1280_00001??O 805516 , ORDINANCENO.1280 AN ORDINANCEVACATINGA PORTIONOF MARINADRIVE THE CITY COUNCILOF THECITY OF MOSESLAKE;WASHINGTONDOORDAINAS FOLLOWS: Section 1.The portion of Marina Drive 10'wide x 181.5'long located adja-cent to lax #1323 shall be vacated;except a utility easement shall be re-tained;legally described as follows:i A portion of a right of way 10'x 181.5'in Section 28;Township 19 North,Range 28 EWMGrant County;Washington;described as follows: Beginning at the southwest corner of the NE 1/4 NE 1/4 Section 28;thencenorth0023'SS"east along the west line of said subdivision 443.00 feet;thence 151.90 feet south 89055'50"east to the westerly right-of-way lineofaroadknownasMarinaDriveandthetruepointofbeginning;thencenorth22057'30"east a distance of 181.50 feet;thence south 89055'50" east a distance of 10.85 feet;thence south 22057'30"west a distance of181.50 feet;thence north 89055'50"west a distance of 10.85 feet to thetruepointofbeginning. Section 2.The property owner;Leroy Johnson;shall donate to the city a 10' portion of property abutting Tax #4318 for a sidewalk/bike path in lieu ofreimbursingthecityforone-half the appraised value of the vacated right-of- way at such time as the property is sold or the use changes;but not laterthan10years. Section 3.Leroy Johnson shall construct the sidewalk/bike path at the timeTax#4318 is sold or the use changes.
