AN ORDINANCEADDINGCHAPTER9.16 OF THEMOSESLAKEMUNICIPAL
CODEENTITLED"PROHIBITINGORRESTRICTINGTHE USEOF CARGOCONTAINERSANDTHELIKE"
THE CITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTON00 ORDAINAS FOLLOWS:
I Section 1.Chapter 9.16 of the Moses Lake Municipal Code entitled "Prohibit-
ing or Restricting the Use of Cargo Containers and the Like"is enacted asfollows:
9.16.010 Purpose and Intent:Locating containers formerly used fortransportingsea-going cargo,railroad cars and cabooses,semi-trailers when intended to be used as storage facilities,or anyotherunitwhichslidesoffachassisorframewhenintendedto beusedasstoragefacilitiesinaresidentialneighborhoodexceptin
the RR,Rural Residential Zone,and without restriction in a commer-cial neighborhood and in the RR,Rural Residential Zone,is con-trary to the best interests and welfare of the citizens of the City
of Moses Lake as such containers,railroad cars and cabooses,semi-
trailers when intended to be used as storage facilities,and otherunitswhichslideoffchassisorframeswhenintendedtobeusedasstoragefacilitieswerenotconstructedorintendedtobelocatedinresidentialneighborhoodsexceptintheRR,Rural Residential
Zone,and without restriction in commercial neighborhoods and intheRR,Rural Residential Zone,and used as a type of storagefacility.If placed and located in residential neighborhoods ex-cept in the RR,Rural Residential Zone,and,without restriction incommercialneighborhoodsandintheRR,Rural Residential Zones,
the placement could have a negative and deleterious effect on sur-rounding property values and the well being of the residents living
in and near the affected neighborhoods.I 9.16.020 Prohibiting Placement of Containers in Residential Neighborhoods:
No person,partnership,joint venture,or corporation shall locate
any container formerly used for transporting sea-going cargo,rail-
road cars and cabooses,semi-trailers when intended to be used asstoragefacilities,or any other unit which slides off a chassis orframewhenintendedtousedas_storage facilities on any residen-tial property except in the RR,Rural Residential Zone,in the CityofMosesLake.Containers formerly used for transporting sea-going
cargo,railroad cars and cabooses,semi-trailers when intended tobeusedasstoragefacilities,or any other unit which slides off achassisorframewhichisintendedtobeusedasastoragefacili-ty,the location and placement of which are in violation of thischapter,shall be removed within thirty (30)days of the effectivedateofthisordinance.
9.16.030 Restricting Placement of Containers and the Like in CommercialNeighborhoods:No person,partnership,joint venture,or corpora-tion shall locate any container formerly used for transporting sea-going cargo,railroad cars and cabooses,semi-trailers when intend-ed to be used as storage facilities,or any other unit which slidesoffachassisorframewhenintendedtobeusedasstoragefacili-ties on any commercial property and in the RR,Rural Residential
I Zone,in the City of Moses Lake without applying for and obtaining
a conditional use permit from the City of Moses Lake and complyingwithallotherapplicableUniformBuilding,Fire,or any and all
other applicable codes.Containers formerly used for transportingsea-going cargo,railroad cars and cabooses,semi-trailers whenintendedtobeusedasstoragefacilities,or any other unit whichslidesoffachassisorframewhichisintendedtobeusedasastoragefacility,which are already in place and located in commer-cial neighborhoods and in the RR,Rural Residential Zone,the loca-tion and placement of which are in violation of this chapter,shallberemovedwithinthirty(30)days of the effective date of thisordinanceoraconditionalusepermitappliedforwithinthirty(30)days of the effective date of this ordinance.Upon consider-ation of the conditional use permit the containers formerly used
for transporting sea-going cargo,railroad cars and cabooses,semi-
trailers when intended to be used as storage facilities,or any
other unit which slides off a chassis or frame when intended to be
used as a storage facility shall be allowed to remain in place upon
such conditions imposed by the Planning Commission.
9.16.030 Penalty:Failure to comply with any provision of this chapter
shall subject the violator to the following penalties as they aredefinedinChapter1.08 of this code:

Section 2.This ordinance shall take effect and be in force five (5)days
after its passage and publication as provided by law.
