1387_00001ORDINANCENO-1387 AN ORDINANCEREPEALINGORDINANCE1193 ANDSETTINGTHESEWERRATESUTILIZEDBYUNIONCARBIDECORPORATION THE CITY COUNCILOF THECITY OF MOSESLAKEDOORDAINAS FOLLOWS: Section 1.Sanitary waste of humanorigin shall be charged as provided for intheratessetbyordinancepursuanttoMosesLakeMunicipalChapter13.12.040 whenmeasured separately from or combined withhavinghigherchemicaland/or physical characteristics. Section 2.Processed wastewater from the industrial discharge of UnionCarbide,their successors or heirs shall be charged at a flat rateof$2,978 per month,based upon a 146,400 gpd maximumdischarge.There shall be no pro rata adjustment for less than maximumdischargeperday. Section 3.In addition to rates established in Section 1,2,and 3 of thisordinance,a surcharge shall be assessed for property outside thecorporatelimitsoftheCityofMosesLakeasprovidedforinMosesLakeMunicipalCode13.12.050.Also,in addition to ratesestablishedinSections1,2,and 3 of this ordinance,a surchargeshallbeassessedforallpropertiesconnectedtotheWheelerRoadtransmissionmainandReservoir#6 standpipe east of L NE asprovidedforinMosesLakeMunicipalCode13.12.050. Section 4.Testing and monitoring performed at city expense shall be chargedattheactualcostplusfifteenpercent(15%)for overhead expenses such as,but not limited to,office space and computertimecharges. Section 5.A maximumpenalty per occurrence may be assessed as follows fornon-compliance with the wastewater discharge permit. First Day $5,000SecondDay7,500ThirdDay10,000 Each day thereafter until corrected or service is terminated shallhaveanadditionalmaximumpenaltyassessmentof$2,500 added ontothepreviousday's maximumpenalty (for example -4th day,$12,500;5th day,$15,000,etc.). The discharge amount may exceed the maximumdaily flow foremergenciesifapprovedbytheCityofMosesLakeinwriting foralimitedtime.A new monthly rate will be assessed to the userbytheCityofMosesLakeforthemonth(s)in which the emergencyoccurred. The user shall have the opportunity for a hearing before the CityCounciloftheCityofMosesLakeonanypenaltyassessedbythecityofMosesLakeprovidedtheuserrequeststhehearinginwritingwithinten(10)calendar days after receipt of the writtennotificationofthecityestablishingsaidpenalty.Failure torequestahearingwithinsaidtimeshallbeconsideredasaforfeitureofsaidfineorpenaltyascompensationtothecity. Section 6.Payment of the rate assessed the user does not relieve the user ofIhisresponsibilitytomaintainhiseffluentandcomplywithallfederal,state,county,and city laws and permits.The user shallberesponsibletoindemnifythecityfromanylossandholdthecityharmlessforanyandalllossordamagefromitseffluent.The user will defend or pay the expenses of defending any suitwhichmaycommenceagainstthecityasaresultoftheuser'sprocessedwatersdischargedtothecity's system. Section 7.The rate structure for International Titanium,Inc.and UnionCarbideshallrunconcurrentlywiththerespectivewastewater discharge permit issued by the city and shall terminate with theterminationofthepermit.Further rate structures will benegotiatedinconjunctionwiththenegotiationoftermsfor a newWastewaterDischargePermit.
