1246_00001ORDINANCENO.1246 AN ORDINANCEAMENDINGCHAPTER18.57 OF THEMOSESLAKE MUNICIPALCODEENTITLED"SIGNS ANDBILLBOARDS" THE CITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTON00 ORDAINAS FOLLOWS: Section 1.Chapter 18.57 of the Moses Lake Municipal Code entitled "Signs andiBillboards"is amended to read as follows: 18.57.020 Signs in Commercial and Industrial Zones: A.Off-Premises Signs: 1.All off-premises signs shall meet the following standardsfordistancebetweensigns: Size of Sign Face Distance Between Signs Under 50 square feet 100 feet from another off premises sign ordevelopedproperty 51 -199 square feet 500 feet from any other commercial sign orbillboard 200 -400 square feet 1,000 feet from anothersignofequalareaor500feetfromanyothercommercialsign Over 400 square feet Not permittedi2.All signs shall be of single stick construction.No ad-ditional bracing is permitted. 3.Billboards shall be double face type except when erectedwithinfivefeet(5')of a building. 4.No billboard shall exceed a height greater than eighteenfeet(18')above ground;or two-thirds (2/3)its horizon-tal length whichever is the greater.No billboard shallbelessthanfivefeet(5')nor more than eight feet (8')from the ground. 5.No more than one (1)billboard structure is permitted at any one (1)location. 6.Any sign which becomes dilapidated or otherwise unsafe,displays advertising which is more than one (1)year outofdate,or is not being properly maintained as pre-scribed in the sign code,or obstructs a driver's view at any intersection so as to be deemed unsafe;may be or-dered corrected or removed by the Building Official. B.On-Premises Signs:I 1.On-premises signs shall be limited to those identifying abusinessorproductssoldonthepremises. 2.The total area of signs shall not exceed one square foot(l')of area for each foot of developed business frontagealongthesidetowhichthesignisdirected,with a to-tal area not to exceed one hundred and fifty square feet(150').Businesses with frontages of less than twenty-five feet (25')may construct a sign with an area not toexceedtwenty-five square feet (25').Only one face of adouble-faced sign shall be considered in computing its area. ORD.1246/Page 2 3.Signs shall not project more than ten feet (10')abovethebuildingcontainingthebusinesswhichthesigniden- tifies,or have an overall height not to exceed twenty-five feet (25')for a free standing sign;except in theC-4 zone,where free standing.signs can be a maximumofforty-five feet (45')high.Signs in the C-4 zone may be constructed to a height higher than forty-five feet (45')only after special permission is granted by the Planning Commission;providing the signs extra height is shown tobeessentialtoitbeingseenbytravelingmotorists. 4.In all zones except C-1,General Commercial;and on ex-isting buildings in the C-2 zone that have no front yard setbacks signs shall not project out over city right-of- way. 5.Signs in the C-1,General Commercial Zone,may project out over the public sidewalk not more than eighty percent(80%)of the distance between the property line and thecurbline. 6.All signs projecting over city right-of-way shall be aminimumofeightandonehalffeet(8 1/2')from ground level except for signs attached to the underside of acanopyorotherarchitecturalprojectionwhichmaybe aminimumofsevenandonehalffeet(7 1/2')from ground level. 7.Fascia signs or signs painted on a building shall not be counted towards the allowable sign area for an on-premises sign. C.Temporary Signs:Temporary signs except for political signsandforsalesignswhichdonotconformtosignstandards shall require approval of the Planning Commission.In grant- ing approval for temporary signs;the Planning Commission mayimposespecialconditionsrequiredtofulfilltheintentof this chapter. 18.57.030 Signs in Residential Zones: A.Off-Premises Signs: 1.No off-premises signs shall be constructed in Ag,R-1;orR-2 districts. 2.The Planning Commission may permit off-premises signs in the R-3 district not to exceed off-premises sign stan-dards for the commercial districts after it has been shown that such sign will not adversely affect adjacent residential uses. B.On-Premises Signs:Only the following signs shall be permit- ted in Ag,R-1,and R-2 Districts: 1.For sale and for rent signs under four square feet (4') 2.Campaign signs 3.Signs identifying home occupations which are unlighted signs under one square foot (1')placed flat against the building,are permitted in Ag and R-2 Districts,but areprohibitedintheR-1 District. 4.Permanent subdivision or neighborhood designation signs shall be unobtrusive;in keeping with the character of the neighborhood and constructed of quality materials;asapprovedinadvancebythePlanningCommission.Signs shall not exceed five feet (5')in height and twenty-five square feet (25')in surface area and shall be located between the building line and the property line unless a ORD.1246/Page 3 location on excess city right-of-way is approved by theMunicipalServicesDirector. C.Only the following signs shall be permitted in the R-3District: 1.Those signs permitted in the R-1 and R-2 Districts. 2.The Planning Commission may permit on-premises signs nottoexceedthestandardspermittedintheC-1,C-2,or C-31Districtsafterithasbeenshownthatsuchsignwillnotadverselyaffectadjacentresidentialuses. Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law. Adopted by the City Council and signed by its Mayor on November 25,1986.
