ANORDINANCEESTABLISHINGCHAPTER18.44 OF THEMOSESLAKEMUNICIPALCODEENTITLED"HEAVYINDUSTRIAL(H-I)ZONE"
THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 18.44 of the Moses Lake Municipal Code entitled "Heavy Indus-trial (H-I)Zone"is hereby established as follows:
18.44.010 Purpose:The Heavy Industrial (H-I)Zone is intended to accommodateiheavyindustrialusesandtopreservelandforsuchusesatlocationsthatwillpermitlessrestrictiveindustrialPerformanceStandardsandBulkRegulationsthanarerequiredintheL-I and M-I zones.Therebyprovidinggreaterflexibilitytoaccommodateavarietyofheavyindus-trial uses including but not limited to manufacturing,fabricating,processing,warehousing,distribution operations,and assembly.
Subject to the approval of the Planning Commission,any industrial,commercial,retail business,or agricultural use desiring to locate intheH-I zone and meeting the Performance Standards and Bulk RegulationsofthischaptermaybepermittedunlessspecificallyexcludedfromtheH-I zone.
Thp performance of such uses shall be of such a nature that theiroperationdoesnotinflictuponthesurroundingresidential,commer-cial,industrial,or agricultural zones smoke,dirt,dust,glare,odors,steam,vibration,noise,electrical interference,excessivehazardsorpollutionexceedingthemaximumpermissiblelimitsasde-fined in this chapter.
18.44.020 Application for a use in the H-I Zone:Application for a use withintheH-I zone shall be submitted to the Planning Commission as an appli-cation for a conditional use.Such uses may be permitted by the Plan-ning Commission subject to the provisions of this chapter and Chapter
i 18.51 of this title,entitled "Conditional and Unmentioned Uses."
18.44.030 Uses Within the H-I Zone:For the purpose of clarification,the fol-lowing principal uses among the many possible uses may be permitted intheH-I zone subject to the provisions of this chapter and any condi-tions imposed by the Planning Commission:
A.Heavy industrial uses.
B.Light industrial,medium industrial,commercial,or retail business
uses in compliance with the provisions of this chapter desiring tolocateinalessrestrictivezone.
C.The cultivation of land for agricultural products,vineyards,gardening and fruit growing and the keeping of livestock,poultry,rabbits,and bees in accordance with Chapter 18.13 of this titleprovidedthatnobuildingsorstructuresshallbeerectedofapermanentnatureforhumanhabitationotherthanprovidedinSee-tion 18.44.030 E of this chapter.
D.Administrative and office facilities for the accommodation ofprofessionalandtechnicalstaffwhichareindependentfromwhataregenerallyrecognizedasbeingsupportiveofprimaryuses(i.e.corporate law firms,engineering firms,accounting firms,consul-tants,and technical service agencies.I E.Dwelling units for the convenience of a resident watchman or cus-todian.Dwelling units as an appurtenant use to the primary use.
F.Accessory uses appurtenant to any primary use.
G.Essential public services and utilities.
H.Parks and commercial or non-commercial recreational uses.
I.Private or public ground transportation systems.

18.44.040 Prohibited Uses:The following uses shall be prohibited in the H-I
zone.:
A.Residential uses except as provided in Section 18.44.030 E of thischapter.
8.Any use which does not conform with the purpose of the H-I zone ordoesnotorisnotcapableofconformingwiththePerformanceStandardsorBulkRegulationsashereindefined.

18.44.050 Performance Standards:The maximum permissible limits of the Perform-
ance Standards for the H-I zone shall be as herein defined:
A.Air Quality:Emissions from combustion and incineration,emissionsfromsourcesemittinghazardousairpollutants,and emission ofsuspendedparticlesorfugitivedustshallnotexceedthestandardssetforthinChapter173400WAC,"General Regulations for AirPollution."
No visible or invisible noxious,toxic,or corrosive fumes,gases,or particulate material shall be discharged into the atmospherewhichwouldbedemonstratablyinjurioustohumanhealth,animals,or plant life commonto the region at or beyond the Heavy Indus-trial Zone boundary line.Where such emissions could be produced
as a result of accident or equipment malfunction,safeguards stand-ard for safe operation of the industry shall be taken.
Polluted air streams shall be treated with the best availablecontroltechnologypriortodischargeintotheatmosphere.
B.Heat,Glare,and Humidity (Steam):In the H-I zone any activityproducinghumidityintheformofsteamormoistair,or producingheatorglareshallbecarriedoninsuchamannerthattheheat,glare,or humidity is not perceptible at or beyond the Heavy Indus-trial Zone boundary line.Artificial lighting shall be hooded orshadedsothatdirectlightofhighintensitylampswillnotresultinglarewhenviewedfromareassurroundingtheH-I zone.
C.Industrial Wastes:The disposal of industrial wastes shall besubjecttotheregulationsoftheStateHealthDepartmentandshallcomplywiththerequirementsoftheWashingtonPollutionControlCommission.
D.Odors:Any use producing odors shall be carried on in such amannerthatoffensiveorobnoxiousodorsshallnotbeperceptibleatorbeyondtheHeavyIndustrialZoneboundaryline.
E.Noise:Noise emanating from a use within the H-I zone which
exceeds the maximum permissible noise levels set forth in WAC173.60.040 and this chapter shall not be permitted.

*Between the hours of 10 p.m.and 7 a.m.the noise limitations
shall be reduced by 10 dBA for receiving property in residential
zones.

may be exceeded for any receiving property by no more than:
A.5 dBA for a total of 15 minutes in any one hour period
B.10 dBAfor a total of 5 minutes in any one hour period
C.15 dBA for a total of 1.5 minutes in any one hour period
Exemptions to the maximum permissible noise levels cited in thischaptershallbeasenumeratedinWAC173-60-050,MaximumEnviron-mental Noise Levels Exemptions.
F.Vibration:Every use shall be so operated that the ground vibra-tion inherently and recurrently generated from equipment other thanvehiclesisnotperceptiblewithoutinstrumentsatanypointonorbeyondtheHeavyIndustrialZoneboundaryline.
G.Fire and Explosive Hazards:The storage,manufacture,use,orprocessingofflammableliquidsormaterialswhichproduceflam-mable or explosive vapors or gases shall be permitted in accordancewiththeregulationsoftheFirePreventionCodeandtheBuildingCodeoftheCityofMosesLake.
H.Electrical Interference:Provisions must be made for necessaryshieldingorotherpreventativemeasuresagainstinterferencecausedbymechanical,electrical,or nuclear equipment,uses,orprocesseswithelectricalapparatusinnearbybuildingsoruseareas.
18.44.060 Bulk Regulations:The maximumpermissible limits of the Bulk Regula-tions for the H-I zone shall be as herein defined:
A.Building Heights:
i 1.There shall be no minimum height requirements.
2.There shall be no maximumheight requirement provided that:
a.Any building or structure erected on a lot adjoining aresidentialorcommercialzoneshallbelimitedtoaheightensuringadjacentpropertiessolaraccesssubjecttotheprovisionsofChapterofthistitleentitled"Solar Access."
b.Any building or structure erected in an airport zone shallnotexceedtheheightlimitationsofsaidzonesubjecttotheprovisionsofChapter18.52 of this title entitled"Airport Zone."
B.Off-Street Parking and Loading:Off-street parking and loadingareasshallbeprovidedincompliancewithChapter18.54 of thistitle.
C.Signs and Billboards:Signs and billboards shall be in compliancewithChapter18.57 of this title.
D.Shoreline Areas:All property developed within two hundred feet(200')of the high water line (1048'elevation)shall be in compli-ance with the city's Shoreline Management Plan.I E.Storage Areas:All storage located on a lot which adjoins a resi-dential or commercial zone shall be wholly within a building orenclosedbyasightobscuringscreennotlessthaneightfeet(8')in height.This shaT1 not be construed to prohibit open saleslots.All storage shall be kept in a manner so that it will notcreateafirehazardoranuisance.In the case of the openstorageofcombustiblematerial,a roadway shall be provided andmaintainedtopermitfreeaccessoffiretrucksatanytime.
F.Set Back Requirements:No set backs are required other than thoserequiredbytheUniformBuildingCodeandtheUniformFireCodeandbySection18.44.060 I of this chapter.

8.Lot Size Requirements:There shall be no minimum or maximumlotsizerequirement.
H.Containment Within a Building:No requirement.
I.Buffer Strip:Any use on a lot in the H-I zone which adjoins aresidential,commercial,or light industrial zone shall be bufferedfromsuchzonewithabufferstriptwenty-five feet (25')in width.The Planning Commission may require sight obscuríng fences,berms,
or sound deadening walls as well as shrubs and trees.Bufferstripsshallbesuitablylandscapedandmaintained.
18.44.070 Enforcement of Performance Standards and Bulk Regulations:
A.Upon occurrance of a violation of the Performance Standards or Bulk
Regulations of this chapter,the Building Official shall issue anoticeofcivilinfraction.The responsible official representingtheuseinviolationshallhavetwenty-four (24)hours to correcttheviolation,unless,in the opinion of the Building Official,there is imminent peril to property and/or to the public health,safety,or general welfare,in which case the violation shall be
corrected immediately or the Building Official shall issue a noticeofceaseanddesistterminatingtheusependingahearingbefore
the Planning Commission.
B.Any violation of the provisions of this ordinance shall be punish-
able as defined in Chapter 1.08 of the Moses Lake Municipal Code.For enforcement purposes each day is defined as a 24-hour periodbeginningat12:01 a.m.and each day in which a violation of thischapteroccursshallconstituteaseparateviolation.
C.Where determinations of violations can be made by the BuildingOfficialusingequipmentnormallyavailabletothecityorobtainedwithoutextraordinaryexpense,such determination shall be so madebeforeanoticeofcivilinfractionornoticetoceaseordesistisissued.Where technical complexity or extraordinary expense makeitunreasonableforthecitytomaintainthepersonnelorequipmentnecessarytomakethedeterminationofviolation,then the cityshallcallinproperlyqualifiedexpertstomakethedeterminationofviolation.If expert findings indicate a violation of theperformancestandards,the cost of the determiantion shall beassessedagainstthepropertiesorpersonsresponsiblefortheviolationinadditiontootherpenaltiesprescribedbythistitle.If no violation is found,cost of the determination shall be paid
entirely by the city.Provisions for such expert findings shall be
a condition of approval of an application for use within the H-I
zone.
D.Upon proof of correction and compliance with the Performance Stand-
ards and Bulk Regulations of this chapter,the Planning commissionmayrescindthenoticeofceaseanddesistandallowtheusetocontinuesubjecttotheconditionsoftheoriginalconditionalusepermitandanyadditionalconditionsimposedbythePlanningCom-mission.
18.44.080 Severability:If any provision of this ordinance,or its applicationtoanypersonorcircumstanceisheldinvalid,the remainder of theordinanceortheapplicationoftheprovisionstotheotherpersons orcircumstanceshallnotbeaffected.
Section 2.This ordinance shall take effect and be in force five (5)days after
its passage and publication as provided by law.
