AN ORDINANCEAMENDINGMOSESLAKEMUNICIPALCODECHAPTER18.19 ENTITLED"R-2;SINGLEFAMILYANDTWOFAMILYRESIDENTIALZONE"
THE CITY COUNCILOF THECITY OF MOSESLAKE;WASHINGTON00 ORDAINAS FOLLOWS:
I Section 1.Moses Lake Municipal Code Chapter 18.19 entitled "R-2;Single Fam-ily and Two Family Residential Zone"is amended as follows:
18.19.020 Permitted Uses:Hereafter in the Single Family and Two Family
Residential Zone;no building;structure;or land shall be used and
no building or structure shall be erected;altered;enlarged;orrelocatedthereinwhichisdesignedorintendedtobeusedforanyotherthanthefollowingoutrightpermittedusesorasacondition-al use.Outright permitted uses or conditional uses in the SingleFamilyandTwoFamilyResidentialZoneshallbeincompliancewiththeconditions;the performance standards;and the bulk regulationsofthischapter.
A.Outright Permitted Uses:
1.Duplex -a structure on one lot of record containing two(2)dwelling units.
2.Single family dwelling units;including
a.Single family detached dwelling units.
b.Single family dwelling units sharing a commonwall
or attachment on two lots of record.
I c.Condominiums -single family attached dwelling unitsdevelopedasahorizontalregimeincompliancewiththerequirementsofthischapterorincompliancewithChapter18.67 of this title entitled "Planned
Development District."
3.Subordinate Uses -any use which is incidental and subor-dinate to the principal use of the land or building;islocatedonthesamelotwiththeprincipaluse;and is
not otherwise prohibited.
4.Accessory buildings and/or structures appurtenant to anypermittedusesincompliancewithSection18.19.040 ofthischapter.
5.Factory-built housing constructed to the standards of theUniformBuildingCode.
6.Keeping of household pets (dogs and cats)not exceedingthree(3)in number which are four (4)months old orolder.
7.Planned Development Districts in compliance with Chapter
i 18.67 of this title;entitled "Planned DevelopmentDistrict."
8.Parks and non-commercial recreational uses.
9.Home occupation in compliance with Chapter 18.06.320 ofthistitle.
10.An accessory dwelling unit intended to accommodate a mem-ber(s)of the immediate family requiring daily care;supervision;or guardianship in compliance with Section18.19.190 of this chapter entitled "Residential Density."

11.Other unmentioned uses ruled by the Planning Commission
to be similar to and compatible with the specified per-mitted uses.
12.Family day care homes as an accessory use to a private
family residence providing care during part of the
twenty-four (24)hour day to six (6)or fewer children.
Family day care homes shall be licensed by the State of
Washington;Department of Social and Health Services and
shall operate in compliance with the licensed capacity
requirements for family day care homes.A city business
license shall be required.
B.Conditional Uses:The following uses may be permitted by thePlanningCommissionasaconditionaluseincompliancewith
the provisions of this chapter and Chapter 18.51 of this title
entitled "Conditional and Unmentioned Uses."
1.Churches
2.Schools
3.Group homes for the developmentally disabled
4.Golf Courses
5.Manufactured homes not located in manufactured home parks
provided that the size;construction;siting;and other
features shall be harmonious with the surroundingresidentialpropertiesandshallpreservethegeneral
character and integrity of the neighborhood.
6.Cemeteries
7.Rental of an apartment appurtenant to a single family
residence
8.Manufactured home parks in compliance with Chapter 18.63
of this code entitled "Mobile (Manufactured)Home Parks."
9.Essential public services and utilities including build-
ings and structures.
10.Boarding houses for not more than three (3)people
11.Mini Day Care Facility and Day Care Centers:
a.Mini Day Care Facility:A day care facility for the
care of from seven (7)through twelve (12)children
in the family abode of the person holding the
license issued by the State of Washington,Depart-
ment of Social and Health Services.
b.Day Care Center:A day care facility that provides
for the care of from thirteen (13)through twenty
(20)children in the family abode of the person
holding the license issued by the State of Washing-
ton,Department of Social and Health Services.
c.Requirements:Mini day care facilities and day care
centers shall be in compliance with the following
requirements:
1)Outdoor play areas shall not be located in front
yards.
2)One (1)on-site parking space is required for
each employee in addition to required resident
parking.
3)An on-site,off-street loading and unloading
area shall be required.

4)A city business license shall be required.
5)Signage shall not be permitted.
6)No structural or decorative alteration whichwouldalterthecharacterorbeincompatiblewiththesurroundingresidencesshallbepermitted.
7)The use and structures shall be in complianceIwithzoningregulationsandUniformBuildingCoderequirements.
8)Mini day care facilities and day care centersshallbelicensedbytheStateofWashington;Department of Social and Health Services andshalloperateincompliancewiththelicensedcapacityrequirementasdeterminedbytheStateofWashington;Department of Social and HealthServicesexceptthatdaycarecentersshalloperateincompliancewiththecapacityrequire-ments as stipulated in this section.
9)The Planning Commission may impose conditions tomitigateanypotentialadverseimpactsonthesurroundingarea.
10)Notification and agreement of adjacent property
owners of an application for a day care facil-ity.
12.Other uses ruled by the Planning Commission to be a con-ditional use provided that the use shall be similar toandcompatiblewiththeexpressedpermittedandcondi-I tional uses.
Section 2.This ordinance shall take effect and be in force five (5)daysafteritspassageandpublicationasprovidedbylaw.
