AN ORDINANCECREATINGA NEWCHAPTER5.06 OF THEMOSESLAKE
MUNICIPALCODEENTITLED"LICENSINGREGULATIONS-TEMPORARYLOCATIONS"WHICHDEFINES,REGULATESANDLICENSESTRANSIENTMERCHANTS,ITINERANTMERCHANTSANDITINERANTVENDORS,ANDPROVIDINGPENALTIESFORTHEVIOLATIONTHEREOF
THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
I Section 1.A new chapter,5.06,of the Moses Lake Municipal Code entitled "Li-censing Regulations -Temporar.y Locations"is hereby enacted as follows:
5.06.010 Authority:The provisions of this chapter shall be deemed an exerciseoftheauthorityandpowerofthecitytolicense,for the purposes ofregulationandrevenue,all and every kind of temporary businessauthorizedb,y law and transacted and carried on within the corporatelimitsofthecit.y,as provided by RCW35.24.290 (7).
5.06.020 License Required:It is unlawful for any person,firm,corporation,or association to engage in any kind of business,trade,or professionauthorizedbylawwithintheCityofMosesLakeasatransientmer-Chant,itinerant merchant,or itinerant vendor as defined in Section5.06.030 without first obtaining a license therefore in compliancewiththeprovisionsofthischapter.
5.06.030 Definitions:For the purpose of this chapter,a transient merchant,itinerant merchant or itinerant vendor is defined as any person,firm,corporation or association,whether as owner,agent,consignee oremployee,whether a resident of the city or not,which engages in atemporarybusinessofsellinganddeliveringgoods,wares,and mer-chandise within said city,and who,in furtherance of such purpose,hires,leases,uses or occupies any building,structure,parking lot
or area,motor vehicle,tent,railroad boxcar or both,public room inhotels,motels,lodging houses,apartments,shops,or any street,i alley,or other public places within the city,for the exhibition andsaleofsuchgoods,wares and merchandise,either privately or atpublicauctionprovidedthatsuchdefinitionshallnotbeconstrued toincludeanyperson,firm,corporation or association who,whileoccupyingsuchtemporarylocation,does not sell from stock but exhi-bits samples only for the purpose of securing orders for future deliv-
ery only.The person,firm,corporation or association so engagedshallnotbereleasedfromcomplyingwiththeprovisionsofthischaptermerelybyreasonofassociatingtemporarilywithanylocaldealer,trader,merchant or auctioneer,or by conducting such transi-ent business in connection with,as a part of,or in the name of anylocaldealer,trader,merchant or auctioneer.
5.06.040 License -Contents:All licenses provided for in this chapter shallbeissuedbytheCityClerkuponpayingtotheCityClerktheproperlicensefeeasprovidedinthischapter.All Ticenses shall bear thenameofthelicensee,and shall designate the nature of the business,trade or profession operated by the licensee;and shall also designatethelocationwherethebusiness,trade or profession is carried on,the date of their expiration of the license,the date of the issuanceofalicenseandtheamountpaidforthelicense.Each licensee shallconspicuouslypostsuchlicenseathisplaceofbusinessorofficeandshallproducesuchlicenseforinspectionifrequiredtodosobyanyauthorizedcit.y official.
I 5.06.050 Review by Fire Chief and Building Official:Prior to the issuance ofalilicensesauthorizedbythischapter,the city clerk shall submittheapplicationtotheFireChiefandBuildingOfficialofthecityforapprovalofthelocationwherethelicenseeistocarryonthebusiness,trade or profession,and the business license shall beissuedonlyifthelocationisincompliancewithbuildingandfirecodesofthecityasthosecodesrelatetoexistingand/or new struc-tures.

5.06.060 Location Change:If an existing licensee desires to change the loca-tion of the business,trade or profession from the location designated
on the business license,application must be made to the City ClerkpriortothechangeinlocationandtheCityClerkshall,prior to theissuanceofanewbusinesslicense,submit the application to the Fire
Chief and Building Official of the city for approval of the new loca-tion where the licensee is to carry on the business,trade or profes-sion,and the business license shall be issued only if the location isincompliancewiththebuildingandfirecodesofthecityasthosecodesrelatetoexistingand/or new structures.There shall be noadditionalbusinesslicensefeeassessedanexistinglicenseeforachangeofhislocation,and the new business license issued shall
carry the same expiration date.
5.06.070 Term of License:All licenses shall be for a period of one yearunlessotherwiseprovidedinthischapter;such license is to beginJanuary1ofeachyearandterminatethefollowingDecember31,
5.06.080 Fee Schedule:The business license fee schedule is fixed in theamountof$100per year or part thereof,payable in advance,for eachbusiness,trade or profession conducted or carried on within thecorporatelimitsofthecity;provided,that tax exempt nonprofit
companies,associations,corporations,or copartnerships of whateverkindasdefinedbythefederalorstategovernment,shall not berequiredtopaythebusinesslicensefee,but,nevertheless,shallobtainabusinesslicense,without fee,if conducting a business inordertoraisefundsfrommembersoutsidetheorganization.ThisexemptionisinadditiontothatprovidedinSection5.06.090.Nobusiness,trade or profession conducted or carried on in a singlelocationunderonemanagementorownershipshallpaymorethanonelicensefeeregardlessofthemultiplenatureofthebusinesscarried
on;Provided further that no tax exempt nonprofit company,associa-tion,corporation or copartnership of whatever kind as defined by thefederalorstategovernmentswhichoperatesorconductsacommunityfestivaloreventofnomorethanfourdaysindurationshallberequiredtoobtainabusinesslicenseashereinpreviouslyprovidedandtheexemptionwhichhasbeenprovidedshallextendtothefesti-val's or event's participants displaying and/or selling arts,crafts,and hobbies under sanction of said festival or event.Any business,
profession or trade in more than one location within the city shall
pay a license fee for each location where the business,profession ortradeisconducted.
5.06.090 Certain Businesses Exempt:Recognizing that there are locally owned
and operated small or part-time businesses which would be undulypenalizedbyrequiringlicensingunderthischapterandthepayment ofthebusinesslicensefeeasprovidedinSection5.06.080,there isexemptedfromthisbusinesslicensingchapterthoselocallyownedand
operated businesses,professions,or trades wherein the annual grossincomeislessthan$1,000per year.
5.06.100 Cash Deposit:Before a license is issued under authority of thischapter,the applicant,in addition to paying the applicable license
fees,shall deposit with the City Clerk a refundable cash deposit or acashier's check in the amount of $150.The deposit or cashier's check
shall be refunded or returned to the licensee at such time as it has
been determined that any check used to pay the licensee fee hasclearedandafterthelicenseedeliverstothecityasigned,decla-
ration indicating the amount of gross sales and which calculates the
amount of sales tax to be forwarded to the Washington Department ofRevenue.In addition the statement shall contain a current address
and telephone number of the licensee.
5.06.110 Non-Transferablity of License:All licenses provided for in this
chapter shall be non-transferable.

5.06.130 Duty of Buildinq Official to Enforce:It shall be the duty of theBuildingOfficialoftheCityofMosesLakeandhisdesigneetoexamineallplacesofbusinessandpersonssubjecttotheprovisionsofthischapter,to determine if this chapter has been complied with and toenforcetheprovisionsofthisordinanceagainstanypersonfoundtobeviolatingthesame.
5.06.140 General Fund:All funds received by the city under the terms of thischaptershallbepaidintotheGeneralFundofthecityandbudgetedannuallyforanymunicipalpurpose,as required by law.
I 5.06.150 Fees Collected by Court:The city shall have the power to institutesuitoractioninanycourtofcompetentjurisdictionforthepurposeofcollectinganylicensefeesthataredueandpayable.
5.06.160 Penalty for Violations:Failure to comply with any provision of thischaptershallsubjecttheviolatortothefollowingpenaltiesastheyaredefinedinChapter1.08 of this code:

5.06.170 Severability:If any section,sentence,clause or phrase of thischapterisforanyreasonheldtobeunconstitutional,such decisionshallnotaffectthevalidityoftheremainingsections,sentences,clauses or phrases of this chapter or the chapter as an entirety,itbeingalegislativeintentthatthischaptershallstandnotwithstand-ing the invalidity of such section,sentence,clause or phrase.
Section 2.This ordinance shall take effect and be in force five (5)da,ys afteritspassageandpublicationasprovidedbylaw.
