1385_00001ORDINANCENO.1385 AN ORDINANCE AMENDINGCHAPTER 18.44 OF THEMOSESLAKEMUNICPIALCODEENTITLED"H-I,HEAVYINDUSTRIALZONE" THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS: Section 1.Chapter 18.44 of the Moses Lake MunicipalCode entitled "H-I,Heavy industrialZone"isamendedasfollows: 18.44.030 Uses Within the H-1Zone:For the purpose of clarification,the following principalusesamongithemanypossibleusesmaybepermittedintheH-IZone subject to the provisionsof thischapterandanyconditionsimposedbythePlanningCommission: A.Heavyindustrial uses B.Lightindustrial,mediumindustrial,commercial,and retail business uses incompliancewiththeprovisionsofthischapterdesiringtolocateinalessrestrictivezone. C.The.cultivationof land for agricultural products,vineyards,gardeningand fruit growing andthekeepingoflivestock,poultry,rabbis,and bees in accordance withChapter 18.13 ofthistitleprovidedthatnobuildingsorstructuresshallbeerectedofapermanentnatureforhumanhabitationotherthanprovidedinSection1844,030 E ofthis chapter. D.Administrative and office facilities for the accommodationof professionaland technical staffwhichareindependentfromwhataregenerallyrecognizedasbeingsupportiveofprimaryuses(i.e.corporate law firms,engineeringfirms,accountingfirms,consultants,and technicalserviceagencies). E.Dwelling units for the convenience of a resident watchman or custodian.Dwelling unitsasanappurtenantusetotheprimaryuse. F.Accessory uses appurtenant to any primaryuse. G.Essentialpublicservicesand utilities. H.Parks and commercialor non-commercial recreational use.I I.Private or public groundtransportationsystems. J.On-sitehazardous waste treatmentandstorage facilities in compilancewiththe performanceandstandardsoftheStateofWashingtonsitingcriteriaforon-site hazardous waste treat-ment and storage facilities and the requirements of tim'schapter;provided that,on-sitehazardouswastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste. K Locating steelsea or ocean-goingcontainersmarkedwith theAmerican BureauofShipping'sEmblemormeetingtheinternationalStandardOrganization's standards which can bedetachedfromatrailer,chassis,or frame and,whichwereformerly usedfortransportingseaorocean-going cargo when Intended to be used as storage facilities withthe followingconditionsbeingrequiredasaminimum: 1.Be used as an appurtenance to the primaryuse;such primaryuse being situated inanenclosedadjoiningbuilding. 2.Be placed on concrete,asphalt,or level,compacted,hard surface at all times. 3.Be painted so as to blend in with the buildingto which it is associated. 4.Not be visible to the motoring public or from residential neighborhoods immediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingsea-goingcargoorsemi-trallerswhen intended to be usedas storagefacilities,whichmeasures shallibeapprovedbythePlanningCommission,provided,thatthe Planning Commissiondoesnotneedtorequiremitigationmeasuresifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted. 5.Have a maximum allowablesquare footage of containerstorage area not to exceed threepercent(3%)of the gross floor area of the building with which the container(s)isassociated.In no event shallthe number of containersallowed as appurtenant storagefacilitiesexceedthree(3)in number. 6.Se located on premises as an appurtenant storage faellity, 7.Notbe stacked. 8.Abide by all set back requirementsapplicableto the zone inwhich it is located. 9.The recipient ofthe conditionaluse permit is the onlypartyallowedto use the container. L Locating steel sea orocean-goingcontainers marked withthe American Bureau ofShipping's Emblem or meeting the Intemational Standards Organizationstandards which can be detached from a trailer,chassis,or frameand,whichwereformerly used for transportingsea or ocean-goingcargo orsemi-tralters when intended to be used as storage facilitiesor the like at construction sites.Constructionstorage facilitiesmay be located ten (10)days prior to start of construction and shall be removed within ten (10)days offinish ofconstruction. Start of construction shall be defined as ten (10)days priorto the physicalpresence of construction activityon the site for which a building permit has been issued.Finish of constructionshall be defined as the date of issuance of a Certificateof Occupancy. 18.43.040 Prohibited Uses:The following uses shallbe prohibitedin the H-IZone: A.Residential uses except as provided in Section18.43.030 E ofthis chapter.- B.Any use which does not conformwith the purpose of the L-IZone or does not or is not capable of conforming with the Performance Standard and Bulk Regulations as herein defined. C.Publicnuisances. D.Any use determined by the PlanningCommissionto pose excessive hazard to the public health,safety,and general welfare. E.Locatingrailroad cars and cabooses,semi-trailerswhen intended to be used as storage facilitiesor any other unitwhich detaches from a trailer,chassis,or frame includingcar, truck,or van bodies or parts of bodieswhen intended to be used as storage facilities or the like except forthose steel sea or ocean-going containers allowedas a conditional use. Section 2.This ordinance shalltake effectand be in force five (5)days after its passage and publicationas provided by law.
