AN ORDINANCE CREATINGA NEW CHAPTER 12.48 OF THE MOSES LAKEMUNICIPALCODEENTITLED"STREETLIGHT1NGUTILITYRATES"
THE CITYCOUNCILOF THECITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section t.Chapter12.48 ofthe Moses Lake Municipal Code entitled"StreetLightingUtilityRates"is created
as follows:
I 12.48.010 Findinqs:
A.The Cityof Moses Lake,under its statutory authorityto provide for the general welfare ofitscitizens,has maintainedand does maintain,at cityexpense,a system of lighting on thepublicstreets,which system benefitsall ofthecitizensof the city.
B.The cost ofsuch street lights has increased in recentyears so as to become a heavy financialburdentothecity.
12.48.020 StatutoryAuthority;RCW35.24.430 providesthat citiesofthethirdclass and non-chartercodecitiesmayfixratesforsupplyingutilities,includingIIghting,
12.48.030 Rate Established:Pursuant to the statutory authority set out in Section 12.48.020,there isestablishedthesumoftwodollars($2.00)per month per utilityaccount for providingstreetlightinginthecity."Utilityaccount"does notincludethoseaccounts reflecting charges for waterpassedthroughahydrantmeter.
12.48.040 Rate -Collection:The utilityrate shall be added to each utilityaccount foraccounts associated
with property inside the corporate limitsof the city,shall be maintained bythe cityas a separatecharge,and shall be collectedas a part of the utilityaccount.For the purpose of this chapter,"utilityaccount"includesaccounts forthe furnishingof water or sewerage service,or garbagecollection,or anycombinationthereof.There shallbe only one charge for those addresses with
a splitbilling.
Section 2.This ordinance shalltake effectand be in force with utilitybillingsoccurringafter April1,1990.
