1223_00001ORDINANCENO.1223 AN ORDINANCECREATINGA NEWCHAPTER10.14 OF THEMOSESLAKEMUNICIPALCODEENTITLED"SNOWEMERGENCY- TOWINGUNAUTHORIZEDVEHICLES" THE CITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Moses Lake Municipal Code Chapter 10.14 entitled "Snow Emergency - Towing Unauthorized Vehicles"shall read as follows:I 10.14.010 Definitions:The following definitions shall apply in the inter-pretation and enforcement of this chapter: A."Municipal Services Director"is the Municipal Services Di- rector or his or her designee. B."Park"means to set and leave,unattended,a motor vehicle onapublicright-of-way.The definition includes an unattendedstalledmotorvehicleoranunattendedmotorvehiclemiredin snow or an unattended motor vehicle unable to movebecause ofsleetorice. 10.14.020 Parking Prohibition -Duration: A.Whenever the Municipal Services Director finds,on the basisoffallingsnow,sleet,or freezing rain,or on the basis of a forecast by the U.S.Weather Bureau of snow,sleet,orfreezingrain,that weather conditions will make it necessarythatmotorvehicletrafficbeexpeditedandthatparkingoncitystreetsbeprohibitedorrestrictedforsnowplowingandotherpurposes,the Municipal Services Director shall putintoeffectaparkingprohibitiononpartsoforallstreetsasnecessarybydeclaringitinamannerprescribedbythischapter.I B.Once in effect,a prohibition under this section shall remainineffectuntilterminatedb.y announcement of the MunicipalServicesDirectorinaccordancewiththischapter,exceptthatanystreetareawhichhasbecomesubstantiallyclear ofsnowandicefromcurbtocurbfortheentirelengthoftheblockshallbeautomaticallyexcludedtherefrom.While theprohibitionisineffect,no person shall park or allow toremainparkedanyvehicleonanyportionofastreettowhichitapplies.However,nothing in this section shall be con-strued to permit parking at any time or place where it isprohibitedbyanyotherprovisionoflaw. 10.14.030 Parking Prohibition -Announcement of Declaration Required: A.The Municipal Services Director shall cause each declarationmadebyhimorherpursuanttothischaptertobepubliclyannouncedbymeansofradiobroadcastfromalllocalstationswithanormaloperatingrangecoveringthecity,and he orshemaycausesuchdeclarationtobefurtherannouncedin newspapers of general circulation when feasible.Each an-nouncement shall describe the action taken by the MunicipalServicesDirector,including the time it became or will be-come effective,and shall specify the streets or areas af-I fected.A parking prohibition declared by the Municipal Ser-vices Director shall not go into effect until at least four(4)hours after it has been announced at least three (3)times at thirty (30)minute -intervals between 6 a.m.and 11p.m.in accordance with this section. B.The Municipal Services Director shall make or cause to bemadearecordofeachtimeanddatewhenanydeclaration isannouncedtothepublicinaccordancewiththissection. 10.14.040 Termination of Parking Prohibition:Whenever the Municipal Ser-vices Director shall find that some or all of the conditions whichgiverisetoaparkingprohibitionineffectpursuanttothischapternolongerexist,he or she may declare the prohibitionterminated,in whole or in part,in a manner prescribed by thischapter,effective immediately upon announcement. ORD.1223/Page 2 10.14.050 Parked Vehicles -Removal by Police Authorized When Procedure Required: A.Members of the Moses Lake Police Department are authorized to remove or have removed a motor vehicle from the street as anunauthorizedvehicleaccordingtotheprovisionsofRCW 46.55,when: 1.The motor vehicle is parked on a part of a street onwhichaparkingprohibitionisineffect; 2.The motor vehicle is parked in violation of any parking ordinance or provision of law and is interfering orabouttointerferewithsnowremovaloperations. B.Whenever a Police Officer removes or has removed a vehicle from a street as authorized in this section and the Police Officer knows or is able to ascertain from the registration records in the vehicle the name and address of the ownerthereof,such Police Officer shall immediately give or causetobegivennoticeorallyand/or in writing to such owner of the fact of such removal and the reasons therefor and of theplacetowhichsuchvehiclehasbeenremoved.A copy of such notice shall be given to the proprietor of the place of busi- ness where the motor vehicle has been stored. C.It shall be the duty of the Police Department to keep arecordofeachmotorvehicleremovedinaccordancewith this section.The record shall include a description of the motorvehicle,its license number,the date and time of its remov- a1,where it was removed from,its location,the nameand address of its owner and last operator,if known,its final disposition,and the parking infraction involved. D.This section shall be supplemental to any other provisions of law granting members of the Police Department authority to remove motor vehicles. 10.14.060 Parked Motor Vehicles -Infraction:Whenever any motor vehicle - without a driver is found parked or left in violation of any pro- vision of this chapter,whether removed and impounded as provided for in this chapter or whether not removed and impounded,the Police Officer finding such motor vehicle shall take its registra- tion number and any other information displayed on the motor vehi- cle which may identify its user;and shall conspicuously affix to such motor vehicle a infraction notice,on a form provided by the Police Department. 10.14.070 Penalty:Every person who violates any of the provisions of this chapter shall be subject to a non-deferrable,non-suspendable C-15 penalty as defined in Chapter 1.08 of the Moses Lake Municipal Code. 10.14.080 Severability:If any section,subsection sentence,clause, phrase,or portion of this ordinance is for any reasons held in- valid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate,distinct,and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law. Adopted by the City Council and signed'b r on 25,1986.
