1075_00001CITY OF DMONSENSCLAKE,WAs5HINGTON AN ORDINANCE relating to the waterworks utilityoftheCity,including the system of sewerage as apartthereof;specifying and adopting a system orplanofadditionstoandbettermentsandextensionsofthatwaterworksutility;declaring the estimated cost thereof as nearly as may be;providing for theborrowingofatotalof‡3,350,000 and issuing nego-tiable general obligation bonds to pay a part of thecostthereof,such bonds to be payable by annualpropertytaxleviestobemadeinexcessofregular property tax levieer and providing for the submissionofthepropositionofincurringsuchindebtednessandissuingsuchbondsandratifyingthisordinancetothequalifiedvotersoftheCityataspecialelec-tion to be held therein on November 2,1982,inconjunctionwiththeStategeneralelectionto beheldonthesamedate. heretWHEREAcSomb enedCi oex st gLawak er sy engm d syhest mcity"L sewerage into a waterworks utility system of the City and the words "Waterworks Utility"shall hereinafter mean the combined water system and system of sewerage of the City together with all additions thereto and betterments and extensions thereof hereafter made;and WHEREAS,the City Council has determined it to be in the best interests of the City that certain improvements be made to the Waterworks Utility;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON, DOES ORDAIN,as follows: Section Î.The City specifies and adopts a system or plan i of additions to and betterments and extensions of the Waterworks Utility of the City more specifically described in Exhibit A attached hereto and incorporated herein by this reference. There shall be included in the foregoing the acquisition and installation of all necessary valves,pumps,fittings, couplings,connections,equipment and appurtenances,the acquisition of easements,rights-of-way and land that may be required and the per-i formance of such work as may be.incidental and necessary. All of the foregoing shall be in accordance with the plans and specifications therefor prepared by the City's Consulting Engineer. The City Council may modify the details of the foregoing system or plan where,in its judgement,it appears advisable,if such modif- ications do not substantially alter the purposes hereinbefore set forth. Section 2.The estimated cost of the acquisition,construction, installation,and financing of the above-described improvement is declared to be approximately $11,487,500,which shall be paid from the following sources: 1.The proceeds of a grant anticipated to be receivedfromtheStateofWashington,Department of Ecology,i in the approximate amount of $4,787,500. 2.The proceeds from the issuance and sales of$3,350,000 par value of water and sewer revenuebonds,and 3.The proceeds of the issuance and sale of $3,350,000parvalueofunlimitedtaxgeneralobligationbondsoftheCity. Section 3.The City shall borrow not to exceed $3,350,000 on the credit of the City and issue and sell its negotiable general obligation bonds therefor,for strictly municipal capital purposes other than the replacement of equipment,for the purpose of pro- viding the funds to pay a part of the cost of carrying out the system or plan of additions to and betterments and extensions of the Waterworks Utility of the City as specified and adopted herein. issueSecb tn 4.Ord aneneral obligati nb nnds authorizedb arbe interest payable semiannually,except for the first interest - coupon if the City Council so determines,and shall mature serially, annually,in from two to twenty years from date of issue -2- i (the life of the improvements to be acquired by the issuance of bonds is found to be at least twenty years)in such amounts that will result in a difference of not more than $5,000 between the highest and lowest annual payment of principal or interest, excluding the years up to and including the year in which prin- cipal payments commence,computed on such anticipated interest rate as the City Council shall in its discretion determine will be borne by such bonds,and shall be paid by annual property tax levies made in excess of regular property tax levies sufficient in amount to pay the principal of and interest on the bonds when due,and the bonde shall so provide.The date,interest rate or rates,maturities,option of prior redemption,form and cove~ nants of the bonds shall be hereafter fixed by ordinance of the i City council and the bonds shall be issued and sold when required in one or more series,and may be combined with any other series of general obligation bonds concurrently or here- after authorized.Pending the issuance of the bonds and receipt of proceeds thereof,the City Council may authorize interim interest-bearing warrants or other short-term obligations to pay for carrying out the purposes of the bonds and the cost of such warrants or short-term obligations shall be included in the cost of those purposes. Section 5.The City Council finds that an emergency exists requiring the making of the improvements referred to in Section 1,and the Grant County Auditor,as ex officio supervisor of Eleenece onaan mrer eenstedan teonceal nnd eon a sp c ee ation to be held in the City on November 2,1982,in conjunction with the State general election to be held on the same date,for the purpose of submitting to the qualified electors of the City,for their ratification or rejection,this ordinance including the question of whether or not the City shall borrow not to exceed -3 - l $3,350,000 and issue its negotiable general obligation bonds therefor for capital purposes only,other than the replacement of equipment,as herein set forth. Section 6.The City Clerk-Treasurer is directed to certify to the Grant County Auditor,as ex officio Supervisor of Elec- tions,at least 45 days prior to the November 2,1982,special election date,a copy of this ordinance and the proposition to be submitted at that special election in the form of a ballot title as follows: PROPOSITION GENERAL OBLIGATION SEWER BONDS -$3,350,000 Shall Ordinance No•1075 providing for the bor-rowing of $3,350,000 for the purpose of paying a partofthecostofmakingimprovementstotheWaterworksUtilityoftheCity,including the system of sewerageiasapartthereof,and the issuance of general obli-gation bonds therefor,maturing in from two to twentyyearsfromdateofissueandpayablefromannual property tax levies to be made in excess of regular property tax 1evies,be ratified or rejected? ORDINANCE AND BONDS ...YES ORDINANCE AND BONDS ...NO Section 7.This ordinance is necessary for the immediate preservation of the public peace,health and safety,and is an emergency ordinance since a certified copy of the duly enacted ordinance must be filed with the Auditor of Grant County by no later than September 17,1982,and,having been passed by the unanimous vote of the City Council,shall take effect immedi- ately upon passage and publication. City ClerkeTreas er Mayor Pro Tem -=-4- r Attorn y l EXHIBIT"A" The project consists of constructing a new Wastewater Treatment Plant,which will allow the-City to discontinue the use of the existingWastewaterTreatmentPlantlocatedonPelicanHornofMosesLake.The project more particularly consists of the following: 1.Modification of a number of existing sewer lift stationstopreventpossibleoverflowstoMosesLake. 2.A force main between the existing plant which would becometheinfluentpumpstationtothenewwastewatertreatmentplantinthesanddunesSouthofMosesLake. 3.Modifications of a portion of the existing plant andiconstructionoftheinfluentpumpstation. 4.Construction of the Pretreatment/Disposal System in thesanddunes. 5.Rehabilitation of the existing sewers.
