1384_00001ORDINANCENO.1384 AN ORDINANCEAMENDINGCHAPTER18.43 OF THE MOSESLAKEMUNCilPALCODEENTITLED"M-I,MEDIUMINDUSTRIALZONE" THECITYCOUNCILOF THECITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS: Section 1.Chapter 18.43 of the Moses Lake Muniepal Code entitled "M-l,Medium Industrial Zone"isamendedasfollows: 18.43.030 Uses Within the M-!2one:For the purpose ofclarification,the followingprincipal uses amongithemanypossibleusesmaybepermittedintheM-I Zone subject to the provisions of thischapterandanyconditionsimposedbythePlanningCommission: A.Medium industrial uses B.Light industrial,commercialand retallbusiness uses incompliancewiththe provisionsof thischapterdesiringtolocateinalessrestrictivezone. C.The cultivationof land foragriculturalproducts,vineyards,gardening and fruitgrowingandthekeepingoflivestock,poultry,rabbis,and bees inaccordance withChapter 18.13 ofthistitleprovidedthatnobuildingsorstructuresshallbeerectedofapermanentnatureforhumanhabitationotherthanprovidedinSection18.43.030 E of this chapter. D.Administrative and officefacilities for the accommodation of professional and technicalstaffwhichareindependentfromwhataregenerallyrecognizedasbeingsupportiveofprimary uses (i.e.corporate lawfirms,engineeringfirms,accounting firms,consultants,and technicalserviceagencies). E.Dwelling units for the convenience of a resident watchmanor custodian.Dwellingunits asanappurtenantusetotheprimaryuse. F.Accessory uses appurtenant to any primaryuse. G.Essential publicservices and utilities. H.Parks and commercial or non-commercialrecreational use.I I.Private or publicground transportationsystems. J.On-sitehazardous waste treatment and storagefacilitiesin compilancewiththe performanceandstandardsoftheStateofWashingtonsitingcriteriaforon-site hazardous waste treat-ment and storage facilitiesand the requirements of this chapter;provided that,on-sitehazardouswastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste. K.Locatingsteelsea or ocean-going containersmarkedwiththe American BureauofShipping'sEmblemormeetingtheIntemationalStandardOrganization's standards which can bedetachedfromatrailer,chassis,or frame and,which were formerly used for transporting seaorocean-going cargo when intended to be used as storage facilitieswith the followingconditionsbeingrequiredasaminimum: 1.Be used as an appurtenance to the primary use;such primaryuse being situated in anenclosedadjoiningbuilding. 2.Be placed on concrete,asphalt,or level,compacted,hard surfaceat alltimes. 3.Be painted so as to blend in with the buildingto which it is associated. 4.Not be visible to the motoringpublicor from residentialneighborhoods immediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingsea-goingcargoorsemi-trailers when intended to beusedas storage facilities,which measuresshallIbeapprovedbythePlanningCommission,provided,that the Planning Commission doesnotneedtorequiremitigationmeasuresifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted. 5.Have a maximum allowablesquare footage of containerstorage area notto exceed threepercent(3%)of the gross floor area of the buildingwith which the container(s)isassociated,Inno event shallthe number ofcontainers allowed as appurtenant storagefacilitiesexceedthree(3)in number. 6.Be located on premises as an appurtenant storage facility. 7.Not be stacked. 8.Abide by all set back requirements applicable to the 2one in whichit is located. 9.Therecipient ofthe conditional use permitis the onlypartyallowedto use the container. L Locatingsteel sea orocean-going containersmarked withtheAmerican BureauofShipping's Emblem or meeting the InternationalStandards Organi2ationstandards which can be detached from a traller,chassis,orframe and,whichwere formerlyused for transportingsea or ocean-going cargo or semî-trailers when intended to be used as storage facilities or the like at constructionsites.Constructionstorage facilities may be located ten (10)days prior to start of construction and shall be removed within ten (10)days of finish of construction. Start of construction shall be defined as ten (10)days prior to the physical presence of construction activity on the site for which a building permit has been issued.Finish of construction shall be defined as the date of Issuance of a Certificateof Occupancy. 18.43.040 Prohibited Uses:The following uses shall be prohibited in the M-IZone: A.Residentialuses except as providedin Section 18.43.030 E of this chapter.- B.Any use which does not conforrn with the purpose of the L-I Zone or does not or is not capable of conformingwith the Performance Standard and BulkRegulations as herein defined. C.Public nuisances. D.Any use determined by the Planning Commissionto pose excessive hazard to the public health,safety,and general welfare. E.Locating railroadcars and cabooses,semi-trailers when Intended to be used as storage facilities orany other unitwhich detahes from a trailer,chassis,or frame including car,truck, or van bodles or parts of bodies when Intended to be used as storage facilities or the like except forthose steel sea or ocean-going containersallowed as a conditionaluse.
