AN ORDINANCECREATINGCHAPTER8.36 OF THE MOSESLAKEMUNICIPALCODEENTITLED"LOITERING-DRUGRELATEDACTIVITY"
THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 8.36 of the Moses Lake Municipal Code entitled "Loitering
-Drug Related Activity"is created as follows:
I 8.36.010 Loitering for the Purpose of Engaqing in Drug Related Activity:
A.It is unlawful for any person to loiter in or near anythoroughfare,place open to the public,or near any public orprivateplaceinamannerandundercircumstancesmanifestingthepurposetoengageindrugrelatedactivitycontrarytoanyoftheprovisionsofChapters69.41,69.50,or 69.52 of theRevisedCodeofWashington.
B.No arrest shall be made for a violation of this section unlessthearrestingofficerfirstaffordssuchpersonanopportunitytoexplainsuchconduct,and no person shall be convicted ofviolatingthissectionifitappearsattrialthattheexplanationgivenwastrueanddisclosedalawfulpurpose.
C.Included amongthe circumstances which may be considered indeterminingwhethersuchpurposeismanifestedbutnotlimitedtheretoarea:
1.Such person is a known,unlawful drug user,possessor,orseller.For purposes of this chapter "known,unlawful drug
user,possessor,or seller"is a person who has,within theknowledgeofthearrestingofficer,been convicted in anycourtwithinthestateofanyviolationinvolvingtheuse,i possession,or sale of any of the substances referred to inChapter69.41,69.50,and 69.52 of the Revised codeofWashington,or such person has been convicted of anyviolationofanyoftheprovisionsofsaidchaptersof theRevisedCodeofWashingtonorsubstantiallysimilarlawsofanypoliticalsubdivisionofthisstateorofanyotherstate.
2.The area involved is by public repute knownto be an area ofunlawfuldruguseandtrafficking.
3.The premises involved have been knownto have been reportedtolawenforcementasaplacesuspectedofdrugactivitypursuanttoChapter69.52 of the Revised Code of Washington.
4.Any vehicle involved knownto be registered to a known,unlawful drug user,possessor,or seller,or for which thereisanoutstandingwarrantforacrimeinvolvingdrugrelatedactivity.
5.Such person behaves in such a manner as to raise areasonablesuspicionthatheorsheisabouttoengage in oristhenengagedinanunlawfuldrugrelatedactivity.
I 6.Such person takes flight upon the appearance of a policeofficer.
7.Such person manifestly endeavors to conceal himself orherselforanyobjectthatreasonablycouldbeinvolved inanunrelateddrugactivity.
8.Such person transfers small objects or packages for currencyinafurtivefashion.
9.Such person refuses to identify himself or herself upon therequestofanidentifiedpoliceofficer.
8.36.020 Penalty:Violation of this chapter shall be deemed a misdemeanorandshallbepunishablebyafinenottoexceedonethousanddollars($1,000)or by imprisonment not to exceed ninety (90)days,or bybothsuchfineandimprisonment.
8.36.030 Constitutionality:If any section,subsection,sentence,clause,orphraseofthischapterisforanyreasonheldtobeinvalidorunconstitutional,such decision shall not affect the validity of theremainingportionsofthischapter.
Section 2.This ordinance is one to provide for the immediate preservation of
the public peace,property,health,safety,and welfare of the citizens of theCityofMosesLake,therefore,an emergency is declared to exist,and thisordinanceshallbeinfullforceandeffectimmediatelyafteritspassage andpublicationasprovidedbylaw.
