1422_00001ORDINANCENO.1422 AN ORDINANCEAPPROVINGAND CONFIRMINGTHE ASSESSMENTSANDASSESSMENTROLLOFLOCALIMPROVEMENTDISTRICTNO.56 WHICH HASBEENCREATEDANDESTABUSHEDFORTHEPURPOSEOFPAYiNGTHECOSTOFIMPROVINGSEVENTHAVENUEBYGRADING,GRAVEUNG,CONSTRUCTING,AND INSTALUNGCURBS,SIDEWALKS,SEWER SIDE LATERALS,WATERSERVICES,ASPHALTCONCRETEPAVEMENT,ANDSTORM DRAINAGEIN THECITYOFMOSESLAKEASPROVIDEDBYORDINANCENO.1838 ANDLEVYlNGANDASSESSINGTHEAMOUNTTHEREOFAGAINSTTHESEVERALLOTS,TRACTS,PARCELSOF LAND,ANDOTHERPROPERTYSHOWNONSAIDROLL WHEREAS,the assessment rolllevying the special assessments against properties located in LocalImprovementDistrictNo.56 inthe CityofMosesLake,Washington,created under Ordinance No.1338 hasbeenfiledwiththeCityClerkoftheCityofMosesLakeasprovidedbylaw;and WHEREAS,notice of the time and place of hearingthereofand ofmaking objectionsand protests to saidrollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixingthetime and place ofhearinghereonforMarch13,1990 at 8 p.m.in the CouncilChambers in the Police/Court Facility,MosesLake,Washington,and further noticethereof was duly mailed by the CityClerkto each property ownershownonsaidroll;and WHEREAS,at the time and place fixedand designated in said notice the hearing was duly held and allprotestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwerebyitoverruled, THECITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.That the assessmentsand assessment rollofLocalimprovement DistrictNo.56 which has beencreatedandestablishedforthepurposeofimprovingSeventhAvenuebygrading,graveling,constructing,and installingcurbs,sidewalks,sewer side laterals,water servicesasphalt concrete pavemert,andstormdrainageintheCityofMosesLakeasprovidedinOrdinanceNo.1338 as the same nowstands,be and thesameasherebyinallthingsandrespectsapprovedandconfirmed. Section 2.That each of the lots,tracts,parcels of land and other property shown uponthe said roll isherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is herebylevled and assessed against eachlot,tract,parceloflandandotherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon. Section3.Thatthe assessment roll as approvedand confirmedshall be filed withthe Treasurerofthe CityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnotice as requiredby lawstating that said rollis in his hands for collectionandthatpayment ofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days from the dateofthefirstpublicationofsaidnoticewithoutpenalty,Interest,or cost,and that hereafter the sumremainingunpaidmaybepaidin10equalannualinstallmentswithinterestthereonfixedattherateof8%per annum.The first Installmentof assessments on saidassessment roll shai be comedue and payable during the30-dayperiod succeeding the date one year afterthe date offirst publication bythe CityTreasurer of noticethattheassessmentrollisinhishandsforcollectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlikemanner. Ifthe whole or any portionof the assessment remainsunpaidafterthe first30-day period,interest uponthewholeunpaidsumshallbechargedatarateof8%per annum;and each year thereafter one of saidinstallments,together with interest due on the whole of the unpaid balance,shall be conected.Anyinstallmentnotpaidpriortotheexpirationofthesaid30<Iay periodduringwhichsuch installment is dueandpayableshallthereuponbecomedelinquent.Alldelinquentinstallmentsshallbe subject to a chargeforinterestattherateabovereferenced,anda penaltyas set by Moses Lake Municipal Code 3.50.020.Thecollectionofsuchdelinquentinstaimentsshallbeenforcedinthemannerprovidedbylaw. Section 4.Thisordinance shalltake effect and be Inforce five (5)days afterits passage and publicationasprovidedbylaw.
