1082_00001ORDINANCENO.1082 ANORDINANCEREPEALINGCHAPTER18.42 OF THEMOSESLAKEMUNICIPALCODEENTITLED"I-1,INDUSTRIALZONE"ANDESTAB-LISHINGA NEWCHAPTER18.42 OF THEMOSESLAKEMUNICIPALCODEENTITLED"LIGHT INDUSTRIAL(L-I)ZONE" THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDO ORDAINAS FOLLOWS: Section 1.Chapter 18.42 of the Moses Lake Municipal Code entitled "I-1,Indus-trial Zone"is hereby repealed in its entirety. Section 2.A new Chapter 18.42 of the Moses Lake Municipal Code entitled "LightIndustrial(L-I)Zone"is hereby established as follows: 18.42.010 Purpose:The Light Industrial (L-I)Zone is intended to accommodateavarietyoflightindustrialusesincludingbutnotlimitedtomanufac-turing,warehousing,distribution operations,processing and fabricat-ing,and to preserve land for such use. Subject to the approval of the Planning Commission,any industrial,commercial,retail business or agricultural use desiring to locate intheL-I zone and meeting the Performance Standards and Bulk RegulationsofthischaptermaybepermittedunlessspecificallyexcludedfromtheL-I zone. The performance of such uses shall be of such a nature that theiroperationdoesnotinflictuponthesurroundingresidential,commer-cial,or agricultural zones smoke,dirt,dust,glare,odors,steam,vibration,noise,electrical interference,excessive hazards or pollu-tion which exceeds the maximumpermissible limits as defined in thischapter. 18.42.020 Application for use Within the L-I Zone:Application for a use withintheL-I zone shall be submitted to the Planning Commission as an appli-I cation for a conditional use.Such uses may be permitted by the Plan-ning Commission subject to the provisions of this chapter and Chapter18.51 of this title entitled "Conditional and Unmentioned Uses." 18.42.030 Uses in the L-I Zone:For the purpose of clarification,the followingprincipalusesamongthemanypossibleusesmaybepermittedintheL-IzonesubjecttotheprovisionsofthischapterandanyconditionsimposedbythePlanningCommission: A.Light industrial uses. B.Commercial and retail business uses in compliance with the provi-sions of this chapter desiring to locate in a less restrictivezone. C.The cultivation of land for agricultural products,vineyards,gardening and fruit growing and the keeping of livestock,poultry,rabbits,and bees in accordance with Chapter 18.13 of this titleprovidedthatnobuildingsorstructuresshallbeerectedofapermanentnatureforhumanhabitationotherthanprovidedinSec-tion 18.42.030 E of this chapter. D.Administrative and office facilities for the accommodation ofprofessionalandtechnicalstaffwhichareindependentfromwhataregenerallyrecognizedasbeingsupportiveofprimaryuses(i.e.I corporate law firms,engineering firms,accounting firms,consul-tants,and technical service agencies). E.Dwelling units for the convenience of a resident watchman or custo-dian.Dwelling units as an appurtenant use to the primary use. F.Accessory uses appurtenant to any primary use. G.Essential public services and utilities. H.Parks and commercial or non-commercial recreational uses. I.Private or public ground transportation systems. #1082-Pg.2 18.42.040 Prohibited Uses:The following uses shall be prohibited in the L-I zone: A.Residential uses except as provided in Section 18.42.030 E of thischapter. B.Any use which does not conform with the purpose of the L-I zone ordoesnotorisnotcapableofconformingwiththePerformanceStandardsandBulkRegulationsashereindefined. .An end s nrm ed by the Planning Commission to pose excessivehazardtothepublichealth,safety,and general welfare. 18.42.050 Performance Standards:The maximum permissible limits of the Perform- ance Standards for the L-I zone shall be as herein identified: A.Air Quality:No visible or invisible noxious,toxic,or corrosivefumesorgasesorparticulateemissions,or suspended particles orfugitivedustemissionsshallbedischargedintotheatmosphereexceptsuchasiscommontothenormaloperationofaheatingplant or gasoline or diesel engines in cars,trucks,or railroad engines.Where such emission could be produced as a result of accident orequipmentmalfunction,adequate safeguards standard for safe opera-tion in the industry involved shall be taken.This shall not beconstruedtoprohibitsprayingofpesticidesorherbicidesonpublicorprivateproperty. B.Vibrations:Every use shall be so operated that any air or groundvibrationgeneratedfromequipmentotherthanvehiclesisnotperceptiblewithoutinstrumentsatanypointonorbeyondtheLightIndustrialZoneboundaryline. C.Waste Storage and Disposal:The storage or disposal of industrialwasteshallbesubjecttotheregulationsoftheStateHealthDepartmentandshallcomplywiththerequirementsoftheWashingtonPollutionControlCommission. D.Electrical Interference:Provisions must be made for necessaryshieldingorotherpreventivemeasuresagainstinterferencecausedbymechanical,electrical,or nuclear equipment uses or processeswithelectricalapparatusinnearbybuildingsoruseareas. E.Noise:The noise resulting from any activity other than noise produced by vehicles and other transportation facilities and con-struction and maíntenance of buildings and grounds shall not beaudibleatanypointonorbeyondtheLightIndustrialZonebound- ary line. F.Fire and Explosive Hazards:The manufacture,use,processing orstorageofflammableliquidsormaterials,liquids or gases whichproduceflammableorexplosivevaporsorgasesshallbepermittedinaccordancewiththeregulationsoftheFirePreventionCodeand the Uniform Building Code of the City of Moses Lake. G.Steam:Any use producing humidity in the form of steam or moistairshallbecarriedoninsuchamannerthathumidityisnotpreceptibleatorbeyondtheLightIndustrialZoneboundaryline. H.Heat:Any use producing heat shall be carried on in such a mannertEatheatisnotpreceptibleatorbeyondtheLightIndustrialZoneboundaryline. I.Odors:Any use producing odors shall be carried on in such a manner that offensive or obnoxious odar shall not be preceptible at or beyond the Light Industrial Zone boundary line. J.Glare:Artificial lighting shall be hooded or shaded so thatdirectlightofhighintensitylampswillnotresultinglare when viewed from surrounding areas. #l082-gg.3 18.42.060 Bulk Regulations:The maximumpermissible limits of the Bulk Regula-tions for the L-I zone shall be as herein defined: A.Building Heights:No building or structure shall be erected orenlargedtoexceedthree(3)stories or fifty feet (50')in height.The Planning Commission may allow buildings or structures to beerectedtoanadditionalheightafterapublichearingandexamina-tion of the location and upon due proof to the satisfaction of theCommissionthatsuchadditionalheightwillnotbedetrimentaltothesurroundingproperties.Any building or structure erected on i a lot adjoining a residential or commercial zona shall be limitedtoaheightensuringadjacentpropertiessolaraccesssubjecttotheprovisionsofChapterofthistitleentitled"SolarAccess." 8.Off-Street Parking and Loading:off-street parking and loadingareasshallbeprovidedincompliancewithChapter18.64 of thistitle. C.Signs and Billboards:Signs and billboards shall be in compliancewithchapter18.57 of this title. D.Shoreline Areas:All property developed within two hundred feet(200')of the high water line (1048'elevation)shall be in compli-ance with the city's Shoreline Management Plan. E.Storage Areas:All storage located on a lot which adjoins a resi-dential or commercial zone shall be wholly within a building orenclosedbyasightobscuringscreennotlessthaneightfeet(8')in height.All storage shall be kept in a manner so that it willnotcreateafirehazardoranuisance.In the case of the openstorageofcombustiblematerial,a roadway shall be provided andmaintainedtopermitfreeaccessoffiretrucksatanytime. F.Set Back Requirements:No set backs are required other than thoseirequiredbytheUniformBuildingCodeandtheUniformFireCodeandbySection18.42.060 I of this chapter. G.Lot Size Requirements:No minimum or maximumlot size requirement. H.Containment Within a Building:All industrial uses including butnotlimitedtomanufacturing,processing,.warehousing,distribu-tion,and fabrication shall be carried on within a building.Thisisnottobeconstruedasprohibitingopensaleslotsoroutsidestoragesubjecttosection18.42.060 E of this Chapter. I.Buffer Strip:Any use on a lot in the L-I zone which adjoins aresidentialzoneshallbebufferedfromsuchzonewithabufferstripfifteenfeet(15')in width.The Planning Commission mayrequiresightobscuringfencesorbermsaswellasshrubsandtrees.Buffer strips shall be suitably landscaped and maintained. 18.42.070 Enforcement of Performance Standards and Bulk Regulations: A.Upon occurrance of a violation of the Performance Standards or BulkRegulationsofthischapter,the Building Official shall issue anoticeofcivilinfraction.The responsible official representingtheuseinviolationshallhavetwenty-four (24)hours to correcttheviolation,unless,in the opinion of the Building Official,I there is imminent peril to property and/or to the public health,safety,or general welfare,in which case the violation shall becorrectedimmediatelyortheBuildingOfficialshallissueanoticeofceaseanddesistterminatingtheusependingahearingbeforethePlanningCommission. B.Any violation of the provisions of this ordinance shall be punish-able as defined in Chapter 1.08 of the Moses Lake Municipal Code.For enforcement purposes each day is defined as a 24-hour periodbeginningat12:01 a.m.and each day in which a violation of thischapteroccursshallconstituteaseparateviolation. #1082,Pg.4 C.Where determinations of violations can be made by the BuildingOfficialusingequipmentnormallyavailabletothecityorobtainedwithoutextraordinaryexpense,such determination shall be so madebeforeanoticeofcivilinfractionornoticetoceaseordesistisissued.Where technical complexity or extraordinary expense makeitunreasonableforthecitytomaintainthepersonnelorequipment necessary to make the determination of violation,then the cityshallcallinproperlyqualifiedexpertstomakethedeterminationofviolation.If expert findings indicate a violation of theperformancestandards,the cost of the determination shall beassessedagainstthepropertiesorpersonsresponsiblefortheviolationinadditiontootherpenaltiesprescribedbythistitle.If no violation is found,cost of the determination shall be paidentirelyb.ythe city.Provisions for such expert findings shall be a condition of approval of an application for a use within the L-Izone. D.Upon proof of correction and compliance with the Performance Stand-ards and Bulk Regulations of this chapter,the Planning Commission may rescind the notice of cease and desist and allow the use tocontinuesubjecttotheconditionsoftheoriginalconditional usepermitandanyadditionalconditionsimposedbythePlanningCom-mission. 18.42.080 Severability:If any provision of this ordinance,or its application to any person or circumstance is held invalid,the remainder of theordinanceortheapplicationoftheprovisionstotheotherpersons orcircumstanceshallnotbeaffected. Section 3.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw. Adopted by the City Council and signed by its Mayor on November 9,1982.
