RECITALS:
1.Resolution No.1406 adopted September 6,1988 by the City Council of theCityofMosesLake,Washington,declared its intention to improve BasinHomesbyconstructingandinstallingasanitarysewersystem,sewer sidelaterals,and appurtenances which connect to the city's existing sanitary
sewer and sewer side laterals and fixed September 27,1988 at 8:00 p.m.in the City Council Chambers,Moses Lake,Washington,as the time andplaceforhearingallmattersrelatingtosaidimprovement,the formationofautilitylocalimprovementdistrict(ULID),and all objections there-to and for determining the method of payment of said improvement;.and
2.The City Engineer's Office has caused an estimate to be made of the costsandexpenseofeachcontinuousunitoftheproposedimprovementandhascertifiedsaidestimatetotheCityCouncil,together with all papers andinformationinitspossessiontouchingtheproposedimprovement,aidescriptionoftheboundariesoftheproposedULID,a statement of whatportionofthecostandexpenseoftheimprovementshouldbebornebythepropertywithintheproposedULID,a statement in detail of the localimprovementassessmentsoutstandingorunpaidagainstthepropertyin theproposedULIDandastatementoftheaggregateactualvaluationoftherealestate,including 25%of the actual valuation of the improvements intheproposedULID,according to the valuation last placed upon it for thepurposeofgeneraltaxation;and
3.Said estimate is accompanied by a diagram of the proposed improvementshowingthereonthelots,tracts,parcels of land,and other propertywhichwillbespecificallybenefitedbyeachcontinuousunitofthe pro-posed improvements,and the estimated amount of the cost and expensethereoftobebornebyeachlot,tract,and parcel of land or other prop-erty;and
4.Due notice of the hearing on Resolution No.1406 was given in the mannerprovidedbylawandsaidhearingwasheldbytheCityCouncilonSeptem-ber 27,1988,and all written protests filed with the City Council on orbeforesaiddateweredulyconsidered;and
5.It has been further determined to be in the best interests of the citythatsaidimprovements,as hereinafter described,be carried out and thatalocalimprovementdistrictbecreatedinconnectiontherewith,NOWITHEREFORE,
THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDO ORDAINAS FOLLOWS:
Section 1.It is hereby ordered that the following improvements in the CityofMosesLake,Washington,and the construction,be carried out,to wit:
The improvement of Basin Homes by constructing and installing a sanitarysewersystem,sewer side laterals,and appurtenances which connect to theexistingCityofMosesLakesanitarysewer.
All of the foregoing shall be in accordance with the plans and specificationsthereforepreparedbytheCityEngineer's Office.
Section 2.The estimated cost and expense for the improvements is $1,346,700
of which $667,426 is the estimate cost of the improvements in Basin Homes
which will be paid by the city.
The city shall bear 50%of the cost and expense of constructing asnd install-
ing the collection system which is estimated to cost $319,930 and 95%of the
cost the interceptor system which is estimated to cost $534,170and all other
costs and expenses of the improvements shall be borne by and assessed against
the property specially benefited by such improvements.
The city has received a Community Development Block Grant offer which will pay
the LID assessments for those property owners who's income is below the low/
moderate level as established by the U.S.Dept.of Housing and Urban
Development.
Section 3.There is hereby created and established a utility local improve-
ment district to be known as "Utility Local Improvement District No.4"(ULID
4),to include,as near as may be,all properties specially benefited by the
improvements,the territory of which is described as follows and includes the
following described properties:
Larson Plat in Section 10,T.19 N.,R.28 E.,W.M.,Larson Plat No.2 in
Section 10,T.19 N.,R.28 E.,W.M.,Replat at Block 2,Larson Plat No.
2 in Section 10,T.19 N.,R.28 E.,W.M.,SW1/4 SW1/4 in Section 10 T.
19 N.,R.28 E.W.M.,Park Orchards Tract 42 Section 15,T.19 N.,R.28
E.W.M.
Section 4.The nature of the improvements ordered by this ordinance to be
made is such that the special benefits conferred upon the property in ULIO 4
are fairly reflected by the use of combinatiion of a front foot and per lot
method of assessment;and it is hereby provided and ordered that the assess-
ments shall be made against the property within ULID No.4 in accordance with
a combinatiion of a front foot and per lot method provided by statute..
Section 5.All assessments levied in ULIDNo.4 shall be for the sole purpose
of payment into a bond fund to pay and secure the payment of water and sewer
bonds issued for the cost of the improvements.All payments of such assess-
ments,including all interest and penalties thereon,shall be paid directly
into the Construction Fund and applied to pay or secure the payment of debt
service on water/sewer revenue bonds heretofore or hereafter issued and pay-
able from the Construction Fund without allocation to any particular series or
issues of such bonds.
Section 6.This ordinance shall take effect and be in force five (5)days
