ANORDINANCEAMENDINGCHAPTER 18.32 OF THEMOSESLAKEMUNICIPALCODEENTITLED"C-2,GENERALCOMMERCIALANDBUSINESSZONE"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 18.32 of the Moses Lake Municipal Code entitled"C-2,General CommercialandBusinessZone"is amended as follows:
i 18.32.040 ConditionalUses:Thefollowing specificandgenerallydescribed uses shall be permittedIntheC-2 Zone only as a conditional use subject to the approval of the Planning Commission incompliancewiththeprovisionsofthischapterandChapter18.57 ofthistitleentitled"ConditionalandUnmentionedUses."
A.Churches
B.Schools
C.Hospitals
D.Temporary or seasonal uses exceeding7 days induration except as providedby thischapter
E.Bulkstorage of hazardous,combustibleor explosivesubstances
F.Manufactured home parks
G.Airports,landing strips,heliports,and air transportationfacilities
H.Recreationalvehicle parks
I.Keeping of livestock,poultry,rabbits,or bees for commercialor privatepurposes
J.Any commercialuse not on citysanitarysewer.
K.Locating steelsea orocean-goingcontainers marked withthe AmericanBureau ofShipping'sEmblemormeetingtheInternationalStandardOrganization's standards which can beidetachedfromatrailer,chassis,or frame and,which were formerly used for transportingseaorocean-going cargo when intended to be used as storage faellitles with the followingconditionsbeingrequiredasaminimum:
1.Be used as an appurtenance to the primaryuse;such primaryuse being situated in anenclosedadjoiningbuilding.
2.Be placed on concrete,asphalt,or level,compacted,hard surface at alltimes.
3.Be painted so as to blendin with the building to which it is assoclated.
4.Not be visibleto the motorîng public or from residentialnelghborhoods ImmediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualImpactsofthecontainersformerlyusedfortransportingseaoroceangoingcargo,which measures shall be approved bythe Planning Commission,provided,thatthe Planning Commissiondoes not need to require mitigationmeasures ifitis feltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted.
5.Have a maximum allowablesquarefootage ofcontainerstorage area not to exceed threepercent(3%)of the gross floor area of the building with which the container(s)Isassociated.Inno event shallthe numberof containersallowedas appurtenant storagefacilitiesexceedthree(3)in number.
6.Be located on premises as an appurtenant storage facility.
I 7.Not be stacked.
8.Abide by allset back requirementsapplicableto the zone in which it is located.
9.Therecipientof the conditionaluse permit is theonlyparty allowedto use the container.
L Other unmentioneduses ruled by the PlanningCommissionto be a conditionaluseor usespermittedbyspecificprovisionofthischapterasaconditionaluse.
M.Sitebuiltandfactorybuilt,detached housing units,whether occupied by the owner,rented,leased,or occupled by a resident watchman,custodlan,or attendant,when set backaccordingtoMosesLakeMunicipalCode18.32.220.
N.On-sitehazardous waste treatmentand storage facilitiesincompliance with the performancestandardsoftheStateofWashingtonsitingcriteriaforon-site hazardous waste treatmentandstoragefacilitiesandtherequirementsofthischapter;provided that,on-site hazardous
waste treatment and storage facilities are accessory to and subordinate to a primaryusewhichisageneratorofhazardouswaste.
O.Manufactureddetached housing units whether occupied by the owner,rented,leased,oroccupiedbyaresidentwatchman,custodian,or attendant when set back one hundred andfiftyfeet(150')from any arterial street.
18.32.120 UBC.UFC,UMC,and UPCCode Reauirements:AIIuses in the C-2Zone mustbe incompliancewiththeapplicablerequirementsoftheUniformBuildingGode,the UniformFire Code,theUniformMechanicalCode,and the Uniform Plumbing Code except as may be provided in thischapter.
18.32.145 Temporary Structures:Acommercial coach or recreational vehicle may be used as a temporaryofficeforaperiodoftimenottoexceedonehundredtwenty(120)days in duration in specificinstanceswhereapermanentstructurehousinganexistinglicensedbusinesshasbeendestroyed
or damaged to the extent that it is rendered unusable.The sitingoftemporary structures shallbeapprovedbytheBuildingOfficial.Temporary structures shall maintaina twenty foot (20')separation frompropertylinesand/or other buildingsor structures.
18.32.150 Outdoor Uses:The following outdoor uses are specificallypermitted in compliancewith therequirementsofthischapter.
A.Service StationPumps -gas pumps shall be set back twenty-five feet (25')from propertylines
B.Parks and playgrounds
C.Outdoor recreational,entertalnment,or amusementfacilities
D.Essential publicservices and utilitiesincluding buildingsand structures
E.Sidewalksales
F.Street vendors
G.Festivals or other outdoor celebrations
H.Other unmentioneduses ruled by the Planning Commissionto be similarto and compatiblewiththespecifiedpermittedoutdooractivitiesoruses.
I.The listed outdoortemporary/seasonal uses are permittedoutrightnotto exceed thirty(30)days induration.Temporarystructures associated with the listed uses are permitted and
shallbe exemptfrom the requirementfor compliancewith the UniformBuilding Code.The
sitingof temporarystructures shallbe approved by the BuildingOfficial.
1.Christmastree sales
2.Fireworks sales as approved by the Fire Chief
3.Non-profit organizationsales or activitiesassociated witha seasonal event
Section2.TheCityCouncildeclares that an emergency exists and this ordinance shall take effectand be
in force five (5)days after its passage and publication as providedby law upon one reading if 2/3 ofthe
entire CityCouncilpresent vote in favor of passage.
