1253_00001ORDINANCENO.1253 ANORDINANCEAPPROVINGANDCONFIRMINGTHEASSESSMENTSANDASSESSMENTROLLOFLOCALIMPROVEMENTDISTRICTNO.53 WHICHHASBEENCREATEDANDESTABLISHEDFORTHEPURPOSEOFGRADING;GRAVELING;CONSTRUCTING;ANDINSTALLINGSTORMDRAINAGE;CURBS;SIDEWALKS;WATERSERVICES;SEWERLATERALS;ANDASPHALTCONCRETEPAVEMENTONMELVALANEFROMTHEEASTERLYCORNERIOFLOT1;MELVAADDITION#7 TO WAPATODRIVE;EASTLAKEDRIVEBETWEENNELSONRDADANDJAMESAVENUE;JAMESAVENUEINBROADRIPPLE#3;KITTELSONROADBETWEENWASHINGTONSTATESIGNROUTE#17 AND705.50 FEET EAST TO THECITYLIMITSASPROVIDEDINORDINANCENO.1198 ANDLEVYINGANDASSESSINGTHEAMOUNTTHEREOFAGAINSTTHEPARCELOFLANDSHOWNONSAIDROLL RECITALS: 1.The assessment roll levying the special assessments against propertieslocatedinLocalImprovementDistrictNo.53 in the City of Moses Lake;Washington;created under Ordinance No.1198 has been filed with the CityClerkoftheCityofMosesLakeasprovidedbylaw;and 2.Notice of the time and place of hearing thereof and of making objectionsandproteststosaidrollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw;fixing the time and place of hearing hereonforDecember9;1986 at 8 p.m.in the Council Chambers in the Police/Court Facility;Moses Lake;Washington;and further notice thereof wasdulymailedbytheCityClerktoeachpropertyownershownonsaidroll;and 3.At the time and place fixed and designated in said notice the hearing wasdulyheldandallprotestsmadeinwritingwerereadandsubmittedtotheiCityCouncilandwerebyitoverruled; THECITY COUNCILOF THECITY OF MOSESLAKE;WASHINGTONDOORDAINAS FOLLOWS: Section 1.That the assessments and assessment roll of Local Improvement Dis-trict No.53 which has been created and established for the purpose of im-provements constructed on Melva Lane from the easterly corner of Lot 1;MelvaAddition#7 to Wapato Drive;Eastlake Drive between Nelson Road and JamesAvenue;James Avenue in Broadripple #3;Kittelson Road between WashingtonStateSignRoute#17 and 705.50 feet east to the city limits by gradinggravelingconstructingcurbs;sidewalks and/or bicycle paths;water services;sewer side laterals;asphalt concrete pavement;signs;and storm drainage asprovidedinOrdinanceNo.1198 as the same nowstands;be and the same asherebyinallthingsandrespectsapprovedandconfirmed. Section 2.That each of the lots;tracts;parcels of land and other propertyshownuponthesaidrollisherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessedagainsteachlot;tract parcel of land and other property appearing upon saidrolltheamountfinallychargedagainstthesamethereon. Section 3.That the assessment roll as approved and confirmed shall be filedIwiththeTreasureroftheCit.y of Moses Lake for collection and that said CityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinhishandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days from the date of the first publication of saidnoticewithoutpenalt.y;interest or cost;and that hereafter the sum remain-ing unpaid may be paid in ten (10)equal annual installments with interestthereonfixedattherateof13%per annum;provided;however that if the neteffectiveinterestratefixedonthelocalimprovementbondshereafterissuedforLocalImprovementDistrictNo.53 is other than 12.5%per annum theinterestrateontheunpaidassessmentsshallberevisedtoarateof1/2 of1%in excess of the net effective interest rate on such bonds.The first in-stallment of.assessments on said assessment roll shall be comedue and payableduringthe30-day period succeeding the date one year after the date of first -1 - publication by the City Treasurer of notice that the assessment roll is in his hands for collection and annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessment remains unpaid after the first 30-day period,interest upon the whole unpaid sum shall be charged at a rate of 13%per annum;provided however;that if the net effective interest rate fixed on the local improvement bonds hereafter issued for Local Improvement District No.53 is other than 12.5%per annum;the interest rate on the unpaid assessments shall be revised to a rate of 1/2 of 1%in excess of the net ef- fective interest rate on such bonds;and each year thereafter one of said in- stallments;together with interest due on the whole of the unpaid balance; shall be collected.Any installment not paid prior to the expiration of the said 30-day period during which such installment is due and payable shall thereupon become delinquent.All delinquent installments shall be subject to a charge for interest at the rate above referenced;and for an additional charge of ten percent (10%)penalty levied upon both principal and interest due upon such installments or installments.The collection of such delinquent installments shall be enforced in the manner provided by law. Section 4.This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law. Adopted by the City Council and signed by its Mayor on December 23 1986.
