ANORDINANCEREPEALINGCHAPTER18.21 OF THEMOSESLAKEMUNI-CIPAL CODEENTITLED"R-3,MULTI-FAMILYRESIDENTIALZONE"ANDESTABLISHINGANEWCHAPTER18.22 OF THEMOSFS LAKEMUNICIPAL300EENTITLED"R-3,MULTI-FAMILYRESIDENTIALZONE".
THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 18.21 of the Moses Lake Municipal Code entitled "R-3,Multi-
I family Residential Zone"is hereby repealed in its entirety.
Section 2.Chapter 18.22 of the Moses Lake Municipal Code entitled "R-3,Multi-family Residence Zone"is hereby established as follows:
18.22.010 Intent:The multi-family residence zone is intended to accommodatemediumtohighdensityresidentialusesandtopreservelandforsuchresidentialuses.The zone may serve as a transitional buffer zonebetweencommercialareasandlow-density residential areas.Limitedcommercialusesarepermittedasconditionaluses.
18.22.020 Permitted Uses:Hereafter in the multi-family residence zone nobuilding,structure,or land shall be used and no building or struc-ture shall be erected,altered,or relocated herein which is designed
or intended to used for any other than the following outright permit-ted uses or as a conditional use.Outright permitted uses or condi-tional uses in the multi-family residence zone shall be in compliancewiththeconditions,the performance standards,and bulk regulationsofthischapter.
A.Outright Permitted Uses:
1.Multi-family dwelling unit structure -a structure containing
more than two dwelling units on a single lot.
I 2.Duplex -a structure on one lot of record containing two (2)dwelling units.
3.Single family dwelling units including:
a.Single family detached dwelling units
b.Single family dwelling units sharing a commonwall orattachmentintwolotsofrecord.
c.Condominiums -single family attached dwelling unitsdevelopedasahorizontalregimeincompliancewith therequirementsofthischapterorincompliancewithChapter18.67 of this title entitled Planned Development District.
4.Subordinate uses -any use which is incidental and subordinatetotheprincipaluseofthelandorbuilding;is located onthesamelotwiththeprincipaluse;and is not otherwiseprohibited.
5.Accessor.y buildings and/or structures appurtenant to anypermitteduseincompliancewithSection18.22.040 of thischapter.
I 6.Factory built housing constructed to the standards of theUniformBuildingcode.
7.Keeping of dogs and cats as household pets not to exceed three(3)in number which are four (4)months old or older.
8.Planned Development Districts in compliance with Chapter 18.67ofthistitleentitledPlannedDevelopmentDistricts.
9.Parks and noncommercial recreational uses.
10.Homeoccupations in compliance with Chapter 18.06.320 of thistitle.

11.An accessory dwelling unit intended to accommodate a member(s)of the immediate family requiring daily care,supervision,orguardianshipincompliancewithSection18.22.210 of thischapterentitledResidentialDensity.
12.Other unmentioned uses ruled by the Planning Commission to besimilartoandcompatiblewiththespecifiedpermitteduses.
B.Conditional Uses:The following uses may be permitted by thePlanningCommissionasaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.57 of this title entitledConditionalandUnmentionedUses.
1.Golf courses
2.Cemetaries
3.Manufactured homes not located in manufactured home parksprovidedthatthesize,construction,siting,and other fea-tures shall be harmonious with the surrounding residentialpropertiesandshallpreservethegeneralcharacterand in-tegrity of the neighborhood.
4.Manufactured home parks in compliance with Chapter 18.63 ofthiscodeentitled"Mobile (Manufactured)HomeParks."
5.Day care or day nurseries
6.Clubs,lodges,and assembly halls
7.Athletic clubs
8.Boarding houses

12.Clinics
13.Professional offices
14.Rental of an apartment appurtenant to a single family residence

use provided that the use shall be similar to and compatiblewiththespecifiedpermittedandconditionaluses.
18.22.030 Prohibited Uses:Any use not expressly permitted outright or as aconditionaluseintheR-3 zone shall be prohibited including but notlimitedtothefollowingexamples:
A.Commercial uses except as provided in Section 18.22.020 A and B ofthischapter.
B.Industrial uses
C.Keeping of livestock,poultry,rabbits,and bees

D.Occupancy of trailers and recreational vehicles other than inmanufacturedhomeparksorrecreationalvehicleparks.
E.Public nuisances
F.Removal of soil or other natural fill materials for the purpose ofsaleoruseasfillmateiral,except that excavation for the
purpose of construction or landscaping shall be permitted.
G.Outside storage,collection,or dumping of dismantled,partly
I dismantled,or wrecked vehicles,trailers,machinery,or theirparts.
H.Outside storage or collection of any junk,scrap,garbage,un-sightly material,litter,or debris.
I.Abandoned sheds or buildings in a state of disrepair.
18.22.040 Accessory Buildings or Structures:Detached accessory buildings orstructuresarepermittedincompliancewiththeuseandbulkregula-
tions and performance standards of this chapter,provided that:
A.Detached accessory buildings or structures shall not exceed
sixteen feet (16')in height.
B.Detached accessory buildings or structures shall comply with thefrontandsideyardsetbackrequirementsofthischapter.
C.There shall be no required rear yard setback except as required by
the Uniform Building Code and the Uniform Fire Code.
D.No detached accessory buildings will be constructed over right-of-
way or a public/private easement.

18.22.050 Lot Size:
A.Lot area shall not be less than six thousand square feet (6,000')for a single family dwelling (onedwelling unit).
B.Lot area shall not be less than six thousand square feet (6,000')for non-residential uses.
C.Lot area for multi-family dwellings shall be governed by the fol-
lowing table:

For all units over fourteen (14),the total area requirementsshallbeincreasedonethousandtwohundred(1,200)square feetforeachaddedunit.

18.22.060 Flaq Lots:
A.Flag lots shall have a minimum of twenty feet (20')frontage uponadedicatedright-of-way.
B.The flag portion of the lot shall not be considered in determiningcompliancewiththebulkregulations,conditions,and performancestandardsofthischapter.
C.Private driveways shall be maintained and clear of obstruction toallowforaccessbyemergencyvehicles.
18.22.070 Lot Design Standards:Lots in the R-3 Zone shall be subdivided incompliancewithChapter17.28 of this code entitled "Design Standards."
18.22.080 Drainage:Roofs shall drain in such a manner that water will not flowontoapublicsidewalk.Water discharged from evaporative air condi-tioners shall be controlled by the owner so as to not discharge into asanitarysewerunlessapprovedbytheCityEngineerandshallnotflowontoacitystreetorontoadjacentlots.Paved areas exceeding twohundredsquarefeet(200')in area shall be provided with approveddrainagedisposalsystemsontheproperty,except in areas whereadequatestormdrainagesystemsareavailable.
18.22.090 Open Space:With every multi-family residence there shall be provided
a usable open area reserved on the lot for outdoor recreation spacewhichshallmeasurenotlessthanonethousandsquarefeet(1,000')for the first dwelling unit,and one hundred square feet (100')foreachadditionalunit.The open area shall he exclusive of parkingareasandfrontyard.The smallest dimension thereof shall be notlessthanfifteenfeet(15').Such open area need not exceed fivethousandsquarefeet(5,000')in area.
18.22.100 Setbacks:No building or structure shall be erected,altered,enlarged,
or relocated so that any portion thereof shall be nearer the propertylinesthanthedistanceindicatedbythedepthoftherequiredyardsetbackexceptasprovidedforinthischapter.
A.Front Yard:Each lot shall maintain a front yard setback not lessthanfifteenfeet(15').
8.Side Yard:Interior side yard setbacks shall not be less thanfivefeet(5')per side yard.
C.Rear Yard:Each lot shall maintain a rear yard setback not lessthanfivefeet(5')except that detached accessory buildings maybesitedwithintherearyardsetbackincompliancewithSection18.22.040 of this chapter.
D.Eaves,Cornices,and Awnings:Eaves,cornices,and awnings mayprojectintotherequiredsetbacksnotmorethantwofeet(2').Open porches,steps,terraces,fences,and platforms having noroofcoveringsmayprojectintothefrontyardsetbacks.
E.Through Lots:Through lots shall maintain not less than a fifteenfoot(15')setback from property lines on each parallel streetuponwhichthelothas.frontage.
F.Lakefront Lots:There shall be no rear yard setback requirementsforalotabuttingashoreline.Structures located wtihin alakefrontrearyardshallbeincompliancewithChapter18.45 ofthistitleentitledCRZone.
G.Corner Lots:Corner lots shall maintain a front yard and exteriorsideyardsetbacknotlessthanfifteenfeet(15').
H.Zero Lot Line:Single family detached dwelling units may belocatedinsuchamannerthatoneofthebuildingsidesrests onalotline.Zero lot lines may be permitted in compliance with
Chapter 18.67 of this title entitled Planned Development District
or as a variance of the setback requirements of this chapterprovidedthatprovisionsaremadeforatenfoot(10')accesseasementforconstruction,maintenance,and repairs.

I.Attached Single Family Residences:There shall be no commonsideyardsetbackrequirementforsinglefamilydwellingunitssharing
a commonwall or attachment on two lots of record.
18.22.110 Lots Fronting on Curved Streets:The required width of residentiallotsfrontingoncurvedstreetswaybereducedtonotlessthanfortyfeet(40')provided that the required lot area is obtained within onehundredtwentyfeet(120')of the front property line abutting acurvedstreetandthattheseshallbeaminimumsixty-five foot (65')1ot width at the front building line on the lot.
I 18.22.120 Signs and Billboards:Signs and billboards shall be in compliancewithChapter18.57 of this title.
18.22.130 Landscaping -Residential Lot:The area within the required frontyardsetbackshallbelandscapedwithinone(1)year of occupancy andmaintained.Landscaping shall be defined as the addition of lawns,trees,plants,shrubs,and other natural and decorative features totheland.
18.22.140 Landscaping -Commercial Lot:At least one square foot (1')per totallotfrontfootageshallbelandscapedandmaintained.For a cornerlot,the front footage shall be based on the street address frontageonly.This landscaping shall be located in the lot area between thestreetaddressfrontageandthepublicright-of-way.Landscapingshallbedefinedastheadditionoflawns,trees,plants,shrubs,andothernaturalanddecorativefeaturestotheland.
18.22.150 Shoreline Areas:All property developed within two hundred feet(200')of the high water line of Moses Lake or its associated wet-lands,and any associated uses relying on the shoreline for such useshallconformwiththecity's Shoreline Management Plan.
18.22.160 Parking:
i A.Parking requirements shall be in compliance with Chapter 18.54 ofthistitle.
B.Recreational equipment,including camping trucks,motor homes,
camping trailers,boats,boat trailers,and similar equipment maybeparkedorstoredonpremises.Recreational equipment stored orparkedwithinsideyardsetbacksshallbepermissibleprovidedtheoccupantsoftheadjoiningpropertyconsentthereto.
18.22.170 Vehicular Movement:
A.Vehicular movementand parking shall be consistant with the exist-ing pattern of vehicular movementand parking.Streets shall beincompliancewithcitydesignstandards.
B.Vehicle movement and parking generated from new developments shallnotexceedthedesigncapacityofcollectororminorstreets.
18.22.180 Satellite Receiving Antennas:Satellite receiving antennas shall besitedincompliancewiththefrontandsideyardsetbackrequirementsofthischapter.
18.22.190 Structures Over Easements or Right-of-Way:No building or structureshallbeconstructedorplacedoverdedicatedright-of-way or over anieasement.
18.22.200 Fences,Walls,and Hedges:Fences,walls,and hedges shall not exceedfourfeet(4')above finished ground level in any front yard orcornerlotexteriorsideyardnorexceedeightfeet(8')in any inter-ior side or rear yard.Electric fences and barbed wire fences shallbeprohibited,
18.22.210 Residential Density:Residential density shall be in compliance withSection18.22.050 of this chapter.

18.22.220 Maintenance of Lots:Lots in the R-3 zone shall be maintained so astonotcreateafirehazardandshallbefreeoflitter,debris,garbage,unsightly material,or weeds.
18.22.230 Vehicle Maintenance:There shall be no maintenance of vehicles oncityright-of-way.Oil and gasoline shall not be dumped on paved citystreetsorintocatchbasinsorstormsewers.
18.22.240 Maintenance of City Right-of-Way:The property owner shall be respon-sible for the maintenance of city right-of-way from the back side ofthecurb.
18.22.250 Uses:Uses within the R-3 zone shall not inflict upon adjacent prop-erty smoke,dirt,dust,glare,odors,steam,vibration,noise,elec-trical interference,or excessive hazard.Noise in the R-3 zone shallnotexceedthestandardssetforthinChapter8.18 of the Moses LakeMunicipalCodeentitled"Noise Control."
18.22.260 Building Heights:No building or structure shall exceed forty feet(40')in height.
18.22.270 Performance Standards Residential Structures:Exclusive of manufac-tured homes located in manufactured home parks which shall be incompliancewithChapter18.63 of this code entitled NMobile (Manufac-tured)HomeParks."
A.Manufactured Homes:
1.Each manufactured home shall be installed with a perimeter
masonr.yor concrete foundation.
2.All manufactured homes shall be set up in accordance with themanufacturer's specifications and as required by the BuildingOfficial.
3.Wheels and tongue of manufactured homes shall be removed.
B.Minimum Roof Pitch:Residential structures shall have a pitchedrooforthepitchofthemainroofshallbenotlessthantwoinches(2")of rise for each twelve inches (12")of horizontal
run.
C,MinimumWidth:The minimumwidth of the main portion of thestructureshallbenotlessthantwentyfeet(20')as measured
across the narrowest portion.
D.Roof Construction:Roof construction shall be of non-reflectivematerials.
E.Insignia Requirement:All mobile/manufactured homes not estab-lished as a permanent residence within the city prior to theeffectivedateofthisordinanceshallbeartheinsigniaofap-proval by the State of Washington or the U.S.Department ofHousingandUrbanDevelopmentindicatingcompliancewiththe 1974NationalMobileHomeConstructionandSafetyAct(effectiveJune15,1976).
18.22.280 Variances:A variance of the bulk regulations and performance stand-ards of this chapter may be obtained through the Zoning Board ofAdjustmentincompliancewiththeprovisionsofChapter18.78 entitled"Zoning Board of Adjustment."

18.22.290 Violation:
A.Upon occurrance of a violation of the provisions of this chapter,the Building Official shall notify the responsible person repre-senting the use in violation that a violation of this chapterexists.Such notice shall be in writing,identify the violation,and specify the time within which the prescribed action to correcttheviolationmustbetaken.The person in violation shall havenotlessthanseven(7)days from the issuance of the notice tocorrecttheviolation,unless,in the opinion of the BuildingOfficial,there is imminent peril to property and/or to the publicIhealth,safety,or general welfare in which case the violationshallbecorrectedimmediately.
B.Upon the failure,neglect,or refusal of any person so notified tocorrectaviolationofthischapter,the Building Official shallissueacivilinfractionnotice.
C.Any violation of the provisions of this chapter shall be punish-able as defined in Chapter 1.08 of the Moses Lake Municipal Code,
18.22,300 Severability:If any provision of this ordinance or its applicationtoanypersonorcircumstanceisheldinvalid,the remainder of theordinanceortheapplicationoftheprovisionstotheotherpersons orcircumstancesshallnotbeaffected.
Section 3.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasrequiredbylaw.
