ANORDINANCEAMENDING.CHAPTER18.42 OF THE MOSESLAKEMUNICIPALCODEENTITLED"L-I,LIGHTINDUSTRIALZONE"
THECITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 18.42 ofthe Moses Lake Municipal Code entitled"L-I,Light industrial Zone"is amendedasfollows:
18.42.030 Uses Inthe L-!Zone:Forthe purpose of clarification,the followingprincipaluses among theimanypossibleusesmaybepermittedintheL-IZone subject to the provisionsofthis chapterandanyconditionsimposedbythePlanningCommission:
A.Light industrial uses
B.Commercialand retall business uses în compliance with the provisions of this chapterdesiringtolocateinalessrestrictivezone.
C.The cultivation of land for agricultural products,vineyards,gardening and fruit growingandthekeepingoflivestock,poultry,rabbis,and bees inaccordance with Chapter 18.13 of thistitleprovidedthatnobuildingsorstructuresshallbeerectedofapermanentnatureforhumanhabitationotherthanprovidedinSection18.42.030 E ofthis chapter.
D.Administrativeand officefacilities for the accommodation of professionaland technicalstaffwhichareindependentfromwhataregenerallyrecognizedasbeingsupportiveofprimaryuses(i.e.corporate law firms,engineering firms,accounting firms,consultants,and technicalserviceagencies).
E.Dwelling unitsfor the convenience of a resident watchman or custodlan.Dwellingunitsasanappurtenantusetotheprimaryuse.
F.Accessory uses appurtenant to any primary use.
G.Essential public services and utilities.
H.Parks and commercialor non-commercial recreational use.I I.Private or public ground transportation systems.
J.On-sitehazardous waste treatment and storagefacilities in compliancewiththe performanceandstandardsoftheStateofWashingtonsitingcriteriaforon-site hazardous waste treat-ment and storage facilities and the requirements of this chapter;provided that,on-sitehazardouswastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste.
K.Locating steel sea orocean-goingcontainersmarkedwiththe American BureauofShipping'sEmblemormeetingtheInternationalStandardOrganization's standards which can bedetachedfromatrailer,chassis,orframe and,whichwere formerly used for transportingseaorocean-going cargo when intended to be used as storage facilitieswith the followingconditionsbeingrequiredasaminimum:
1.Be used as an appurtenance to the primary use;such primaryuse being situated in anenclosedadjoiningbuilding.
2.Be placed on concrete,asphalt,or level,compacted,hard surfaceat alltimes.
3.Be painted so as to blend in withthe buildingto which itis associated.
4.Not be visibleto the motoring publicor from residentialneighborhoodsImmediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingsea-goingcargo,which measures shall be approvedby the Planning Commission,provided,thatithePlanningCommissiondoesnotneedtorequiremitigationmeasuresifitisfeltthatthemotoringpublicoradjacentresidentialnelghborhoodsarenotimpacted.
5.Have a maximumallowablesquare footage ofcontainer storage area notto exceed threepercent(3%)of the gross floor area of the building with which the container(s)isassociated.In no event shallthe number ofcontainers allowed as appurtenant storagefacilitiesexceedthree(3)In number.
6.Be located on premises as an appurtenant storage facility.
7.Not be stacked.
8.Abide by allset back requirements applicableto the zone in which it is located.
9.The recipientofthe conditionaluse permitis the onlypartyallowedto use the container.
L Locating steel sea or ocean-going containers marked withthe American Bureau ofShipping's
Emblem or meeting the IntemationalStandards Organizationstandards which can be
detached from a trailer,chassis,or frame and,which were formerly used for transportingsea
or ocean-going cargo or semi-trailers when intended to be used as storage facilitiesorthe
like at construction sites.Constructionstorage facilities may be located ten (10)days prior
to startof constructionand shall be removed within ten (10)days of finish of construction.
Start of construction shall be defined as ten (10)days prior to the physical presence of
construction activityon the site for which a building permit has been issued.Finishof
constructionshall be defined as thedate of issuance ofa Certificateof Occupancy.
18,42.040 Prohibited Uses:The following uses shall be prohlbitedin the L-I Zone:
A.Residential uses except as provided in Section 18.42.030 E ofthis chapter.W
B.Any use which does not conform with the purpose of the L-IZone or does not or is not
capable of conformingwith the Performance Standard and Bulk Regulations as herein
defined.
C.Public nuisances.
D.Any use determinedby the Planning Commissionto pose excessive hazard to the public
health,safety,and general welfare.
E.Locating railroad cars and cabooses,semi-trailers when intended to be used as storage
facilities or any other unitwhich detaches from a traller,chassis,orframe including car,truck,
or van bodies or parts of bodies when intended to be used as storage facilities or the Ilke
except for those steel sea or ocean-going containers allowedas a conditionaluse.
Section 2.This ordinance shall take effect and be In force five (6)days afterits passage and publicationasprovidedbylaw.
