ANORDINANCEAMENDINGCHAPTER18.52 OF THEMOSESLAKEMUNICIPALCODEENTITLED"GRANTCOUNTYAIRPORTZONING"
THE CITY COUNCILOF THE CITY OF MOSESLAKE;WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 18.52 of the Moses Lake Municipal Code entitled "GrantCountyAirportZoning"is amended to read as follows:
1 18.52.080 Enforcement:It shall be the dut.y of the Municipal Services De-partment to administer and enforce the regulations prescribedherein.Applications for permits and variances shall be made totheMunicipalServicesDepartmentuponaformpublishedforthat
purpose.Applications required by this ordinance to be submittedtotheMunicipalServicesDepartmentshallbepromptlyconsideredandgrantedordenied.Application for action by the Board of Ad-justment shall be forthwith transmitted by the Municipal ServicesDepartment.
18.52.090 Appeals:
A.Any person aggrieved;or any taxpayer affected;b.yany deci-sion of the Municipa1 Services Department made in the ad-ministration of the ordinance,may appeal to the Board ofAdjustment.
B.All appeals hereunder must be taken within a reasonable timeasprovidedbytherulesoftheBoardofAdjustment,by filingwiththeMunicipalServicesDepartmentanoticeofappealspecifyingthegroundsthereof.The Municipal Services De-
partment shall forthwith transmit to the Board of Adjustmentallthepapersconstitutingtherecorduponwhichtheactionappealedfromwastaken.
I C.An appeal shall stay all proceedings in furtherance of theactionappealedfromunlesstheMunicipalServicesDepartmentcertifiestotheBoardofAdjustment;after the facts statedinthecertificateastaywouldintheopinionoftheMunicipalServicesDepartmentcauseimminentperiltolifeorproperty.In such case;proceedings shall not be stayed ex-cept by the order of the Board of Adjustment on notice to theMunicipalServicesDepartmentandonduecauseshown.
D.The Board of Adjustment shall fix a reasonable time for hear-ing appeais;give public notice and due notice to the partiesininterest;and decide the same within a reasonable time.Upon the hearing;any party may appear in person or by agentorbyattorney.
E.The Board of Adjustment may,in conformity with the provisionsofthisordinance;reverse or affirm;in whole or in part ormodifytheorder;requirement;decision;or determination ap-pealed from and may make such order requirementi decision ordeterminationasmaybeappropriateunderthecircumstances.
Section 2.This ordinance shall take effect and be in force five (5)daysafteritspassageandpublicationasprovidedbylaw.
