AN ORDINANCEAMENDINGCHAPTER18.22 OF THE MOSESLAKEMUNICIPALCODEENTITLED"R-3,MULTI-FAMILYRESIDENTIALZONE"
THE CITY COUNCILOF THECITY OF MDSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 18.22 of the Moses Lake Municipal Code entitled R-3,Multi-family Residential Zone"is amended as follows:
18.22.020 Permitted Uses:Hereafter in the Multi-family Residential Zone,noibuilding,structure,or land shall be used and no building orstructureshallbeerected,altered,or relocated herein which is
designed or intended to be used for any other than the following
outright permitted uses or as a conditional use.Outright permit-ted uses or conditional uses in the Multi-family Residential Zoneshallbeincompliancewiththeconditions,the performance stan-dards,and bulk regulations of this chapter.
A.Outright Permitted Uses:
1.Multi-family dwelling unit structure -a structure con-taining more than two dwelling units on a single lot.
2.Duplex -a structure on one lot of record containing two(2)dwelling units.
3.Single family dwelling units,including
a.Single family detached dwelling units.
b.Single family dwelling units sharing a commonwall
or attachment on two Tots of record.
c.Condominiums -single family attached dwelling units
i developed as a horizontal regime in compliance with
the requirements of this chapter or in compliancewithChapter18.67 of this title entitled "PlannedDevelopmentDistrict."
4.Subordinate Uses -any use which is incidental and subor-dinate to the principal use of the land or building;is
located on the same lot with the principal use;and is
not otherwise prohibited.
5.Accessory buildings and/or structures appurtenant to anypermittedusesincompliancewithSection18.22.040 ofthischapter.
6.Factory-built housing constructed to the standards of theUniformBuildingCode.
7.Keeping of household pets (dogs and cats)not to exceedthree(3)in number which are four (4)months old orolder.
8.Planned Development Districts in compliance with Chapter18.67 of this title,entitled "Planned DevelopmentDistricts."
i 9.Parks and non-commercial recreational uses.
10.Homeoccupations in compliance with Chapter 18.06.320 ofthistitle.
11.An accessory dwelling unit intended to accommodate a mem-ber(s)of the immediate family requiring daily care,supervision,or guardianship in compliance with Section18.22.210 of this chapter entitled "Residential Density."
12.Other unmentioned uses ruled by the Planning Commissiontobesimilartoandcompatiblewiththespecifiedper-mitted uses.

13.Family day care homes as an accessory use to a privatefamilyresidenceprovidingcareduringpartofthetwen-ty-four (24)hour day to six (6)or fewer children.Fam-ily day care homes shall be licensed by the State of
ashington,Department of Social and Health Services andshalloperateincompliancewiththelicensedcapacity
requirements for family day care homes.A city businesslicenseshallberequired.
B.Conditional Uses:The following uses may be permitted by thePlanningCommissionasaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 of this titleentitled"Conditional and Unmentioned Uses."
1.Golf Courses
2.Cemeteries
3.Manufactured homes not located in manufactured home parksprovidedthatthesize,construction,siting,and otherfeaturesshallbeharmoniouswiththesurroundingresidentialpropertiesandshallpreservethegeneralcharacterandintegrityoftheneighborhood.
4.Manufactured home parks in compliance with Chapter 18.63ofthiscodeentitled"Mobile (Manufactured)HomeParks."
5.Clubs,lodges,and assembly halls
6.Athletic clubs
7.Boarding houses
8.Group homes for the developmentally disabled

12.Professional offices
13.Rental of an apartment appurtenant to a single family
residence
14.Essential public services and utilities including build-
ings and structures.

18.Marinas located along the lake shore
19.Mini Day Care Facilities and Day Care Centers:
a.Mini Day Care Facility:
1)A day care center for the care of twelve (12)orfewerchildreninafacilityotherthanthefam-
ily abode of the person or persons under whose
direct care and supervision the child is placed;
or
2)For the care of from seven (7)through twelve
(12)children in the family abode of such person
or persons.
b.Day Care Center:A day care facility that provides
for the care of thirteen (13)or more children pro-
vided that the capacity of day care centers located

in private family residences in residential zonesshall.not exceed twenty (20)children at any giventimeandthepermittedcapacityofdaycarecenterslocatedinresidentialzonesinotherthanprivatefamilyresidencesshallbesetbythePlanningCom-
mission on a case by case basis.
c.Requirements:Mini day care facilities and day carecentersshallbeincompliancewiththefollowing
requirements:
1)Outdoor play areas shall not be located in frontyards.
2)One (1)on-site parking space is required foreachemplo.yee in addition to required resident
parking.
3)An on-site off-street loading and unloading
area shall be required.
4)A cit.y business license shall be required.
5)Signage shall not be permitted.
6)No structural or decorative alteration which
would alter the character or be incompatiblewiththesurroundingresidencesshallbe
permitted.
7)The use and structures shall be in compliancewithzoningregulationsandUniformBuildingCoderequirements.
8)Mini day care facilities and day care centersshallbelicensedbytheStateofWashington,
i Department of Social and Health Services andshalloperateincompliancewiththelicensed
capacit.y requirement as determined by the StateofWashington,Department of Social and HealthServicesexceptthatdaycarecentersshalloperateincompliancewiththecapacityrequire-
ments as stipulated in this section.
9)The Planning Commission may impose conditions tomitigateanypotentialadverseimpactsonthesurroundingarea.
10)Notification and agreement of adjacent property
owners of an application for a day care facil-
ity.
20.Other uses ruled by the Planning Commission to be a con-ditional use provided that the use shall be similar toandcompatiblewiththeexpressedpermittedandcondi-tional uses or other uses permitted by specific provisionofthischapterasaconditionaluse.
18.22.050 Lot Size:
A.Lot size shall not be less than six thousand (6,000)squareifeetforresidentialusesornon-residential uses.
B.Lot size shall not be less than six thousand (6;000)squarefeetforsinglefamilyandduplexstructures.
C.Lot size for multi-family residential structures includingcondominiumsshallbenotlessthantheminimumlotsize(6,000 square feet)plus one thousand two hundred (1;200)square feet for each additional dwelling unit in excess of two(2)dwelling units.

D.Not less than one thousand (1,000)square feet for the first
dwelling unit and one hundred (100)square feet for each addi-
tional dwelling unit exclusive of parking areas and driveways
shall be retained as usable outdoor area for recreation and
landscaping.Such open area need not exceed five thousand(5,000)square feet.
E.The maximumarea of a multi-family residential lot that may becoveredbybuildingsshallnotexceedthepercentagestipu-lated in Table F of this section.
F.Lot area for multi-family residential structures includingcondominiumsshallbegovernedbythefollowingtablewhichsummariestheminimumrequirementsandstandardsofthis

The number of dwelling units shall be inclusive of all floors
of the structure.The total number of dwelling units may be
split out into several structures occupying a lot of record.
For each dwelling unit in excess of eight (8)dwelling units
as stipulated on the above table,the total minimum lot areashallbeincreasedonethousandtwohundred(1,200)squarefeetforeachadditionalunit;the total minimum open spaceshallbeincreasedonehundred(100)square feet for each ad-
ditional dwelling unit;and the maximumpercentage of lot area
that may be covered by a building(s)shall not exceed fifty
percent (50%)of the lot area.
G.Deviations from the multi-family residential lot area require-
ments and standards of this section may be permitted by the
Planning Commission as a conditional use in compliance with
Chapter 18.51 of this title entitled "Conditional and Unmen-
tioned Uses"and the remaining sections of this chapter.
Section 2.This ordinance shall take effect and be in force five (5)days
atter its passage and publication as provided by law.
