1399_00001ORDINANCENO.1399 AN ORDINANCEAMENDINGCHAPTER10.16 OF THE MOSESLAKEMUNICIPALCODEENTITLED"WEIGHTANDLOAD RESTRICTIONS" THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS: Section 1.Chapter 10.16 of the Moses LakeMunicipal Code entitled"Weight and Load Restrictions"isamendedtoreadasfollows: 1 10.16,010 Certain Vehicles to be Kept OffStreet When Not in Use:No person having charge of griytruckorothermotorvehicleexceedingtenthousandpounds(10,000lbs.)gross vehicleweight(GVW)as established by the manufacturer,excluding pickups;any commercial,industrial,or agriculturalequipment and/or machinery;or any trailer,unless attached to amotorvehiclebywhichitmaybepropelledordrawnshallpermitorallowthesametoremainorparkthesameInanystreet,alley,or publicright-of-way for a continuous periodexceedingfourhours;provided,that in case of accident such vehicle,equipment,ortrailermaybemovedtothesideofthestreet,alley,or publicright-of-way,and if goodandsufficientredsignalbedisplayedatbothendsthereofduringthehoursofdarkness,may be permitted or allowed to remain for a period not exceeding twenty-four(24)hourspendingremovalprovidedthattheprovisionsofRCW46.61.571 or any other parkingregulationoftheModelTrafficOrdinanceadoptedbythiscodearenotviolated. 10.16.020 CertainLoads Prohibited: A.No person shall drag or haul any timber or any articlesalong or over any street in such amannerthataportionofthesameshallrestuponorcomeintocontactwiththesurfaceofsuchstreet;nor shallany person on any paved or macadamized street lock the wheelofanyvehiclebyanymethodwherebyanythingotherthanthetireofsuchwheel,or asmoothshoeshallcomeintocontactwiththesurfaceofthestreet.No person shallunloadavehicleinanymannerthatwillcausedamagetothesurfaceofthestreet. B.No person shall haul any manure in any business district. C.No person shallload or transport any metals or metal vessels or materialsin any such amannerastocausealoudnoisetothedisturbanceofthepeace. I 10.16.030 Truck Routes:The following routes are the onlydesignated "throughtruck routes"forvehicleswithacombinedaxleloadof12,000 lbs.Streets open to truck trafficshallcomplywithRCW46.44.041 and RCW46.44.042. Street Name Originor Eqress Boundary Highway 17 AIIportions within city limits1-90 AIIportionswithincity limits 10.16.040 Arterials and Residential Streets:The following trucks shall be permitted on city arterialsandresidentialstreetseventhoughnotdesignatedas"throughtruck routes"and eventhoughexceedingthecombinedaxleloadof12,000 lbs: A.Commercialvehicles delivering merchandise to businesses and homes withinthecityilmits. B.Utilityvehicles servicing utilitieswithin the city limits. C.Local garbage collector vehicles operating within the citylimits. D.Construction vehiclesmayoperate within the city limits;however,the owners shallberesponsibleforwheelrutrepairsand/or other damage resulting to streetstraveledbyconstructionequipmenttotheCityofMosesLakeandasprovided forinRCW46.44.110 and 46.44.120. I E.Municipal vehiclesof the City of Moses Lake. F.School buses. G.Vehicles approved by the city used in parades. H.Unloaded vehicles used for transportationby operators to their home.Thesevehiclesmayonlybeallowedonthestreetsforamaximumoffour(4)hours. I.Trucks enroute to and from repair shops. J.Mailtrucks. 10.16.050 Restrictive Load Limits:Allcommercialvehicles shallbe required to obey all laws,signs,and officialnotices or postings regarding gross weight limits that are erected,posted,and/or published as an official notificationby the city. 10.16.060 Transportation of Hazardous Materials;Hazardous materials,other than flammable andexplosive,shall be transported on truck routes ofthe State ofWashington.Local delivery of hazardous material shall be subjectto the jurisdictionofthe Moses Lake Police Chief or his representative.Transport offlammable,explosive,and hazardous waste materialsregulatedbytheUniformFireCodeshallbesubjecttothejurisdictionoftheFireChief.No hazardous materlais may be stored on trucks within the Cityof Moses Lake. 10.16.070 Penaltv:Every person who violatesanyof the provisions of this chapter shall be subject to a non-deferrable,non-suspendable C-15penaltyas defined in Chapter 1.08 of the Moses Lake Municipal Code. 10.16.080 Severability:Ifany section,subsection,sentence,clause,phrase,or portion ofthisordinanceisforanyreasonheldinvalidorunconstitutionalbyanycourtofcompetentjurisdiction,such portion shallbe deemed a separate,distinct,and independent provision and such holding shall not affectthe validityof the remaining portionsthereof. Section 2.This ordinance shalltake effect and be in force five (5)days after its passage and publication as provided by law.
