ANORDINANCEAMENDINGCHAPTER13.12 OF THE MOSESLAKEMUNICIPALCODEENTITLED"WATERANDSEWERRATES"
THECITY COUNCILOF THE CITY OF MOSESLAKE;WASHINGTON00 ORDAINAS FOLLOWS:
Section 1.Chapter 13.12 of the Moses Lake Municipal Code entitled "Water andiSewerRates"is amended as follows:
13.12.050 Surcharge:
A.In addition to the rates established for water and sewer ser-vices as set forth in this chapter;a twenty-five percent(25%)surcharge shall be assessed for water service and sewerservicefurnishedoutsidethecitylimits.
B.An additional surcharge shall be assessed for water and sewerservicesfurnishedoutsidethecitylimitsforatwenty(20)year period as follows:
1.All the properties owned by Willamette Industries as ofJanuary1986inSection17;Township 19 North;Range 29EWMshallbeassessedatenpercent(10%)additionalsurchargeforwaterandsewerservices.
2.All the properties connected to the Wheeler Road trans-mission main and Reservoir #6 standpipe east of L NEshallbeassessedatwenty-five percent (25%)additionalsurchargeforwaterandsewerservicesexcepttheprop-erties described in #1 above.
If any other property used for commercial or industrial pur-i poses connects to the Wheeler Road transmission main andReservoir#6 standpipe east of L NE;the customer utilizingthewatersystemshallalsoparticipate;on a pro rata basis,in the costs incurred by the city in the construction ofReservoir#6.In that case the surcharge shall be adjustedtoallusersofReservoir#6 accordingly.
The additional surcharge is assessed to cover the costs thecityincurredintheconstructionofReservoir#6 located intheWheelerRoadarea.The surcharge in Subsection B shallexpirewithwater/sewer billings occurring after January 1;2006.Such reservoir was constructed to service those indus-tries and other properties located along Wheeler Road andwhichutilizethecity's water system.
C.Sewer rates for industrial or processing plants may be sepa-rately determined by the City Council;based upon bothvolume;location;and chemical characteristics of the ef-fluent discharge into the sewer collection system.
Section 2.This ordinance shall take effect and be in force with water/sewerbillingsoccurringafterJanuary11986andwithpublicationasprovidedbylaw.
