ANORDINANCEAMENDINGMOSESLAKEMUNICIPALCODECHAPTER2.68 ENTITLED"PUBLICEMPLOYEES'RETIREMENTSYSTEM"
THECITY COUNCILOF THE CITY OF MOSESLAKE;WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Moses Lake Municipal Code Chapter 2.68 entitled "Public Employees'I Retirement System"is amended as follows:
2.68.010 Participation in Washington Public Employees'Retirement System:The City of Moses Lake shall participate as an employee member intheWashingtonPublicEmployees'Retirement System (PERS)for theeligibleemployeesandofficialsofthecity;PERS having absorbedtheState-Wide City Employees'Retirement (SWCER)(RCW41.44)andthecityhavingelectedtojoinSWCER;and;therefore;binds itselftotheprovisionsofRCW41.40 as it is now written or in the fu-ture may be amended.
2.68.020 Membership =Persons Covered:
A.All eligible employees of the city shall be membersof PERS;provided that if an employee has the option of not becoming amemberofPERSorwithdrawingasamemberofPERS;the cityshall;at the option of the employee;either permit the em-ployee to become or remain a memberof PERS or contribute thesameamountthatwouldhavebeenmadetoPERSasanemployercontribution.
1.To a city sponsored retirement pension;or deferred com-pensation program;or the like;if one is offered by thecit.y;
i 2.To an employee selected retirement;pension;or deferredcompensationprogram;or the like;if the city can legal-ly and practically contribute to the selected program;
3.To the employee directly to place in an IRA;annuity;deferred compensation program;or the like;or to place
or use the contribution as he or she desires.
B.Elected officials shall have the option of membership;if andasallowedbylaw;regardless of time served;to be effectiveatthebeginningofanytermofofficeanduponpaymentofemployeecontributionsforsuchperiod.
Section 2.This ordinance shall take effect and be in force five (5)daysafteritspassageandpublicationasprovidedbylaw.
