1124_00001ORDINANCENO.1124 ANORDINANCEESTABLISHINGCHAPTER18.14 OF THEMOSESLAKE MUNICIPALCODEENTITLED"RR,RURALRESIDENCE,ZONE" THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 18.14 of the Moses Lake Municipal Code entitled "RR,RuralResidence.Zone"is hereby established as follows: I 18.14.010 Intent:The Rural Residence Zone is intended to provide certain areaswherearuraloragriculturalenvironmentisretainedthroughthepreservationofopenspace;to provide for the needs of citizens who desire to reside on small rural or estate acreages;and to act as atransitionzonebetweenagriculturalusesoropenspaceandmoreintensiveuses. The Rural Residence Zone shall include two categories as designated onthecityzoningmap-RR-A and RR-B,Manufactured homes shall beprohibitedintheRR-A category.Manufactured homes shall be permitted in the RR-B category. 18.14.020 Permitted Uses:Hereafter in the Rural Residence Zone no building, structure,or land shall be used and no building or structure shall be erected,altered,enlarged,or intended to be used for any other thanthefollowingoutrightpermittedusesorasaconditionaluse.Out-right permitted uses or conditional uses in the Rural Residence Zoneshallbeincompliancewithallperformancestandards,conditions,andbulkregulationsofthischapter. A.Outright Permitted Uses: 1.Single family detached dwelling units including factory built housing constructed to the standards of the Uniform BuildingCode, i 2.Any use which is incidental and subordinate to the principal use of the land or building;is located on the same lot withtheprincipaluse;and is not otherwise prohibited. 3.Accessory buildings and/or structures appurtenant to anypermittedusesincompliancewithSection18.14.040 of thischapter. 4.Cultivation of land for agricultural products,vine.yards,gardening,and fruit growing. 5.Keeping of livestock,poultry,rabbits,and bees in accordancewithSection18.14.050 of this chapter. 6.Selling of agricultural products raised or grown on the prem-ises. 7.Keeping of household pets (dogsand cats)not exceeding four(4)in numberwhich are four (4)months old or older. 8.Planned Development Districts in compliance with Chapter 18.67ofthistitle. I 9.Parks and non-commercial recreational uses. 10.An accessory dwelling unit intended to accommodatea member(s)of the immediate family requiring daily care,supervision,orguardianshipincompliancewithSection18.14.200 of thischapterentitledResidentialDensity. 11.Other unmentioned uses ruled by the Planning Commission to besimilartoandcompatiblewiththespecifiedpermitteduses. ORD.1124,Page 2 B.Conditional Uses:The following uses may be permitted by thePlanningCommissionasaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 of this title entitledConditionalandUnmentionedUses. 1.Cemetaries 2.Churches 3.Essential public services and utilities including buildingsandstructures 4.Golf courses 5.Homeoccupations 6.Other unmentioned uses ruled by the Planning Commission to be a conditional use provided that the use shall be similar toandcampatiblewiththeexpressedpermittedandconditionalUSGS. 7.Schools 8.Stables,riding academies,and commercial dog kennels 18.14.030 Prohibited Uses:Any use not expressly permitted outright or as aconditionaluseintheRRZoneshallbeprohibited,including but notlimitedtothefollowingexamples: A.Abandoned sheds or buildings in a state of disrepair B.Commercial uses except as provided in Section 18.14.020 A and B ofthischapter. C.Two family or multi-family dwelling unit structures except asprovidedforinSection18.14.010 A (9)of this chapter. D.Industrial uses E.Occupancy of trailers or recreational vehicles F.Public nuisances G.Removal of soil or other natural materials for the purpose of saleoruseasfillmaterialexceptthatexcavationforthepurposeofconstructionorlandscapingispermitted. H.Outside storage,collection,or dumping of dismantled,partlydismantled,or wrecked vehicles,trailers,machinery,or theirparts. I.Outside storage or collection of any junk,scrap,garbage,unsight-ly material,litter,or debris. 18.14.040 Accessory Buildings or Structures:Detached accessory buildings orstructuresarepermittedincompliancewiththeuseandbulkregula-tions and performance standards of this chapter,provided that: A.Detached accessory buildings or structures shall not exceed thirty feet (30')in height. 8.Detached accessory buildings or structures shall comply with thefrontandsideyardsetbackrequirementsofthischapter. C.No detached accessary buildings will be constructed oyer right-of- way or on a public/private easement. D.Accessory buildings or structures intended for the keeping and maintenance of livestock shall be in compliance with Section18.14.050 G of this chapter. E.There shall be no required rear yard setback for detached acces-sory structures except as required by the Uniform Building Code ortheUniformFireCode. ORD.1124,Page 3 18.14.050 Keeping of Livestock: A.Livestock,rabbits,fowl,and bees shall not be kept on any lot orparceloflandlessthanone(1)acre in size. B.Large livestock shall be defined as horses,mules,donkeys,burros,cattle,buffalo,sheep,goats,and similar animals. C.Small livestock shall be defined as rabbits,guinea pigs,chickens,ducks,geese,turkeys,and other similar fowl. I D.Not more than three (3)animals per acre of the large livestock category shall be kept on a lot or parcel of land exceeding one(1)acre in size exclusive of the lot area devoted to residential use. E.Not more than fifteen (15)animals or fowl of the small livestockcategoryshallbekeptforeachfivethousand(5,000)square feetoflotareaexclusiveofthelotareadevotedtoresidentialuse. F.Livestock,rabbits,fowl,and bees shall be cared for in such amanneraswillnotcreateanuisancesuchasnoise,odors,airpollution,waste,vibration,traffic,physical hazard,or health hazard. G.The keeping of swine shall be prohibited. H.Pens,barns,stables,coops,corrals,or other structures used forthecontainmentorhousingoflivestock,rabbits,fowl,or beesshallnotbelocatedcloserthanonehundredfeet(100')from anyneighboringresidentialstructure. 18.14.060 Lot Size: A.Lot size shall not be less than one (1)acre nor greater than teni(10)acres. B.Lots shall not be less than one hundred fift.y feet (150')in widthanddepth.No lot shall have less than forty feet (40')frontage on a dedicated street. 18.14.070 Flaq Lots: A.Flag lots shall have a minimumof forty foot (40')frontage on adedicatedright-of-way. B.The flag portion of the lot shall not be considered in determiningcompliancewiththebulkregulations,conditions,and performancestandardsofthischapter. C.Private driveways shall be maintained and clear of obstruction toallowforaccessbyemergencyvehicles. 18.14.080 Lot Design Standards;Lots in this zone shall be subdivided in com-pliance with Chapter 17.28 of this code entitled "Design Standards." 18.14.090 Drainaqe:Roofs shall drain in such a manner that water will not flowontoapublicsidewalk.Water discharged from evaporative air condi-tioners shall be controlled by the owner so as to not discharge into aisanitarysewerunlessapprovedbytheCityEngineerandshallnotflowontoacitystreetorontoadjacentlots.Paved areas exceeding twohundredsquarefeet(200')in area shall be provided with approveddrainagedisposalsystemsontheproperty,except in areas whereadequatestormdrainagesystemsareavailable. 18.14.100 Setbacks:No building or structure shall be erected,altered,enlarged, or relocated so that any portion thereof shall be nearer the propertylinesthanthedistanceindicatedbythedepthoftherequiredsetbackexceptasprovidedforinthischapter,the Uniform Building Code,and/or the Uniform Fire Code. ORD.1124,Page 4 A.Front Yard:Each lot shall maintain a front yard setback of notlessthantwenty-five feet (25'). B.Interior Side Yard:Each lot shall maintain an interior side yardsetbackofnotlessthantwentyfeet(20'). C.Rear Yard:Each lot shall maintain a rear yard setback not lessthantwenty-five feet (25')except that detached accessory build-ings or structures may be sited within the rear yard setback incompliancewithSections18.14.040 and .050 of this chapter. D.ERVes,Cornices,and AWnings:Eaves,cornices,and awnings mayprojectintotherequiredsetbacksnotmorethantwofeet(2'). Open porches,steps,terraces,fences,and platforms having noroofcoveringsmayprojectintothefrontyard. E.Lakefront Lots:There shall be no rear yard setback requirementforalotabuttingashoreline.Structures located within alakefrontrearyardshallbeincompliancewithChapter18.45entitledCRZone. F.Through Lots:Through lots shall maintain not less than a twenty-five foot (25')setback from property lines on each parallelstreetuponwhichthelothasfrontage. G.Corner Lots:Corner lots shall maintain an exterior side yardsetbackofnotlessthantwenty-five feet (25'). 18.14.110 Signs and Billboards:Signs and billboards shall be in compliancewithChapter18.57 of this title. 18.14.120 Landscaping:The area within the front yard shall be landscapedwithinone(1)year of occupancy and maintained.Landscaping shall bedefinedastheadditionoflawns,trees,plants,shrubs,and othernaturalanddecorativefeaturestotheland. 18.14.130 Shoreline Areas:All property developed within two hundred feet(200')of the high water line of Moses Lake or its associated wet-lands,and any associated uses relying on the shoreline for such useshallconformwiththecity's Shoreline Management Plan. 18.14.140 Parking: A.Parking requirements shall be in compliance with Chapter 18.54 ofthistitle. B.Recreational equipment,including camping trucks,motor homes,camping trailers,boats,boat trailers,and similar equipment maybeparkedorstoredonpremises.Recreational equipment stored orparkedwithinsideyardsetbacksshallbepermissableprovidedtheoccupantsoftheadjoiningpropertyconsentthereto. 18.14.150 Vehicular Movement and Parking: A.Vehicular movementand parking shall be consistant with the exist-ing pattern of vehicular movementand parking.Streets shall beincompliancewithcitydesignstandards. B.Vehicle movement and parking generated from new developments shallnotexceedthedesigncapacityofcollectororminorstreets. 18.14.160 Satellite Receiving Antennas:Satellite receiving antennas shall besitedincompliancewiththefrontandsideyardsetbackrequirementsofthischapter. ORD.1124,Page 5 18.14.170 Structures Over Easements or Right-of-Way:No building or structureshallbeconstructedorplacedoverdedicatedright-of-way or over aneasement. 18.14.180 Fences.Walls,and Hedges:Fences,walls,and hedges shall not exceed eight feet (8')above finished ground level.Solid fencing shall notobscuresightatintersection.Sight distances shall be as requiredinChapter17.28.030 of this title, 18.14.190 Residential Density:Residential density shall not exceed one (1)I dwelling unit per acre. 18.14.200 Maintenance of Lots:Lots in the RR Zone shall be maintained so as tonotcreateafirehazardandshallbefreeoflitter,debris,garbage,unsightly material,or weeds. 18.14.210 Vehicle Maintenance:There shall be no maintenance of vehicles oncityright-of-way.Oil and gasoline shall not be dumped on paved city streets or into catch basins or storm sewers. 18.14.220 Maintenance of City Right-of-Way:The property owner shall be respon-sible for the maintenance of city right-of-way from the back side ofthecurb. 18.14.230 ILSJtt:Uses within the RR Zone shall not inflict upon adjacent prop-erty smoke,dirt,dust,glare,odors,steam,vibration,noise,elec-trical interference,or excessive hazard.Noise in the R-1 Zone shall not exceed the standards set forth in Chapter 8.18 of the Moses LakeMunicipalCodeentitled"Noise Control." 18.14.240 Building Heights:No building or structure shall exceed thirty feet(30')in height. 18.14.250 Performance Standards Residential Structures i A.Manufactured Homes: 1.All manufactured homes shall be placed on a foundation or onfootingsandpiersoronblocksinaccordancewiththemanu-facturer's specifications or other specifications required bytheBuildingOfficial. 2.Each manufactured home shall be installed either with approvedcompatibleskirtingmaterialoraperimetermasonryfounda-tion. B.Minimum Roof Pitch:Residential structures shall have a pitched roof or the pitch of the main roof shall be not less than twoinches(2")of rise for each twelve inches (12")of horizontal run. C.MinimumWidth:The minimum width of the main portion of thestructureshallbenotlessthantwentyfeet(20')as measured across the narrowest portion. D.Roof Construction:Roof construction shall be of non-reflectivematerials. E.Wheels and Tonque:Wheels and tongue of all manufactured homesishallberemoved. F.Insignia Requirement:All mobile/manufactured homes not estab-lished as a permanent residence within the city prior to theeffectivedateofthisordinanceshallbeartheinsigniaof ap-proval by the State of Washington or the U.S.Department ofHousingandUrbanDevelopmentindicatingcompliancewiththe 1974NationalMobileHomeConstructionandSafetyAct(effective June15,1976). ORD.1124,Page 6 18.14.260 Variances:A variance of the bulk regulations and performance stand-ards ot'this chapter may be obtained through the Zoning Board ofAdjustmentincompliancewiththeprovisionsofChapter18.78 entitled"Zoning Board of Adjustment." 18.14.270 Violation: A.Upon occurrance of a violation of the provisions of this chapter,the Building Official shall notify the responsible person repre-senting the use in violation that a violation of this chapterexists.Such notice shall be in writing,identify the violation,and specify the time within which the prescribed action to correcttheviolationmustbetaken.The person in violation shall havenotlessthanseven(7)days from the issuance of the notice tocorrecttheviolation,unless,in the opinion of the BuildingOfficial,there is imminent peril to property and/or to the publichealth,safety,or general welfare in which case the violationshallbecorrectedimmediately. B.Upon the failure,neglect,or refusal of any person so notified tocorrectaviolationofthischapter,the Building Official shallissueacivilinfractionnotice. C.Any violation of the provisions of this chapter shall be punish-able as defined in Chapter 1.08 of the Moses Lake Municipal Code. 18.14.280 Severability:If any provision of this ordinance or its applicationtoanypersonorcircumstanceisheldinvalid,the remainder of theordinanceortheapplicationoftheprovisionstotheotherpersons orcircumstancesshallnotbeaffected. Section 2.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasrequiredbylaw. Adopted by the City Council and signed by 13,1983.
