ORDAINAS FOLLOWS: Section 1.Chapter 8.08 of the Moses Lake Municipal Code entitled "GarbageCollection"is hereby amended as follows: 8.08.010 Applicability:This chapter shall apply to all territory embracedwithinthecorporatelimitsofthecityandtheareaofpolicejuris-diction thereof. 8.08.020 Intent:The maintenance of health and sanitation require,and it istheintentionofthischaptertomake,the collection,.removal,anddisposalofgarbage,refuse and dead animals within the .city compul-sory.However,collection service is not required when written noticehasbeengiventhecit.y requesting a cessation of service where abuilding,whether commercial or residential,is vacant or if a build-ing is used for storage or similar type use and has no living quarters,no office facilities,per se,or if the business occupying the build-ing is closed for business and no garbage,rubbish,refuse,solidwaste,or other waste material is produced. 8.08.030 Definitions:The following words and phrases shall apply in thischapter: 1."Agricultural Waste"means all solid waste generated by the grow-ing,washing,or preparation for marketing of agricultural pro-ducts,without cooking,blanching,or other processing. 2."Ashes"means solid waste products of coal,wood,or other fuelsusedforheatingandcooking,from all public and private estab-lishments and from all residences. 3."Collector of Rufuse"means the individual,firm,association,co-partnership,corporation,or any other entity whatsoever,includ-ing the City of Moses Lake which collects the garbage,rubbish,refuse,solid waste,or other waste material in the City of MosesLakeunderanyarrangementwhatsoever. 4."Combustible Rubbish"or "Burnable Material"means,in general,the organic component .of refuse,paper,rags,cartons,boxes,wood,excelsior,furniture,bedding,rubber,plastics,.1eather,tree branches,lawn trimmings,and the like. 5."Commercial Refuse"means all solid wastes which originate inbusinesses,office buildings,stores,markets,theaters,and otherbuildings.The point at which any of the refuse becomes solidwasteandistheresponsibilit.y of the city garbage contractorshallbedetenninedbythesanitationtechnicianofthecity, 6."Compactor Collection Truck"means an enclosed vehicle providedwithspecialmechanicaldevicesforloadingtherefuseintothemaincompartmentofthebody,for compressing the.loaded materials,and for distributing the refuse within the body. 7."Construction and Demolition Wastes"means building materials andrubbTeresultingfromconstruction,remodeling,repair and demoli-tion operations on houses,commercial buildings,pavements,andotherstructures. 8."Containers"means small receptacles (one-to ten-cubic-yardcapacity)that can be emptied by compactor collection trucks onsite. 9."Disposal Site"means the location where any treatment,utiliza-tion processing or deposition of solid waste occurs, ORD.1128/Page 2 10."Drop Box Site"means a loading site where small loads of solid waste are dumped into a large container for transport to a pro-cessing and/or disposal site. 11."Functional Standards"means the criteria for solid waste handling expressed in terms of expected performance. 12."Garbage"means all putrescible material including all putrescible animal and vegetable wastes resulting from the handling,prepara-tion,cooking,and consumption of food;swill and carcasses ofdeadanimals,except sewage,sewage sludge and humanbody wastes. 13."Groundwater"means water in the ground that is in the zone ofsaturation. 14."Hazardous Wastes"means dangerous wastes requiring special handl- ing including,but is not limited to,explosives,pathological wastes,radioactive materials and chemicals. 15."Industrial Solid Waste"means all solid wastes which result fromindustrialprocessesandmanufacturingoperationssuchasfactor- ies,processing plants,repair and cleaning establishments,refin-eries and rendering plants. 16."Institutional Solid Waste"means solid waste generated by hospi- tals,nursing homes,schools,prisons,reformatories,or otherbuildingshousinganorganizationhavingsocial,educational,orreligiouspurpose. 17."Jurisdictional Health Department"means city,county,city-county,or district health department. 18."Landfill"means the solid waste disposal process using land for the final disposal site. 19."Noncombustible Rubbish"means material that is unburnable atordinaryincineratortemperatures(one thousand three hundred totwothousanddegreesFahrenheit).For the most part,it is theinorganiccomponentofrefuse,such as tin cans,heavy metal, mineral matter,glass,crockery,dust,metal furniture,ashes,and the like. 20."Offal"means intestine and discarded parts from the slaughter of animals. 21."On-site Disposal"includes all means of disposal or,more usually, volume reduction,of refuse on premises before collection.Exam- ples are garbage grinding,burning or incineration,burial,com-paction or slurrying at homes and commercial establishments. 22."Open Burning"means the burning of solid wastes in an open area or burning of solid wastes in a type of chamber or vessel which is not approved in regulations. 23."Open Dumping"means the depositing of solid wastes into a body orstreamofwater,or onto the surface of the ground without compac-ting the wastes and covering with suitable material to a suitable depth that would prevent vector nuisance and pollution problems. 24."Pathogen"means any infective agent capable of producing disease; it may be a virus,rickettsia,bacteria,protozoan,etc. 25."Person"means an individual,firm,association,copartnership, political subdivision,government agency,municipality,industry, public or private corporation,or any other entity whatsoever. ORD.1128/Page 3 26."Pollution"means the presence in the environment or portion of the environment of contaminating substances,materials,forms ofanimalsorplantlifeinsufficientquantitiesandofsuchcharac-teristics and duration,as is or is likely to be,injurious tohumans,to other plant or animal life,or property,or whichunreasonablyinterfereswithenjoymentoflifeandproperty. 27."Processing of Waste"means the operation of solid waste whichconvertsawasteintosomethinguseful,leaving the term "handl-ing"to describe what is done to prepare it for disposal. I 28."Pull-on Container"means a detachable container system in which alargecontainer(aroundtwenty to fifty cubic yards)is pulled onto service vehicle mechanically and carried to disposal site foremptying. 29."Putrescible"means capable of being decomposed by micro-organisms with sufficient rapidity as to cause nuisances from odors,gases,etc.Kitchen wastes,offal,and dead animals are examples ofputresciblecomponentsofsolidwaste. 30."Refuse"means "Solid Waste"as defined in subsection 38 of thissection. 31."Refuse Fill"means "Landfill"as defined in subsection 18 of thissection. 32."Rendering"means a process of salvaging fats and oils,animalfeedandotherproductsfromanimalwastebycooking.Dead ani-mals,fish and wastes from slaughter houses and butcher shops arecommonlyused. 33."Rubbish"means all discarded nonputrescible solid waste exceptashes,including paper,cardboard,tin cans,wood,glass,bedding,yard clippings,etc. I 34."Salvage"means reclaimable solid waste such as paper,metal,bottles,or other objects saved for the purpose of sale or other use not prohibited by law,rule,or regulation. 35."Sanitary Landfill"means a method of disposing of refuse on landwithoutcreatingnuisancesorhazardstopublichealthorsafety,by utilizing the principles of engineering to confine the refusetothesmallestpracticalarea,to reduce it to the smallestpracticalvolume,and to cover it with a layer of earth at theconclusionofeachday's operation or at such more frequent inter- vals as may be necessary. 36."Sanitation Technician"means the city offical or employee of thecitydelegatedandauthorizedtoadministerthischapter. 37."Scavenging"means the uncontrolled picking of materials. 38."Solid Waste"means all putrescible and nonputrescible solid andsemisolidwastes,including garbage,rubbish,ashes,industrial wastes,demolition and construction wastes,abandoned vehicles orpartsthereof,discarded home and industrial appliances,manure,vegetable or animal solid and semisolid wastes and other discardedmaterial.The point at which any of the above becomes solid waste I and is the responsibility of the city garbage contractor shall bedeterminedbythesanitationtechnicianofthecity. 39."Solid Waste Disposal"means final disposition of solid waste byacceptablemeans. 40."Solid Waste Handling"means the storage,collection,transporta-tion,treatment,utilization,processing,and final disposal ofsolidwastes. ORD.1128 ge.4 41."Special Wastes"means wastes difficult or unusual in the charac-teristics of quantities or composition to handle. 42."Street Refuse"means material picked up by manual and mechanicalsweepingofstreetsandsidewalks,litter from public litterreceptacles,and dirt removed from catch basins. 43."Surface Water"means a body of water whose top surface is exposedtotheatmosphereincludingaflowingbodyaswellasapondorlake. 44."Swill"means the semiliquid animal or vegetable waste of kitchens,market or stores. 45."Transfer Station"means a loading site where solid waste istransferredfromonevehicletoanotherfortransfertoafinaldisposalsite. 46."Trash"means "Rubbish",as defined in subsection 33 of thissection. 47."Unsanitar.y Condition"means any situation which negatively effectsthehealthandgeneralwelfareofhumansorisofsuchacharacter so as to be likely to be injurious to humans,plant or animallife,or property,or which unreasonably interferes with theenjoymentoflifeorproperty. 48."Vacant"means not lived in or occupied. 49."Vector"(of disease)means a living insect or other arthropod,oranimal(not human),which transmits infectious diseases from onepersonoranimaltoanother. 50."Waste"means useless,unused,unwanted,or discarded materials.Waste includes solids,liquids,and gases.The gases are princi-pally industrial fumes and smoke;the liquids consist mainly of sewage and the fluid part of industrial wastes,the solids areclassedasrefuseorsolidwastes. 8.08.040 City Sanitary Division: A.For the purpose of carrying into effect the provisions and aims ofthischapter,there is created and established a division to beknownasthecitysanitarydivision. B.The City Manager is empowered and authorized and may appoint asuitableandqualifiedpersonassanitationtechnicianandthispersonshallhavefullchargeandcontrolofalltheworkprovidedforandcontemplatedunderthischapterandasmaybeprovidedforbyrulesandregulationssubsequentlyadopted.He shall also havechargeofallcollectionsandtheenforcementofallchargesforservicesrendered.In the absence of the appointment of a Sanita-tion Technician,the City Manager may designate an individualemployedbythecityoracitydepartmenttoperformthefunctionsofaSanitationTechnician. 8.08.050 Sanitation Fund:There is created and established a special fundknownanddesignatedastheSanitationFund,into which all sumscollectedunderthischaptershallbedepositedandkeptbytheTrea- surer of the city and from which all expenses of the administration and operation of this chapter shall be paid. 8.08.055 Collection -Contract: A.The City Council may authorize the entering into of a contractwithacontractororcontractorsforthecollection,removal,anddisposalofallgarbage,rubbish,refuse,solid waste,or otherwastematerial;provided,however,that the City Council may,atitsoption,authorize the City of Moses Lake to handle the collec-tion,removal,and disposal of garbage,rubbish,refuse,solidwaste,and other waste material by the City of Moses Lake. ORD.1128/Pg.5 B.The contractor shall be a person who,in the minds of the CityCouncil,is the lowest responsible bidder.Such contract shall bemadeatleasteveryfiveyearsormorefrequentlyifdesired.The contractor shall furnish a corporate surety bond to the city in asumsetunderthecontract,conditioned upon the faithful perform- ance of his contract and in compliance with all ordinances of thecityandallrules,regulations,laws,and statutes relating tohisbusinessincludingtheprovisionsofthischapterandinadditionprovideforpaymenttoalllaborors,mechanics,andsubcontractorsandmaterialmen,and all persons who shall supplysuchcontractorwithprovisionsandsuppliesforcarryingonsuchIwork. C.As a breach of the service provided by this contract would causeseriousandsubstantialdamagetothecityanditsresidents,and the nature of this contract would render it impractical or ex-tremely difficult to fix the actual damage sustained by the citybysuchbreach,it is agreed that in case of such breach of ser-vice the city may elect to collect liquidated damages for eachsuchbreach,and the contractor will pay to the city as liquidated damages,and not as a penalty,the amount specified therefor inthecontractsuchsumsbeingagreedastheamountwhichthecitywillbedamagedbythebreachofsuchservice.An election toseeksuchremedyshallnotbeconstruedasawaiverofanyrem-edies that the city may have as to any subsequent breach of ser-vice under the contract. D.Any contract with the contractor may be terminated by the city at any time for cause,or for failure to comply with the terms of thecontractwiththecityortheprovisionsofthischapterandreasonableregulationsimposedpursuantthereto. 8.08.060 Container Regulations: i A.It shall he the duty of every person in possession,charge or incontrolofanydwelling,flat,roominghouse,apartment house,oreatingplaceorinpossession,charge,or in possession,charge orcontrolofanyshop,place of business,or manufacturing estab-lishment at all times,to keep or cause to be kept,portablecontainersorgarbagecansofapprovedsize,type,and construc-tion,and to deposit or cause to be deposited the refuse therein.Additionally,plastic garbage bags may be utilized in accordancewithSubsectionBinlieuoforinadditiontousingportablecontainersorgabargecans. B.Containers or garbage cans shall be constructed in such a mannerastobestrong,not easily corrodible,rodent-proof,insect-proof,and of not less than fifteen-gallon and not more thanthirty-gallon capacit.y.and shall have two handles at the sidesthereof.Refuse or garbage containers shall not be filled withdishwaterorotherliquidorsemiliquidkitchenwastes,which areproperlydisposabledownsanitarydrains.Such containers andgarbagecansshallbekeptinasanitaryconditionwiththeout-side thereof clean and free from accumulative grease and decom-posing material.Plastic bags containing putrescible waste shallbeplacedinacontainerorgarbagecan.Plastic bags containingnon-putrescible waste do not necessarily have to be placed in acontainerorgarbagecan.I C.In residential neighborhoods every container or garbage can on thedaydesignatedforcollection,shall be kept in a place accessibletothecollectorofgarbageandrefuse.Where alley access isavailable,all containers shall be placed at the alle.y line.Where no alley access is available,all containers shall be placedatthecurblineonthedaydesignatedforcollectionandonallotherdaysshallberemovedfromstreetview.Commercial accountsshallhavetheircontainersplacedinalocationaccessibletothecollectorofgarbageandrefuse.Safety and maneuverability ofthecollectorofrefuse's vehicles shall be prime considerations,but not the only considerations,in determining accessibility.The Sanitation Technician shall be the determiner of accessibility ORD.1128/Pg.6 after conferring with the collector of garbage and refuse.If there is a dispute between the Sanitation Technician and thecollectorofgarbageandrefuseastoaccessibility,the CityManagershallmakethedeterminationastowhetheralocation is accessible.The decision of the City Manager shall be final.The collector of garbage and refuse shall pick up all commercialaccountswherethecontainerislocatedwhetherthelocation is onprivateorpubliclyownedproperty. D.Each container shall be kept clean inside and out so that no odornuisanceshallexist.It shall be the responsibility of the ownerofthecontainerorgarbagecantokeepsuchcontainerorgarbage can clean unless this responsibility is altered by contract be- tween the city and the collector of garbage and refuse.In such asituation,the contract shall control.The area around thecontainersshallbekeptinaneatandsanitar.y condition.The Sanitation Technician shall place tags on garbage containers foundtobeinviolationofthissubsectionandnotifytheproperty owner when the areas around the container are not being kept in aneatandsanitarycondition.All tags and notifications shall be dated and signed by the Sanitation Technician.Twoor more viola- tions of this provision of this section shall subject the personresponsibletothepenaltiesdescribedinChapter1.08 of this code. E.Those containers found to be defective or illegal (defectivebottomscrushedsothatlidswillnotfit,fifty-five gallonbarrels,waste baskets,paper drums)or any other containers that are found to be illegal shall be subject to impounding and dispo- sal.If a container received two violations within a thirty-dayperiod,the Sanitation Technician of the city will impound it. The container shall be stored by the city not to exceed ten days. If after ten days the owner has not claimed and agreed to repairtheillegalcontainer,it will be disposed of by the city.The impoundment of an illegal container shall not relieve the ownerfromcompliancewithregulationsinthischapter. F.No garbage or refuse container or garbage can shall contain earth,rocks,or heavy refuse.Any container requiring a man to lift it shall not exceed seventy-five pounds in total weight of containerandrefuse. G.Customers must restrain vicious dogs beyond reach of the garbage containers and prevent any interference with the pickup man onthisaccount. H.Large,suitable containers for collection of garbage and refuse may,with the approval of the Sanitation Technician,be used in the business and commercial zones.Such containers shall be supplied by the collector of garbage and refuse if the collector of garbage and refuse is so required by his contract with the city,however,that does not preclude any person from owning their owncontainer(s)if they so desire. I.Compactors for industrial and commercial users shall have a double stage pump capable fo developing a pressure of at least 1600 psi. The pressure on the ram face shall be a minimum of 40 psi.Com- pression ratio shall be a minimum of 3:1.The Sanitation Tech- nician shall approve all compactors used for commercial or indus- trial uses.These compactors shall be designed to be compatible with local sanitation transportation equipment. J.All containers,compactors,and dumpsters shall comply with the ConsumerProducts Safety Commission laws and regulations. K.It shall be the duty of every person in possession,charge,orcontrolofanydeadanimaloruponwhosepremisesthesamemay be located,to forthwith cause the same to be removed and disposed of by the collector of refuse. ORD.1128/Pg.7 L.No person shall place their garbage,rubbish,refuse,solid waste, or other waste material in the container or garbage can of another. 8.08.070 Unlawful Disposal -Permits -Compost: A.It is unlawful for any person to burn,dump,collect,remove,orinanyothermanner,dispose of garbage,rubbish,refuse,solid waste,other waste material,or swill upon any streets,alleys,public place or private property within the city otherwise than asprovidedinthischapter.I B.No person shall maintain on his premises in any residential zoneinthecityanyreceptacleforoutdoorburningofwastepaper,boxes,rubbish,paper,or cardboard.Persons in any zone may burn brush,leaves,grass,wood,limbs,weeds,or other vegetable typematterintheopenorinareceptaclesolongasanopenburning permit is obtained from the Moses Lake Fire Department and allotherlocal,state and federal laws are observed.In commercialandindustrialzonesincineratorsmaybeconstructedinaccordancewithstandardssetbytheBuildingOfficialasadministeredundercontrolsoftheUniformBuildingCode. C.No compost pile shall be kept or maintained unless sufficientappropriatematerialorsubstance,approved by.the SanitationTechnician,is used to prevent the presence of flies,insects,bugs,rodents,or other pests or menance to public health andwelfare. 8.08.080 Collection Frequency:The collector of garbage and refuse shallcollect,remove,and dispose of all garbage and refuse in the residen-tial sections of the city at least once each week,and in the businessandcommercialzonesofthecityasrequired. 8.08.085 Ownership of Collected Waste:The collector of garbage and refuse i shall have title to all garbage,rubbish,refuse,solid waste,andotherwastematerialafterthematerialhasbeencollectedbythecollectorofgarbageandrefuse. 8.08.090 Separation of Garbage:The city reserves the right to and may havetheoptiontorequiretheseparationofpaperorswillorothercom-ponent parts of refuse,and may require the deposit thereof in separ-ate cans or receptacles and may prescribe the method of disposalthereof. 8.08.100 Hotels and Restaurants:It is unlawful for any person,firm,orcorporationconductinganyhotel,restaurant,or any public eatingplacetodeposit,throw,or.place swill or other refuse matter in alane,alley,street,or other public place,or to deposit,throw,orplaceanyswilluponanyproperty,regardless of ownership,unless theswillisenclosedinvesselsortanksoftypeapprovedbytheSanita-tion Technician,and which are perfectly watertight and have tightlyfittingcovers,which covers shall not be removed,except when abso-lutely necessary for the depositing and removal of swill.Such ves-sels or tanks shall be kept in the rear of the premises or in thebasement,or other place authorized by the Sanitation Technician,soastobereadilyaccessibleforcollectionandshallnotbekeptuponthestreet,alley,or sidewalk or public place.All such tanks orvesselsshallbepromptlydeliveredtothecollectorwhencalledfor i and shall be returned by him without unnecessary delay,and no person,except for the purpose of collection under license,shall in anymannerinterferewiththevesselsortanksorwithcontentsthereof. 8.08.105 Construction and Demolition Waste:Construction and demolition wastemayberemovedbythepersonorhisagentproducingsuchwasteortheymayhavethewasteremovedbythecollectorofrefuse. ORD.1128/Pg.8 8.08.108 Hazardous Waste:Hazardous waste shall not be the responsibility ofthecollectorofgarbageandrefuseandshallbedisposedofinac-cordance with all local,state,and federal law directly by the personproducingsuchwaste.Whether waste is considered hazardous waste isthedecisionoftheSanitationTechnicianandhisdecisionisfinal. 8.08.110 Disposal of Garbage and Other Refuse:All disposal of refuse shall bebysanitar.y fill method or methods specifically approved by the stateDepartmentofHealth;provided,that the method or methods shallincludethemaximumpracticablerodent,insect,and nuisance controlattheplaceofdisposal;and,provided further,that animal offal and carcasses of dead animals shall be buried or cremated as directed bytheSanitationTechnicianershallberenderedatfortypoundspersquareinchsteampressureorhigher,or heated by equivalent cooking. 8.08.120 Compliance:Every person shall be responsible for disposal of allgarbagepromptlyaccordingtothetermsofthischapterandrules andregulations. 8.08.130 Duties:It shall be the duty of ever.y person or companyto causetheirgarbageandrefusetoberemovedanddisposedofonlybythecollectorofgarbageandrefuse. 8.08.133 Billing -Service Charges: A.The city shall perform all billing of customers,the collection ofcharges,service initiation,changes .in service and service dele-tions and will pay the contractor in accordance with his contract.The city maywithhold payment to the contractor of any billsdisputedbyacustomerforanyreasonuntilthedisputeis re-solved. B.Charges for refuse collection and disposal may be billed sepa-rately or in conjunction and simultaneously with statements issuedbythecityforwaterandsewer.However,the form of billing shall be at the city's discretion.If charges for refuse collec-tion and disposal are billed in conjunction and simultaneous withstatementsissuedbythecityforwaterandsewercharges,allpaymentsreceivedfromacustomershallbecreditedfirsttopastduegarbagecharges,then the remainder,if there be any,first topastduesewerchargesthentopastduewatercharges.Payments on current accounts shall be credited first to garbage chargesthentheremainder,if there be any,to sewer charges then towatercharges. C.The billing for garbage service shall be made in the name of the owner of the real estate served but can be sent to an addressotherthanthatoftheowneroftherealestate.If the owner oftherealestatewishesthebillsenttoanotheraddress,the owneroftherealestatefirstmustexecuteaformprovidedforbystheCityofMosesLakeindicatinghisdesires.The form shall con-tain,at a minimum,the owner of the real estate's name and ad-dress,the address to which he wishes the bill sent,and a state- ment that if the person at the address to which the bill is sent moves and leaves an unpaid balance,the owner of the real estaterecognizeshisresponsibilityforthebill. D.The charges or accounts shall be paid at the city hall 30 days after the date of billing,and if not paid,shall become delin- quent on the 31st day after the date of billing.Service may be suspended for nonpayment of such accounts.Such suspension shall not relieve the person owing such account from the duty of comply- ing with the provisions of this chapter.Such suspension shall render the premises where such service is suspended,subject tocondemnationforsanitaryreasons. E.Upon failure to pay the charges for garbage collection and dis- posal,the amount thereof shall become a lien against the real estate as provided for by law. ORD.1128/Pg.9 8.08.135 Utility Tax Passthrough: A.Section 3.28.050 provides in part for the collection of a utility tax upon every person,including the city,who engages in orcarriesonthebusinessofsellingorfurnishingsanitationorgarbagefacilitiesand/or service for domestic or industrial use.As a result of the operation of the cit.y sanitary division,thecityissubjecttotheutilitytaximposedbySection3.28.050. B.The city is authorized to collect the percentage of gross income I portion of the utility tax imposed by Section 3.28.050 from the users of the city's sanitary services by including on each user'sbillingthesumthecitywouldbeliabletopayasautilitytax on that basis. 8.08.140 Fee Schedule:Commencing with billing dates after October 1,1981,except as has been otherwise provided,services and charges for gar-bage collection shall be as follows: A.Residential Rates:Regular service at the curb or alley forcollectiononceperweekshallbe$5.25.Service fees for du-plexes shall be in accordance with the service fees as shown onScheduleAofOrdinance1029foundonfileintheofficeoftheCityClerk.Service fees for condominiums shall be the same astherateforregularresidentialserviceandshallbeeffective with billing dates after July 1,1981. B.Commercial Rates:Service fees for,including but not limited toapartments,motels,planned unit developments,and trailer park rate shall be in accordance with the service fees as shown inScheduleAofOrdinance1029foundonfileintheofficeoftheCityClerk. C.Additional or Special Services:Additional or special servicesdesiredbyresidentialcustomersshallbearrangedandpaidfor i through the city. D.No garbage customer or account shall pay more than $25 per monthforbillingservicesprovidedbytheCityofMosesLake. 8.08.150 Administration: A.If a homeoccupation is carried on in a residential zone as al-lowed by the Planning Commissionunder the Moses Lake MunicipalCode,the resident shall pay only for residential service so long as there is never more than four garbage cans per week put out forcollection.In the event a dispute arises over whether a homeoccupationshouldberequiredtopayresidentialorcommercialrates,the Sanitation Technician shall make the determination astowhatserviceisbeingusedorshouldbeusedandthereforwhatserviceistobecharged.The decision of the Sanitation Techni- cian shall be final. B.If a commercial building with a single entrance,exclusive of fireexists,has multiple tenants,the owner of the real estate shallhavetheoptionofpayingforserviceforallthetenantsortheowneroftherealestateuponnotifyingtheCityofMosesLakeoniaformprovidedbythecitycanrequirethetenantstopayforindividualservices.The form shall provide that in the event thetenantfailstopayfortheservicerendered,the owner of therealestateshallassumeresponsibilit.y for the debt and agree topaythesame.The form shall also provide that if the service isconvertedfromasingleservicetomultipleservicesorviceversatheaccountoraccountsmustbepaidinfullbeforethechangeismade. ORD.1128/Pg.10 C.If two or more types of service are available to a garbage account,both which adequately and satisfactorily serve the account,theowneroftherealestateorthepartyreceivingtheservice,de-pending upon the circumstances,shall have the option of selectingtheservicehewishestoreceivesolongasnounsanitarycondi-tion is created as a result of the service selection of the owneroftherealestateorthepartyreceivingtheservice.If adisputearisesbetweentheowneroftherealestateorthepartyreceivingtheserviceandthecollectorofrefuseconcerningthetypeofcollectionserviceanaccountshouldbereceiving,theSanitationTechnicianshallmakethedeterminationastowhat typeofserviceistobecharged.The decision of the SanitationTechnicianisfinal. D.The type of service to be utilized by commercial accounts and theattendantfeeshallbeagreeduponbytheowneroftherealestateservedorthepartyreceivingtheservice,depending upon thecircumstances.If a dispute arises between the owner of the realestateorthepartyreceivingtheserviceandthecollectorofrefuseconcerningthetypeofcollectionserviceanaccountshouldbereceiving,the Sanitation Technician shall make the determina-tion as to what type of service is to be charged.The decision oftheSanitationTechnicianshallbefinal. E.If a single commercial building contains more than one business,the owner of the real estate or the party or parties receiving theservice,depending upon the circumstances,.may elect a singleservicetoservetheentirebuildingorcomplex.The city mayrequirethattheowneroftherealestateorthepartyoroneofthepartiesreceivingtheserviceberesponsiblefortheentireaccount. F.The city shall have the power,from time to time,by resolution orafterCouncilconsiderationbymotiondulymadeandpassed,to setforthanddetermineadditionalrulesandregulationsandothermattersasmaybenecessaryinthediscretionoftheCityCouncilfortheproperexecutionofthischapter. 8.08.160 Violation -Penalty:A violation of this section shall be punishable as defined in Chapter 1.08 of the Moses Lake Municipal Code. Section 2.This ordinance shall take effect and be in force on September 1,1984 so long as publication has been provided as required by law.
