"PAWNBROKERSANDSECONDHANDDEALERS
THECITY COUNCILOF THECITY OF MOSESLAKE;WASHINGTON,DOORDAINAS FOLLOWS:
Section 1.Moses Lake Municipal Code Chapter 5.20 entitled "Pawnbrokers"is
I repealed on the effective date of this ordinance.
Section 2.Moses Lake Municipal Code Chapter 5.32 entiteld "Secondhand
Dealers"is repealed on the effective date of this ordinance.
Section 3.There is created a new Moses Lake Municipal Code Chapter 5.22 en-titled "Pawnbrokers and Secondhand Dealers"to provide as follows:
5.22.010 License Required:Every person;firm,or corporation who shall
engage in the business of being a panwbroker as defined in RCW
19.60.010,or who shall engage in the business of being a second-
hand dealer as defined in RCW19.60.015 within the city,shallfirstobtainalicensetodoso.It shall be a violation of this
chapter and a separate civil infraction for each day a business is
conducted in violation of this chapter.
5.22.020 License -Application and Fee:Application for a license under
this chapter shall be in writing filed with the Finance Department
on forms furnished by the city and shall be accompanied by a fee
of seventy-five dollars ($75).The application shall be referred
to the Police Department for review.The application,togetherwiththePoliceDepartment's recommendation shall be forwarded to
the City Council for its consideration.If the Council approvestheapplicationitmay,by resolution,direct the issuance of thelicensebytheFinanceDirector.
I 5.22.030 Records:Every secondhand dealer and pawnbroker shall maintain the
records required by RCW19.60.020 and such records shall be subject
to inspection as provided by RCW19.60.030.
5.22.040 Reports:Every pawnbroker and secondhand dealer shall make the
reports required by RCW19.60.040.
5.22.050 License -Revocation:Any license issued under the provisions of
this chapter shall be subject to revocation for any violation of
the ordinance of the city,any state law,or any federal law.The
license shall be revoked by the Finance Director upon his deter-
mination that a violation has occurred.A notice stating the par-ticulars of the reason for the revocation shall be delivered per-
sonally to the licensee or mailed to the licensee's address at
least one (1)day prior to the effective date of the revocation of
the license.The licensee may file a notice of appeal of theFinanceDirector's decision within ten days of the Finance Direc-
tor's decision.Such appeal shall be heard by the City Council
within 30 days at a regularly scheduled Council meeting.The deci-
sion of the City Council shall be final.
5.22.060 Violation -Civil Infraction:Every violation of any of the provi-
sions of this chapter is a violation of this chapter and will sub-I ject the violator to a civil penalty as provided in Chapter 1.08.
Section 4.This ordinance shall take effect and be in force five (5)days
atter its passage and publication as provided by law.
