1401_00001ORDINANCENO.1401 AN ORDINANCEAMENDINGCHAPTER 18.28 OF THE MOSESLAKEMUNICIPALCODEENTITLED"C-1,CENTRALBUSINESSDISTRICTZONE" THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 18.28 ofthe Moses LakeMunicipal Code entitled"C-1,CentralBusiness District2one'is amended as follows: i 18.28.040 ConditionalUses:The following specificand generallydescribed uses shallbe permitted intheC-1 Zone only as a conditionaluse subject to the approval of the PlanningCommissionincompliancewiththeprovisionsofthischapterandChapter18.57 ofthistitleentitled"ConditionalandUnmentionedUses." A.Churches B.Schools C.Hospitals D.Gasolinestations E.Any permitteddevelopmentovertwo (2)acres in size F.Open sales lots G.Temporary or seasonal uses exceeding seven (7)days indurationexcept as providedby thischapter H.Keeping of livestock,poultry,rabbits,or bees I.Bulk storage of hazardous,combustible,or explosive substances J.Any commercialuse not on citysanitarysewer K.Other unmentioneduses ruled bythe Planning Commissionto be a conditionaluse or usesipermittedbyspecificprovisionofthischapterasaconditionaluse. L.Residential Uses M.On-sitehazardous waste treatmentand storage facilities incompliancewiththe performancestandardsoftheStateofWashingtonsitingcriterîaforon-site hazardous waste treatmentandstoragefacilitiesandtherequirementsofthischapter;providedthat,on-site hazardouswastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste. 18.28.120 UBC.UFC,UMC.and UPCCode Requirements:Alluses Inthe C-1Zone must be in compliancewiththeapplicablerequirementsoftheUniformBuildingCode,the UniformFire Code,theUniformMechanicalCode,and the Uniform Plumbing Code except as maybe providedin thischapter. 18.28.135 Temporary Structures:Acommercialcoach or recreational vehicle maybe used as a temporaryofficeforaperiodoftimenottoexceedonehundredtwenty(120)days in duration in specificinstanceswhereapermanentstructurehousinganexistinglicensedbusinesshasbeendestroyedordamagedtotheextentthatitîsrenderedunusable.The siting oftemporary structures shallbeapprovedbytheBuildingOfficial.Temporary structures shall maintaina twentyfoot (20')separation from property lines and/or other buildingsor structures. 18.28.140 Outdoor Uses:The following outdoor uses are specificallypermitted in compliance with therequirementsofthischapter. A.Service Station Pumps -gas pumps shall be set back twenty-fivefeet (25')from propertyilines B.Parks and playgrounds C.Outdoor recreational,entertainment,or amusementfacilities D.Essential public servicesand utilitiesincluding buildingsand structures E.Sidewalksales F.Street vendors G.Festivals or other outdoor celebrations H.Other unmentioneduses ruled by the Planning Commissionto be similarto and compatiblewiththespecifiedpermittedoutdooractivitiesoruses. I.The listed outdoortemporary/seasonal uses are permittedoutrightnotto exceed thirty(30)days in duration.Temporarystructures associated with the listed uses are permittedandshallbeexemptfromtherequirementforcompliancewiththeUniformBuildingCode.ThesitingoftemporarystructuresshallbeapprovedbytheBuildingOfficial. 1.Christmastree sales 2.Fireworkssales as approved bythe FireChief 3.Non-profit organizationsales or activitiesassociated with a seasonal event Section2.The CityCouncildeclares that an emergency exists and this ordinance shalltake effectand be Winforcefive(5)days after its passage and publicationas provided by law upon one reading if2/3 of theentireCityCouncilpresentvoteinfavorofpassage.
