ANORDINANCESETTINGTHE SEWERRATESFORSEWERSERVICEUTILIZEDBYINTERNATIONALTITANIUM,INC.
THECITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Sanitary wastewater shall be charged at the existing commercial rateasfollows:

In addition,there is an assessed twenty-five percent (25%)surchargefortheservicebeingoutsidethecorporatelimitsoftheCityofMosesLake,pursuant to MLMC13.12.050.
Section 2.Processed wastewater shall be charged at a flat rate of $1,881permonth,based upon a 100,000 gpd maximumdischarge.There shall be also charged asumof$853per month to cover the cost of capital replacement due to InternationalTitanium,Inc.'s corrosive processed wastewater discharge.Additionally,therewillbeassessedatwenty-five percent (25%)surcharge pursuant to MLMC13.12.060fortheservicebeingoutsidethecorporatelimitsoftheCityofMosesLake.Thetotalchargepermonth,including the basic fee,the fee for capital replacement,and the 25%surcharge,shall be $3,417.50.
Section 3.Testing and monitoring shall be charged at the actual cost plus fifteenpercent(15%)for overhead expenses such as,but not limited to,office space andcomputertimecharges.
Section 4.A maximum penalty per occurrence may be assessed as follows for non-compliance with International Titanium,Inc.'s wastewater discharge permit.
First Day $5,000SecondDay7,500ThirdDay10,000
Each day thereafter until corrected or service is terminated shallhaveanadditionalmaximumpenaltyassessmentof$2,500added on tothepreviousdaysmaximumpenalty(for example -4th day,$12,500;Sthday,$15,000,etc.).
The penalty provisions are provided in addition to the city's reservation of theright.to discontinue service at any time as outlined in the Wastewater DischargePermit.
International Titanium,Inc.has the same opportunity for a hearing regarding thepenaltyassessmentasisoutlinedinPermit#1,Item 6,Page 3,dated March 29,1982.
Section 5.This rate structure for International Titanium,Inc,shall run concur-rently with International Titanium,Inc.'s Permit #1 and shall terminate with theterminationofthepermit.Further rate structures will be negotiated in conjunc-tion with the negotiation of terms for a new Wastewater Discharge Permit.
Section 6.This ordinance is necessary for the preservation of health and safetyandthereforeitisdeclaredthatanemergencyexists.Since an emergency hasibeendeclared,the ordinance shall be read only once before its passage and havingbeenpassedbyanaffirmativevoteof2/3 of the Council present or no less than 4affirmativevotes,it shall take effect and be in force with billings after March1,1983.
