1340_00001ORDINANCENO.1340 AN ORDINANCEAPPROVINGANDCONFIRMINGTHE ASSESSMENTSANDASSESSMENTROLLOFLOCALIMPROVEMENTDISTRICTNO.55IWHICHHASBEENCREATEDANDESTABLISHEDFORTHEPURPOSEOFPAYINGAPARTOFTHECOSTOFIMPROVINGCLOVERDRIVEFROMEVERGREENTONELSONROADBYGRADING:GRAVELINGLCONSTRUCTINGCURBWITHGUTTERS,CONCRETESIDEWALKSONONESIDE,WATERSERVICES,ASPHALTCONCRETEPAVEMENT, SEWERLATERAL FIRE HYDRANTS,SIGNS,ANDSTORMDRAINAGEINTHECITYOFMOSESLAKEASPROVIDEDBYORDINANCENO.1265,ANDLEVYINGANDASSESSINGTHEAMOUNTTHEREOFAGAINSTTHESEVERALLOTS,TRACTS,PARCELSOF LANDANDOTHERPROPERTYSHOWNONSAIDROLL WHEREAS,the assessment roll levying the special assessments againstpropertieslocatedinLocalImprovementDistrictNo.55 in the City of MosesLake,Washington,created under Ordinance No.1265 has been filed with theCityClerkoftheCityofMosesLakeasprovidedbylaw;and WHEREAS,notice of the time and place of hearing thereof and of makingobjectionsandproteststosaidrollwasdulypublishedatandforthe timeandinthemannerprovidedbylaw,fixing the time and place of hearing hereonforSeptember13,1988 at 8 p.m.in the Council Chambers in thePolice/Court Facility,Moses Lake,Washington,and further notice thereof wasdulymailedbytheCityClerktoeachpropertyownershownonsaidroll;and WHEREAS,at the time and place fixed and designated in said notice the hearing was duly held and all protests made in writing were read and submitted to theiCityCouncilandwerebyitoverruled, THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.That the assessments and assessment roll of Local ImprovementDistrictNo.55 which has been created and established for the purpose ofgrading,graveling,constructing curb with gutters,concrete sidewalks on oneside,water services,asphalt concrete pavement,sewer lateral,fire hydrants,signs and storm drainage in the Lakeview area on Clover Drive from EvergreentoNelsonRoadintheCityofMosesLakeasprovidedinOrdinanceNo.1265 asthesamenowstands,be and the same as hereby in all things and respectsapprovedandconfirmed. Section 2.That each of the lots,tracts,parcels of land and other propertyshownuponthesaidrollisherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessedagainsteachlot,tract,parcel of land and other property appearing upon saidrolltheamountfinallychargedagainstthesamethereon. Section 3.That the assessment roll as approved and confirmed shall be filedwiththeTreasureroftheCityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredby ORD.1340 -PAGE 2 law stating that said roll is in his hands for collection and that payment of any assessment thereon or any portion of said assessment can be made at anytimewithinthirty(30)days from the date of the first publication of said notice without penalty,interest,or cost,and that hereafter the sumremainingunpaidmaybepaidinten(10)equal annual installments with interest thereon fixed at the rate of 13%per annum,provided,however,thatiftheneteffectiveinterestratefixedonthelocalimprovementbonds hereafter issued for Local Improvement District No.55 is other than 12.5%per annum,the interest rate on the unpaid assessments shall be revised to a rate of 1/2 of 1%in excess of the net effective interest rate on such bonds.The first installment of assessments on said assessment roll shall be come due and payable during the 30-day period succeeding the date one year after the date of first publication by the City Treasurer of notice that the assessment roll is in his hands for collection and annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessment remains unpaid after,the first 30-day period,interest upon the whole unpaid sum shall be charged at a rate of 13%per annum,provided however,that if the net effective interest rate fixed on the local improvement bonds hereafter issued for Local Improvement District No.55 is other than 12.5%per annum,the interest rate on the unpaid assessments shall be revised to a rate of 1/2 of 1%in excess of the net effective interest rate on such bonds;and each year thereafter one of said installments,together with interest due on the whole of the unpaid balance, shall be collected.Any installment not paid prior to the expiration of the said 30-day period during which such installment is due and payable shall thereupon become delinquent.All delinquent installments shall be subject to a charge for interest at the rate above referenced and a penalty as set by Moses Lake Municipal Code 3.50.020.The collection of such delinquent installments shall be enforced in the manner provided by law. Section 4.This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law.
