiththeBindingSitePlanandthePlanningCommission's recommendation.
B.The Planning Commission shall not grant a variance of the subdivi-sion regulations unless it shall find that all of the followingconditionsexistineachcaseofarequest:
1.There are special physical circumstances or conditions affect-ing said real property such that strict application of theprovisionsofthisChapterwouldcauseanunusualandunneces-
sary hardship on the subdivider.
2.The granting of the variance will not be detrimental to thepublichealth,safety,or welfare or injurious to other real
property in the vicinity.
3.In granting variances,the Planning Commission may require suchconditionsaswillsecure,in so far as practicable,the objec-
tives of the requirement varied.Any variance authorized shallbeenteredintheminutesofthePlanningCommissiontogetherwiththecircumstancesthatjustifythevariancegranted.
17.26.050 Dedications:Dedication of all streets,right-of-ways,parks,play-
grounds,easements,reservations,irrigation water right-of-ways,and
any area to be dedicated to public use,together with any restrictions
thereon shall be submitted as a part of the Binding Site Plan;approved
by the Council;and,shall be recorded and filed as a part of theBindingSitePlanwiththeCountyAuditor.
17.26.060 Planning Commission Public Hearing:When the Plat Administrator deter-
mines that the completed Binding Site Plan is acceptable,the Plat
Administrator shall set a date for a public hearing before the Planning
Commission.The Planning Commission shall conduct a hearing on theBindingSitePlannotlessthantwenty(20)days nor more than forty-
five (45)days after receipt of the completed Binding Site Plan.
17.26.070 Notice of Public Hearing:The Plat Administrator shall give notice of
the time,location,and purpose of the public hearing in the following
manner.

A.At least one (1)public notice shall be published not less than ten(10)days prior to the hearing in a newspaper of general circula-tion within the city and area where the real propert.y that isproposedtobesubdividedislocated.
B.Three (3)notices shall be posted on.or adjacent to the land pro-posed for the Binding Site Plan at least ten (10)days prior to thepublichearingdate.
C.One (1)notice shall be mailed via the U.S.mails to each owner ofIpropertywithinthreehundredfeet(300')of the property proposedfortheBindingSitePlanatleastten(10)days prior to thepublichearing.
D.If the owner of the real property which is proposed for the BindingSitePlandevelopmentownsanotherparcelorparcelsofrealprop-erty which lies adjacent to the real property proposed for BindingSitePlandevelopment,one (1)notice shall be mailed via the U.S.mails to each owner of property located within three hundred feet(300')of any portion of the boundaries of such adjacent locatedparcelsofrealpropertyownedbytheowneroftherealpropertyproposedfortheBindingSitePlan.
E.Notice shall be sent to the Grant County Planning Department and totheStateDepartmentofHighwaysrespectivelyiftheBindingSitePlanisadjacenttomunicipalboundariesoriftheBindingSitePlanisadjacenttoastatehighway.
17.26.080 Planninq Commission Action:
A.The Plat Administrator shall transmit the application,the BindingSitePlan,respective comments and recommendations from otherofficesandagencies,comments and recommendations from citydepartments,and Planning Division commentsand recommendations toithePlanningCommissionpriortothehearing.
B.The Planning Commission shall review the Binding Site Plan,munici-pal recommendations,testimony,and exhibits submitted at thehearingandmakerecommendationsthereontotheCounciltoassureconformanceoftheproposedBindingSitePlanwiththeComprehen-sive Plan,Zoning Ordinance,Community Street and Utilit.y Stand-ards,and city Design Standards.The Planning Commission shallrecommendtheCouncilapprove,conditionally approve,or disapprovetheBindingSitePlan.
17.26.090 Council Action:
A.Upon receipt of a Planning Commission recommendation,the Counci.1shall,at its next regular meeting,set a date for a public meetingtobescheduledfortheCouncil's next regular meeting.The Coun-cil shall consider and adopt or reject the Planning Commission'srecommendation.
B.If the Council finds that the Binding Site Plan conforms to allrequirementsofthischapter,the requirements of RCWChapter58.17,other applicable state laws,and any other requirements itshallapprovetheBindingSitePlanandthatactionshalldirecttheCit.y Manager to sign the plan.
I C.If the Council,after considering the recommendations at a publicmeetingdeemsnecessaryachangeintherecommendationsofthePlanningCommission,such a change shall not be made until theCouncilholdsapublichearingtoconsidertheirownrecommenda-tions.The hearing before the Council shall be held and conductedinthemannerprescribedforthePlanningCommissionwithpublicnoticegiveninthemannerprescribedforthePlanningCommissionhearing.

17.26.100 Final Filing Fees:Upon Council approval of the Binding Site Plan andwithinfifteen(15)days thereafter,the applicant shall remit thefollowingfeespriortotheBindingSitePlanbeingofficiallysignedandrecordedwiththeCountyAuditor:
A.A check payable to the County Auditor sufficient to cover therecordingfees.
B.When applicable,parks and public lands fee of $.0025per squarefootoftheBindingSitePlanincludingalldedicationsunlessthePlanningCommissionagreestoacceptdonationsoflandforpublic
use in lieu thereof.
C.When applicable,a certificate from the Grant County Auditor certi-fying that covenants to the property title have been recorded andfiledshallaccompanytheBindingSitePlan.
17.26.110 Final Filing:
A.Upon receipt of all required final fees the Binding Site Plan shallbesignedbythefollowingofficials:
1.City Engineer
2.City Manager
3.City Clerk
8.The Plat Administrator shall transmit the original mylar to theCountyAuditorforfinalfiling.One reproducable copy shall beforwardedwiththeoriginaltobeconfirmedandreturnedtotheCityEngineerfortheCityEngineer's record.One paper copy shallbefiledwiththeCountyAssessor.
17.26.120 Certificate of Segregation -Buildinq Permit:
A.Prior to the issuance of any building permit for constructionwithinanapprovedBindingSitePlan,that portion of the BindingSitePlanforwhichthebuildingpermitisrequestedmustbelegallydescribedandreceiveacertificateofsegregationfromthePlan-ning Division of the Community Development Department.Said certi-ficate shall insure the segregation of construction complements oftheapprovedBindingSitePlan.
B.Approval of the Binding Site Plan shall constitute approval for theBindingSitePlanapplicanttodevelopconstructionplansandspecificationsforallstreetandutilityimprovementsrequiredby
the Council in granting approval of the Binding Site Plan.
17.26.130 Improvements:
A.Prior to the issuance of a building permit for construction within
a Binding Site Plan all street and utility improvements required by
the Council in granting Binding Site Plan approval including all
street and utility improvements required to adequately service thatportionoftheplanforwhichabuildingpermitisrequestedshallbeinstalledandcompletedbythedeveloperandacceptedbythecity.
B.The subdivider shall file with the Plat Administrator three (3)complete sets of preliminary construction plans and specifications
prepared by a professional engineer licensed by the State of Wash-ington showing all street and utility improvements as required by
the Council in granting approval of the preliminary plat.The
construction plans and specifications shall be accompanied by aminimumplancheckfeeof$150.All construction plans and speci-fications shall be in conformance with city Design Standards and
Ordinance 1071:11
the Community Street and Utility Standards.Sheet size shall betwenty-four inches (24")by thirty-six inches (36")and shall haveaborderofoneinch(1")on the left margin and one half inch (½")on the remaining three (3)margins.The scale shall be five feet(5')or ten feet (10')vertically and forty feet (40')or fiftyfeet(50')horizontally.
C.The preliminary construction plans and specifications shall beforwardedtotheCityEngineerwithintwo(2)days of receipt bythePlatAdministrator.Within twenty (20)working days of filingioftheplanswiththePlatAdministratortheCityEngineershallapprove,conditionally approve,or disapprove the plans.Thesubdividershallsubmitone(1)set of reproducable mylar and three(3)sets of specifications which have been approved for the CityEngineer's signature,records,and use.
D.After the City Engineer has approved the construction plans andspecifications,the subdivider shall complete and install allimprovements.
E.The Engineering Division of the City of Moses Lake's Public WorksDepartmentoralicensedprofessionalengineerorengineeringfirmhiredbythecityshallberesponsiblefortheinspectionofallsubdivisionimprovementstoinsureconformancewiththeapprovedplansandspecifications.The subdivider shall deposit an inspec-tion fee in the amount of two and a half percent (24%)of theestimatedconstructioncostoftheBindingSitePlanimprovements.The inspection fee shall be based on the actual cost of labor,materials,and equipment plus fifteen precent (15%)for overhead.If the final cost is less than the amount deposited,the differencewillberefunded.
F.The subdivider shall submit a maintenance bond in the amount of100%of the cost of construction.Said bond shall be in effect for
i one (1)year from the date of acceptance.
17.26.140 Performance Bond:
A.In lieu of completing and installing all required street and util-ity improvements prior to the issuance of a building permit,thesubdividermaypostaperformancebondorotherapprovedsecurityinaformsatisfactorytotheCityAttorney.
B.The performance bond or approved security shall be in an amountequaltoonehundredfiftypercent(150%)of the estimated cost,asdeterminedbythePublicWorksDirector,of such improvementsrequiredbytheCityCouncilingrantingapprovaloftheBindingSitePlan.
C.All required street and utility improvements listed in the perform-ance bond or approved security must be installed,completed,andacceptedbythecitywithinone(1)year of the date of issuance ofthebuildingpermit.In the event that all street and utilityimprovementsarenotcompletedwithinthetimelimitspecified intheperformancebondorsecurit.y,the bond or security may beforfeitedandthecitymayundertaketheinstallationandcomple-tion of all required street and utility improvements.
17.26.150 Vested Rights:A Binding Site Plan shall be governed by the terms ofIapprovaloftheBindingSitePlan,and the statutes,ordinances,andregulationsineffectatthetimeofapprovalandforaperiodoffive(5)years after Binding Site Plan approval unless the Council findsthatachangeinconditionscreatesaseriousthreattothepublichealthorsafety.Lots,parcels,or tracts in a Binding Site Planfiledforrecordshallbeavalidlandusenotwithstandinganychangeinzoninglawsforaperiodoffive(5)years from the date of filing.

17.26.160 Appeals:Any decision approving or disapproving any Binding Site Plan
shall be reviewable as provided by law by writ of review before theSuperiorCourtofGrantCounty.Said application for a writ of review
shall be made to the court within thirty (30)days from any decision tobereviewed.The cost of transcriptions of all records ordered certi-
fied by the court for such review shall be borne by the party seekingreviewintheSuperiorCourtandnotranscriptsshallbepreparedorprovidedpriortoreceiptofpaymentofthem.
Section 5.This ordinance shall take effect and be in force five (5)days after
its passage and publication as provided by law.
