1318_00001ORDINANCENO.1318 ANORDINANCEAMENDINGCHAPTER18.14 OF THEMDSESLAKEMUNICIPALCODEENTITLED"RR,RURALRESIDENTIALZONE" THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTON00 ORDAINAS FOLLOWS: Section 1.Chapter 18.14 of the Moses Lake Municipal Code entitled "RR,RuraliResidentialZone"is amendedas follows: 18.14.020 Permitted Uses:Hereafter in the Rural Residential Zone no build- ing,structure,or land shall be used and no building or structureshallbeerected,altered,enlarged,or intended to be used for anyotherthanthefollowingoutrightpermittedusesorasacondition-al use.Outright permitted uses or conditional uses in the RuralResidentialZoneshallbeincompliancewithallperformancestan-dards,conditions,and bulk regulations of this chapter. A.Outright Permitted Uses: 1.Single family detached dwelling units including factorybuilthousingconstructedtothestandardsoftheUniformBuildingCode. 2.Any use which is incidental and subordinate to the prin-cipal use of the land or building;is located on the samelotwiththeprincipaluse;and is not otherwiseprohibited. 3.Accessory buildings and/or structures appurtenant to anypermittedusesincompliancewithSection18.14.040 ofthischapter. I 4.Cultivation of land for agricultural products,vineyards, gardening,and fruit growing. 5.Keeping of livestock,poultry,rabbits,and bees in ac-cordance with Section 18.14.050 of this chapter. 6.Selling of agricultural products raised or grown on thepremises. 7.Keeping of household pets (dogs and cats)not exceedingfour(4)in number which are four (4)months old orolder. 8.Planned Development Districts in compliance with Chapter18.67 of this title. 9.Parks and non-commercial recreational uses. 10.An accessory dwelling unit intended to accommodate a mem-ber(s)of the immediate family requiring daily care,supervision,or guardianship in compliance with Section18.14.200 of this chapter entitled Residential Density. 11.Other unmentioned uses ruled by the Planning Commissionitobesimilartoandcompatiblewiththespecifiedper-mitted uses. B.Conditional Uses:The following uses may be permitted by thePlanningCommissionasaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 of this titleentitledConditionalandUnmentionedUses. 1.Cemeteries 2.Churches 3.Essential public services and utilities including build-ings and structures. 4.Golf courses 5.Home occupations 6.Other unmentioned uses ruled by the Planning Commission to be a conditional use provided that the use shall be similar to and compatible with the expressed permitted and conditional uses. 8 thab e ,riding academies,and commercial dog kennels 9.Locating containers formerly used for transporting sea-going cargo,railroad cars and cabooses,semi-trailers when intended to be used as storage facilities,or anyotherunitwhichslidesoffachassisorframewiththefollowingconditionsbeingrequiredasaminimum: The container,railroad car and caboose,semi-trailer or any other unit which slides off a chassis or frame must: a.Be placed on concrete,asphalt,or level compacted hard surface at all times. b.Be painted so as to blend in with the building to which it is associated. c.Not be visible to the motoring public or from residential neighborhoods immediately adjacent tothepropertywhereitislocatedunlessothermea- sures are employed to mitigate the visual impact of the containers formerly used for transporting sea-going cargo,railroad cars and cabooses,semi- trailers when intended to be used as storage facili- ties,which measures shall be approved by the Plan- ning Commission,provided,that the Planning Commis- sion does not need to require mitigation measures if it is felt that the motoring public or adjacent residential neighborhoods are not impacted. d.Abide by all set back requirements applicable to the zone in which it is located. Section 2.The City Council declares that an emergency exists and this or- dinance shall take effect and be in force five (5)days after its passage and publication as provided by law upon one reading if 2/3 of the entire City Council present vote in favor of passage.
