ANORDINANCEAMENDINGCHAPTER18.32 OF THEMOSESLAKEMUNICIPALCODEENTITLED"C-2,GENERALCOMMERCIALANDBUSINESSZONE"
THECITY COUNCILOF THECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 18.32 of the Moses Lake Municipal Code entitled "C-2,General Commercial and Business Zone"is amended as follows:
18.32.040 Conditional Uses:The following specific and generally described
i uses shall be permitted in the C-2 Zone only as a conditional usesubjecttotheapprovalofthePlanningCommissionincompliancewiththeprovisionsofthischapterandChapter18.57 of thistitleentitled"Conditional and Unmentioned Uses."
A.Churches
B.Schools
C.Hospitals
D.Temporary or seasonal uses exceeding 7 days in duration
E.Bulk storage of hazardous,combustible or explosivesubstances
F.Manufactured homeparks
G.Airports,landing strips,heliports,and air transportationfacilities
H.Recreational vehicle parks
I.Keeping of livestock,poultry,rabbits,or bees for
J.

sanitary sewer.
K.Locating containers formerly used for transporting sea-goingcargo,railroad cars and cabooses,semi-trailers whenintendedtobeusedasstoragefacilities,or any other unitwhichslidesoffachassisorframewhenintendedtobeusedasastoragefacilityshallmeetthefollowingminimumconditions:
1.Be placed on concrete,asphalt,or level compactedhardsurfaceatalltimes.
2.Be painted so as to blend in with the building towhichitisassociated.
3.Not be visible to the motoring public or fromresidentialneighborhoodsimmediatelyadjacent to thepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingsea-goingcargo,railroad cars and cabooses,semi-trailers whenintendedtobeusedasstoragefacilities,whichmeasuresshallbeapprovedbythePlanningCommission,I provided,that the Planning Commission does not needtorequiremitigationmeasuresifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted.
4.Abide by all set back requirements applicable to thezoneinwhichitislocated.
L.Other unmentioned uses ruled by the Planning Commission tobeaconditionaluseorusespermittedbyspecificprovisionofthischapterasaconditionaluse.
M.Site built and factory built,detached housing units,whether occupied by the owner,rented,leased,or occupiedbyaresidentwatchman,custodian,or attendant,when setbackaccordingtoMosesLakeMunicipalCode18.32.220.
N,On-site hazardous waste treatment and storage facilities in
compliance with the performance standards of the State ofWashingtonsitingcriteriaforon-site hazardous wastetreatmentandstoragefacilitiesandtherequirementsof
this chapter;provided that,on-site hazardous wastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste.
0.Manufactured detached housing units whether occupied by the
owner,rented,leased,or occupied by a resident watchman,
custodian or attendant when set back one hundred and fifty
feet (150')from any arterial street.
18.32.050 Prohibited Uses:The following uses shall be prohibited in theC-2 Zone:
A.Any use which does not or is not capable of conforming with
the requirements of this chapter.
B.Public nuisances as defined by Moses Lake Municipal Code
Section 18.06.485
C.Industrial uses
D.Outside storage,collection,or dumping of dismantled,
partly dismantled,or wrecked vehicles,trailers,machinery,
or their parts.
E.Outside storage or collection of any junk,scrap,garbage,unsightly material,or debris except as may be contained in
approved garbage collection containers or as may be enclosed
within a sight obscuring fence or screen subject to Planning
Commission approval as a conditional use.
F.Abandoned structures or buildings in a state of disrepair.
G.Removal of soil or other natural materials for the purposeofsaleoruseasfillmaterial,except that excavation for
the purpose of construction or landscaping is permitted.
H.Occupancy of a recreational vehicle outside of amanufacturedhomeparkorarecreationalvehicle park.Recreational vehicle shall be defined as a vehicular typeunitwhichcanbetowed,hauled,or driven designed astemporarylivingquartersforrecreational,camping,ortravelusesincludingbutnotlimitedtotraveltrailers,
camp trailers,truck campers,and self-propelled motorhomes.A recreational vehicle is not a manufactured home orafactorybuilthome.
I.Wrecking yards,salvage yards,or junk yards
Section 2.The City Council declares that an emergency exists in order toprotectpropertyandthisordinanceshalltakeeffectandbeinforcefive (5)
days after its passage and publication as provided by law upon one reading if
2/3 of the entire City Council present vote in favor of passage.
Adopted by the City Council and signed by its Mayor on May 1989.
