AN ORDINANCEAMENDINGCHAPTER13.12 OF THE MOSESLAKEMUNICIPALCODEENTITLED"WATERANDSEWER RATES"
THE CITYCOUNCIL OF THECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 13.12 ofthe Moses Lake Municipal Code entitled"Water and SewerRates"is amendedtoreadasfollows:
13.12.010 Residential Water Rates:i A.The followingshall be the monthlyrate charge for water from the citywater system fromallresidentialIMngunitswithinthecorporateIlmitsofthecityandoutsidethecorporatelimitsofthecity.

13.12.030 ResidentialSewer Rates:Thefollowingshall be the monthlyrate charged customers residing
within the corporate limitsofthe cityand outside the corporateIlmitsofthe cityfor sewer service
from the citysewer system for single-familydwellings and each unitof a duplex with separate
meters:flat rate,$16.30per month.
13.12.035 Duplex Sewer Rates:The following shallbe the monthly rate charged customers residing within
the corporate limits ofthe cityand outside the corporate limits of the cityfor sewer servicefrom
the citysewer system for duplexes withonlyone meter servingtwoliving units or for two living
unitson a single lot served by one meter:flat rate,$32.60per month.
13.12.040 CommercialSewer Rates:
A.The following shall be the monthly rate charged customers residing within the corporate
limits of the city and outside the corporate limits of the city for all chargeable water dis-
charged intothe city sewer system by commercialusers and dwellingswiththree or morelivingunitsservedbyonemeter:

B.For purposes of calculatingsewer charges,Chargeable water shall be defined as follows:
Chargeable water shallbe measured bythe water consumed onthe premises,whatever the
source of such water,and the same wlllbe metered either by a public utilitymeter or oneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedand
inspected by the city.As an option,ifrequested by the owner of the premises,the citywill
install a water meter withthe cost for the meterand installation being paid by the owner of
the premises in accordance withthe charges assessed in MLMC13.08.020 for water/sewer
connections.Under such circumstancesthe water meter becomes the propertyofthe ownerofthepremisesandallcostsofreplacementandrepairaretheresponsibilityoftheownerofthepremises.In allcircumstanceswherethe water is metered by a privatelyowned water
meterand is used to determine sewer charges,the cityshall be allowedaccess to the meter
in order to read such meter.Where the use of water is such that a portion of allthe water
used does not flow into the sewer system,for whateverreason,but is lost by evaporation,
irrigation,sprinklingor is used in manufacturingor in a manufactured product,or is lost for
whatever reason,and the person in control providesproof of thisfact and installs a meter or
other measuringdevice approved by the city to measure the amount of water so used and
so lost,orifthe cityis capable ofdetermining theamount ofsewage enteringthe city'ssewer
system by some othermechanicalmeans,thiswater maybe deducted from the actualwater
consumption used in calculating the sewer charge.
The sewer charges for triplexesand apartments,mobile home parks,schools,hospitals and
other commercial establishmentswith increased usage for irrigation,onlyiftheir landscaping
exceeds five thousand square feet,shall be computedon the average consumption during
the previous non-irrigation season,unless the user elects to Install,at his expense,anapprovedmeasuringdevicetomeasurewaternotenteringthesewersystem.When a user
has a swimming poolor coolingunitsdischarging to the sanitary sewer,he must Install anapprovedmetertodeterminetheamountofwaterexemptfromsewerchargesduringthe
irrigation season.The irrigation season shallbe defined as the period inwhich statements
are mailed for the Aprilthrough October billingcycles.

C.Sewer rates for commercial uses discharged into the sewer system may be separatelydeterminedbytheCityCouncil,based upon bothvolume and chemicalcharacteristicsofthesewage.The CityCouncilreserves the privilegeto require pre-treatment of any materialdischargedintotheseweragesystem,or to prohibitdischarge into the system of industrialwastesthat,because of either volume or concentration,will overload existingseweragefacilities.
D.Allair-conditioningand refrigeration unitsthatare installed,replaced or that have capacityIncreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequiredtoinstallrecirculatingunits.Disposal may not be accomplished by discharging into thesanitarysewersystem.
13.12.050 Surcharge:
A.In additionto the rates established for water and sewer senricesas set forth in thischapter,a twenty-fivepercent (25%)surcharge shallbe assessed for water serviceandsewer servicefumishedoutsidethecitylimitsexceptfortheareacommonlyknownastheformerLarsonAirBase.In additionto the rates establishedfor water and sewerservices as set forth in thischapter,an eight per cent (8%)surcharge shall be assessedfor water service and sewerservicefurnishedoutsidethecitylimitsintheareacommonlyknownastheformerLarsonAirBase.
B.An additionalsurcharge shallbe assessed for water and sewer services furnished outsidethecitylimitsforatwenty(20)year periodas follows:
1.AIIthe properties owned by Willamette Industries as of January 1986 in Section 17.Township 19 North,Range 29 EWMshall be assessed a ten percent (10%)additionalsurchargeforwaterandsewerservices.
2.Allthe properties connected to the WheelerRoad transmission main and Reservoir#6standpipeeastofLNEshallbeassessedatwenty-fivepercent (25%)additional sur-charge for water and sewer services except the propelties described in #1 above.
If any other property usedfor commercialor industrial purposes connects to the WheelerRoadtransmissionmainandReservoir#6 standpipe east of L NE,the customerutilizingthewatersystemshallalsoparticipate,on a pro rata basis,in the costs incurred bythe cityintheconstructionofReservoir#6.In that case the surcharge shall be adjusted to alliusersofReservoir#6 accordingly.
The additionalsurcharge is assessedto coverthe costs the city incurred in the constructionofReservoir#6 located in the Wheeler Road area.The surcharge in Subsection Bshallexpirewithwater/sewer billingsoccurring after January 1,2006.Such reservoir wasconstructedtoservicethoseindustriesandotherpropertieslocatedalongWheelerRoadandwhichutilizethecity's watersystem.
C.Sewer rates for Industrialor processing plants may be separately determined by the CityCouncil,based upon both volume,location,andchemicalcharacteristicsofthe effluentdis-charge into the sewer collectionsystem.
Section 2.This ordinance shall take effectand be in force with utilitybillingsoccurring after February 1,1990.
