ANORDINANCEAMENDINGCHAPTER8.24 OF THEMOSESLAKEMUNICIPALCODEENTITLED"BURGLARALARMSYSTEMS"
THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 8.24 of the Moses Lake Municipal Code entitled "BurglarAlarmSystems"is amended as follows:
8.24.230 False Alarms:
A.It is unlawful to have to maintain on any premises an audibleitypeburglaryand/or robbery alarm unless:
1.The alarm will shut itself off after sounding for aperiodofsevenminutesmaximum;
2.Unless there is posted at the main entrance to suchpremisesaprominentnoticeofthetelephonenumbers atwhichthepersonorpersonsauthorizedtoentersuchpremisesandturnoffsuchalarmcanbereachedatalltimes,and it is unlawful for any such person to fail toappearandturnoffanysuchalarmwithinonehourafterbeingnotifiedbythepolicetodoso.
B.It is unlawful for anyone to activate any robbery or burglaryalarmforthepurposeofsummoningpoliceexceptintheeventofanactualorattemptedburglaryorrobbery,or for anyonenotifyingthepoliceofanactivatedalarmandhavingknowledgethatsuchactivationwasapparentlycausedbyanelectricalorothermalfunctionofthealarmsystemtofailatthesametimetonotifythepoliceofsuchapparentmalfunction.
C.For a police response to any false alarm the Police ChiefshallinformtheCityClerkandtheCityClerkshallchargeiandcollectfromthepersonhavingormaintainingsuchburglaryand/or robbery alarm on premises ownedor occupied byhimfeesasfollows:
1.For a response to premises at which no other false alarmhasoccurredwithintheprecedingthree-month period,hereinafter referred to as a "first response,"no feeshallbecharged,but the person having or maintainingsuchburglaryand/or robbery alarm shall,within threeworkingdaysafternoticetodoso,make a written reporttothePoliceChiefonformsprescribedbyhimsettingforththecauseofsuchfalsealarm,the correctiveactiontaken,whether such alarm has been inspected by anauthorizedserviceman,and such other information as thePoliceChiefmayreasonablyrequiretodeterminethecauseofsuchfalsealarmandcorrectiveactionnecessary.
2.For a second response to a premises within three monthsafterafirstresponse,no fee shall be charged,but awrittenreportshallberequiredasforafirstresponseandthePoliceChiefshallbeauthorizedtoinspectorcausetobeinspectedthealarmsystematsuchpremises,prescribe necessary corrective action,and shall giveinoticetothepersonhaving.or maintaining such alarmsystemoftheconditionsandrequirementsofthissection.
3.For a third response to premises within three monthsaftersuchasecondresponse,and for all succeeding
responses within three months of the last response,a feeoffiftydollars($50)shall be charged,and if suchthirdfalsealarmoranysuchsucceedingfalsealarm isasaresultoffailuretotakenecessarycorrectiveactionprescribedbythePoliceChief,the Police Chiefmayorderthedisconnectionofsuchalarmsystemanditshallbeunlawfultoreconnectsuchalarmsystemuntilsuchcorrectiveactionistaken;provided,that nodisconnectionshallbeorderedastoanypremisesrequiredbylawtohaveanalarmsysteminoperation.
Section 2.This ordinance shall take effect and be in force five (5)days
after its passage and publication as provided by law.
