1382_00001ORDINANCENO.1382 AN ORDINANCEAMENDINGCHAPTER 18.32 OF THEMOSESLAKEMUNICIPALCODEENTITLED"C-2,GENERALCOMMERCIALANDBUSINESSZONE" THECITYCOUNCILOFTHE CITYOF MOSESt.AKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 18.32 of the Moses Lake Municipal Code entitled"C-2,General Commercial andBusinessZone"is amendedas follows: 18.32.030 Examplesof Permitted Uses:The following specificand generally described uses are listed asexamplesofthetypesofusesthatmaybelocatedintheC-2zone.Thelistis not allInclusive. I A.Retail and wholesale uses B.Offices C.Services D.Cultural,recreational,and entertainmentuses E.Essentialpublicservicesand utilitiesincluding buildingsand structures F.Lodging,assembly,and food service G.Planned development districts H.Banking and financial services I.Repair and maintenance J.Storage,warehousing,and distribution K.Lightmanufacturingwhen conducted as part of a retail sales outlet L Privateor publictransportationsystems M.Accessory uses appurtenantto any primary usesand not otherwiseprohibited. N.Locatingsteelsea orocean-goingcontainers markedwiththe AmericanBureau ofShipping'sEmblemormeetingtheInternationalStandardsOrganizationstandardswhichcanbeidetachedfromatrailer,chassis,orframe and,which wereformerly used fortransportingseaorocean-going cargo or semi-trailerswhen intended to be used as storagefacilitiesorthelikeatconstructionsites.Constructionstorage facilities may be located ten (10)days priortostartofconstructionandshallberemovedwithinten(10)days of finishof construction.Start of construction shall be defined as ten (10)days prior to the physical presence ofconstructionactivltyonthesiteforwhichabuildingpermithasbeenissued.Finish ofconstructionshallbedefinedasthedateofissuanceofaCertificateofOccupancy. 18.32.040 ConditionalUses:The following specificand generally described uses shall be permittedintheC-2 2one only as a conditional use subject to the approval of the Planning CommissionincompliancewiththeprovisionsofthischapterandChapter18.57 ofthis title entitled "ConditionalandUnmentionedUses." A.Churches B.Schools C.Hospitals D.Temporary or seasonal uses exceeding 7 days in duration E.Bulk storage of hazardous,combustible or explosive substances F.Manufacturedhome parks G.Airports,landing strips,hellports,and airtransportationfacilitiesiH.Recreational vehicle parks 1.Keeping of livestock,poultry,rabbits,or bees for commercialor privatepurposes J.Any commercial use noton citysanitary sewer. K.Locatingsteelsea or ocean-goingcontainersmarkedwiththe American Bureau ofShipping'sEmblemormeetingtheIntemationalStandardOrganization's standards which can bedetachedfromatrailer,chassis,orframe and,whichwere formerly used for transportingseaorocean-going cargo when intended to be used as storage facilities with the followingconditionsbeingrequiredasaminimum: 1.Be used as an appurtenance to the primaryuse;such primaryuse beingsituatedin anenclosedadjoiningbuilding. 2.Be placed on concrete,asphalt,or level,compacted,hard surface at all times. 3.Be painted so as to blend inwith the building to which it is associated. 4.Not be visible to the motoring public or from residential neighborhoods immediately adjacent to the property where it is located unless other measures are employed to mitigatethe visualimpacts ofthe containersformerly used for transportingsea oroceangoingcargo,which measures shallbe approvedbythe PlanningCommission,provided, thatthe PlanningCommissiondoes not needtorequire mitigationmeasures ifItis felt that the motoringpublicor adjacent residentialneighborhoods are not impacted. 5.Have a maximum allowablesquarefootage ofcontainer storage area not to exceed three percent (3%)of the gross floor area of the building with which the container(s)is associated.In no event shallthe number of containersallowed as appurtenant storage facilities exceed three (3)in number. 6.Be located on premisesas an appurtenant storage facility. 7.Not be stacked. 8.Abide by all set back requirementsapplicableto the zone in which itis located. 9.The recipientofthe conditionaluse permitisthe onlypartyallowedto use the container. L Other unmentioneduses ruledby the Planning Commissionto be a conditionaluse or usespermittedbyspecificprovisionofthischapterasaconditionaluse. M.Residential Uses N.On-sitehazardous waste treatmentand storage facilitiesincompliancewiththe performance standards ofthe StateofWashington siting criteriafor on-sitehazardous wastetreatment and storage facîlities and the requirements ofthis chapter;provided that,on-site hazardous waste treatmentand storage facilities are accessory to and subordinateto a primary use whichis a generator of hazardous waste. 18.32.050 ProhibitedUses:The following uses shall be prohibited in the C-2Zone: A.Any use which does not or is not capable of conformingwith the requirements of this chapter. B.Public nuisances as definedby Moses Lake Municipal Code Section 18.06.485 C.Industrial uses D.Outsidestorage,collection,ordumpingofdismantled,partly dismantled,orwrecked vehicles, trailers,machinery,or their parts. E.Outsidestorage or collectionofanyjunk,scrap,garbage,unsightly material,ordebris except as may be contained in approved garbage collection containers or as may be enclosed within a sight obscuring fence or screen subject to Planning Commissionapproval as a conditional use. F.Abandoned structures or buildings in a state ofdîsrepair. G.Removal of soilor other natural materialsfor the purpose of saleoruse as fillmaterial,except that excavation for the purpose of constructionor landscaping is permitted. H.Occupancy of a recreational vehicleoutsideofa manufacturedhome parkor a recreational vehicle park.Recreationalvehicleshall be definedas a vehiculartype unitwhich can be towed,hauled,ordrivendesigned as temporarylivingquarters for recreational,camping,or traveluses including but not limitedto traveltrallers,camp trallers,truckcampers,and self- propelled motor homes.A recreational vehicle is not a manufactured home ora factory built home. I.Wrecking yards,salvage yards,or junkyards J.Locating railroad cars and cabooses,semi-trailers when Intended to be used as storage facilities or any other unitwhich detaches from a trailer,chassis,or frame including car, truck,or van bodies or parts of bodies when intended to be used as storagefacilities or the like,except for those steel sea or ocean-goingcontainers allowed as a conditionaluse.
