1381_00001ORDINANCENO.1381 AN ORDINANCEAMENDINGCHAPTER 18.28 OF THEMOSESLAKEMUNICIPALCODEENTITLED"G4,CENTRALBUSINESSDISTRICTZONE" THECITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS: Section 1.Chapter 18.28 ofthe Moses Lake Municipal Code entitled "C-1,CentralBusiness District Zone"is amended as follows: 18.28.030 Examplesof Permitted Uses:Thefollowingspecificand generallydescribed uses are listed asiexamplesofthetypesofusesthatmaybelocatedintheC-1zone.The list is not all inclusive. A.Retall uses B.Governmentaloffices C.Service uses D.Professional offices E.Cultural,recreational,and entertainmentuses F.Lodging,assembly and food services G.Planned developmentdistricts H.Essential public services and utilitiesincluding buildingsand structures I.Accessory uses appurtenant to any primaryuses and not otherwiseprohibited. J.Banking andfinancialservices K.Locatingsteel sea oroceangoing containersmarked withthe American Bureau ofShipping'sEmblemormeetingtheintemationalStandardsOrganizationstandardswhichcanbedetachedfromatraller,chassis,or frame and,whichwere formerly usedfor transportingseaorocean-going cargo or seml-trailerswhen intended to be used as storage facilitiesor theilikeatconstructionsites.Constructionstorage facilities may be located ten (10)days priortostartofconstructionandshallberemovedwithinten(10)days offinish of construction.Start of construction shall be defined as ten (10)days prior to the physical presence ofconstructionactivityonthesiteforwhichabuildingpermithasbeenissued.Finish ofconstructionshallbedefinedasthedateofissuanceofaCertificateofOccupancy. 18.28.040 ConditionalUses:Thefollowing specificand generallydescribed uses shallbe permittedintheC-1 Zone only as a conditionaluse subject to the approval of the Planning CommissionincompliancewiththeprovisionsofthischapterandChapter18.57 of thistitleentitled"ConditionalandUnmentionedUses." A.Churches B.Schools C.Hospitals D.Gasolinestations E.Any permitteddevelopmentovertwo (2)acres Insize F.Open sale lots G.Temporaryor seasonal uses exceeding seven (7)days in duration i H.Keeping of livestock,poultry,rabbits,or bees I.Bulk storage of hazardous,combustible,or explosivesubstances J.Anycommercialuse not on city sanitarysewer. L.Other unmentioned uses ruled by the Planning Commissionto be a conditionaluse or usespermittedbyspecificprovisionofthischapterasaconditionaluse. M.Residential Uses N.On-sitehazardous waste treatmentand storage facilities in compliancewith the performancestandardsoftheStateofWashingtonsitingcriteriaforon-site hazardous waste treatmentandstoragefacilitiesandtherequirementsofthischapter;provided that,on-site hazardous wastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste. 18.28.050 Prohibited Uses:The following uses shall be prohibitedin the C-1Zone: A.Any use which does not or is not capable of conforming with the requirements of this chapter. B.Public nuisances as defined by Moses Lake Municipal Code Section 18.06.485 C.Industrial uses D.Outsidestorage,collection,ordumpingofdismantled,partly dismantled,orwreckedvehicles, trailers,machinery,or their parts. E.Outsidestorage orcollectionofanyjunk,scrap,garbage,unsightlymaterial,ordebrisexcept as may be contained inan approved garbage collection container or as may be enclosed within a sight obscuring fence or screen subject to Planning Commisslonapproval as aconditionaluse. F.Abandoned structuresor buildings in a state of disrepair. G.Removal of soil or other natural materials for the purpose of sale or use as fillmaterial,except that excavation for the purpose of construction or landscaping is permitted. H.Occupancy of trailersor recreational vehicles I.Warehouses not connected to a retall outlet J.Wrecking yards,salvageyards,or junkyards K.Mobilehome parks or recreational vehicleparks L.Locating any sea or ocean-going containerswhichcan be detached from a trailer,chassis, or frame and,which were formerly used for transportingsea orocean-goingcargo,railroad cars and cabooses,semi-trailers when intended to be used as storage facilities or any other unitwhich detaches from a trailer,chassis,or frame including car,truck,or van bodies or parts of bodies when intended to be usedas storage faellIties or the like. Section 2.This ordinanceshall take effectand be in force five (5)days afterits passage and publicationas provided by law. Adopted bythe CityCounciland signed by its Mayor on August22,1989.
