ANORDINANCEAMENDINGCHAPTER18.32 OF THEMOSESLAKE
MUNICIPALCODEENTITLED"C-2,GENERALCOMMERCIALANDBUSINESSZONE"
THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTON00 ORDAINAS FOLLOWS:
I Section 1.Chapter 18.32 of the Moses Lake Municipal Code entitled "C-2,
General Commercial and Business Zone"is amended as follows:
18.32.040 Conditional Uses:The following specific and generally described
uses shall be permitted in the C-2 Zone only as a conditional usesubjecttotheapprovalofthePlanningCommissionincompliancewiththeprovisionsofthischapterandChapter18.57 of this titleentitled"Conditional and Unmentioned Uses."
A.Churches
B.Schools
C.Hospitals
D.Temporary or seasonal uses exceeding 7 days in duration
E.Bulk storage of hazardous,combustible or explosive substances
F.Manufactured home parks
G.Airports,landing strips,heliports,and air transportationfacilities
H.Recreational vehicle parksiI.Keeping of livestock,poultry,rabbits,or bees for commercial
or private purposes
J.Any commercial use not on city sanitary sewer.
K.Locating containers formerly used for transporting sea-going
cargo,railroad cars and cabooses,semi-trailers when intendedtobeusedasstoragefacilities,or any other unit whichslidesoffachassisorframewhenintendedtobeusedas astoragefacilityshallmeetthefollowingminimumconditions:
1.Be placed on concrete,asphalt,or level compacted hardsurfaceatalltimes.
2.Be painted so as to blend in with the building to whichitisassociated.
3.Not be visible to the motoring public or from residentialneighborhoodsimmediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomiti-gate the visual impacts of the containers formerly usedfortransportingsea-going cargo,railroad cars andcabooses,semi-trailers when intended to be used asIstoragefacilities,which measures shall be approved bythePlanningCommission,provided,that the Planning Com-mission does not need to require mitigation measures ifitisfeltthatthemotoringpublicoradjacentresiden-tial neighborhoods are not impacted.
4.Abide by all set back requirements applicable to the zoneinwhichitislocated.
L.Other unmentioned uses ruled by the Planning Commission to be
a conditional use or uses permitted by specific provision ofthischapterasaconditionaluse.
M.Residential Uses
N.On-site hazardous waste treatment and storage facilities incompliancewiththeperformancestandardsoftheStateofWashingtonsitingcriteriaforon-site hazardous waste treat-ment and storage facilities and the requirements of this chap-ter;provided that,on-site hazardous waste treatment andstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste.
Section 2.This ordinance shall take effect and be in force five (5)daysafteritspassageandpublicationasprovidedbylaw.
