1388_00001ORDINANCENO.1388 AN ORDINANCEAMENDINGCHAPTER 18.51 OF THEMOSESLAKEMUNICIPALCODEENTITLED"CONDITIONALAND UNMENTIONEDUSES" THE CITYCOUNCIL OF THE CITYOF IVIOSESLAKE,WASHINGTONDO ORDAINAS FOLLOWS: Section 1.Chapter 18.51 of the Moses Lake Municipal Code entitled "Conditional and UnmentionedUses"is amended as follows: i 18.51.010 Conditional Uses:Conditionaluses shall only be permittedafter a public hearing before thePlanningCommissionfindingthat: A.The use furthers the intent ofthe zone in whichit willbe located and conformsto thegeneralplan. B.The use will not create undesirable trafficcongestion or parkingproblems. C.The usewillnot be detrimental to surroundingproperties ortheiruses because ofappear-ances,noise,use,or other undesirablefeatures. D.The use willmeet all standards and regulations for the zone inwhich it is to be located. E.The use will not create undesirableenvironmentalproblems: 1.The Commission can made specialrequirements in conjunction with its decisionfollowingapublichearingiftheyarenecessarytomorecloselyfulfilltheintentofthe zone in which a developmentis permitted. 2.Conditions,if any,which may be imposed on any proposed project requiringaconditionalusepermit,shallbe endorsed on the conditionaluse permitand failure tocomplytherewithshallbegroundsforrevocationoftheconditionalusepermit.Revocation of the conditionaluse permitshallbe final after thirty (30)days writtennoticeoftheviolationisgivenbycertifiedmailtotheownerand/or occupant of thelandorimprovementsforwhichtheconditionalusepermitwasissued,ifin the meantime,the violation is not corrected. I 3.If no development has taken place on the proposal or if no buildingpermits orsubdivisionapplicationshavebeenissuedorreceivedwithinatwenty-four(24)monthtimelimitfromthedateofissuance,the conditional use permitshall become nullandvoid. 4.The decision ofthe Commissionin approvingorconditionallyapprovinga conditional use permitshallstipulatewhetherthe conditionaluse permit is issued to a person orwhetherthepermitshallrunwiththeland.Person shall be defined as an individual,corporation,company,firm,association,partnership,or jointstock company,a state,and all political subdivisions ofa state or any agency or any instrumentality thereofhavinganownershipinterestInthelandasanowner,renter,or lessee.A usepermittedasaconditionaluseissubjecttothelimitsinthepermitandconveysnogreaterrightsthanexpresslypermitted.A request for a revision to a conditional usepermitshallbeprocessedasanapplicationforanewconditionalusepermit.
