THE AMOUNTTHEREOF AGAINSTTHE SEVERALLOTS,TRACTS,PARCELSOF
LAND,ANDOTHERPROPERTY SHOWNON SAIDROLL
WHEREAS,the assessment roll levying the specialassessmerts against propertieslocated inUtilityLocalImprovementDistrictNo.4 inthe Cityof Moses Lake,Washington,created under OrdinanceNo.1342 hasbeenfiledwiththeCityClerkoftheCityofMosesLakeasprovidedbylaw;and
WHEREAS,notice ofthe timeand place of hearing thereofand of makingobjections and protests to saidrollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixingthe timeand place ofhearinghereonforMarch13,1990 at 8 p.m.in the CouncilChambers in the Police/CourtFacility,MosesLake,Washington,and further notice thereof was duly mailed by the CityClerkto each property ownershownonsaidroll;and
WHEREAS,at the time and place fixed and designated in said notice the hearing was duly held andallprotestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwerebyitoverruled,
THECITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Thatthe assessments and assessment roll ofUtilityLocalimprovementDistrict No.4 whichhasbeencreatedandestablishedforthepurposeofconstructingandinstallingasanitarysewersystem,sewersidelaterals,and appurtenances which connects to existingsanitarysewer system and sewer side lateralsinLarsonPlat,Larson Plat No.2,Replat of Block 2,Larson Plat No.2,SW 1/4 SW 1/4 of Section 10,Township 19 North,Range 28 EWM,Battery OrchardTracts42,commonly known as BasinHomesin theOCityofMosesLakeasprovidedinOrdinanceNo.1342 as the same now stands,be and the same as herebyinallthingsandrespectsapprovedandconfirmed.
Section 2.That each of the lots,tracts,parcels of land and other property shown upon the said roll isherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameIsinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessed against each lot,tract,parceloflandandotherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.Thatthe assessment roll as approvedand confirmedshallbe filed withthe Treasurerofthe CityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinhishandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days from the dateofthefirstpublicationofsaidnoticewithoutpenalty,interest,or cost,and that hereafter the sum remainingunpaidmaybepaidin10equalannualinstallmentswithinterestthereonfixedattherateof13%per annum,provided,however,that if the net effectiveinterest rate fixedon the financing established for UtilityLocalImprovementDistrictNo.4 is other than13%per annum,the interest rateon the unpaidassessments shallberevisedtoarateof1/2 of 1%in excess of the net effectiveinterest rate on such financing.The firstinstallmentofassessmentsonsaidassessmentrollshallbecomedueandpayableduringthe30-dayperiodsucceedingthedateoneyearafterthedateoffirstpublicationbytheCityTreasurerofnoticethattheassessmentrollisinhishandsforcollectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlikemanner.
Ifthe wholeor any portionofthe assessment remains unpaidafterthe first 30-day period,interest upon thewholeunpaidsumshallbechargedatarateof13%per annum,provided however,thatifthe net effective0interestratefixedonthelocalimprovementbondshereafterissuedforUtilityLocalimprovementDistrictNo.4 is other than 13%per annum,the interest rate on the unpaidassessments shallbe revisedtoa rate of1/2of1%in excess of the net effectiveinterest rate on suchfinancing;and each year thereafter one of saidinstallments,together with Interest due on the whole of the unpaid balance,shall be collected.Anyinstallmentnotpaidpriortotheexpirationofthesaid30-day period duringwhichsuch installmentis dueandpayableshallthereuponbecomedelinquent.AIIdelinquent installments shall be subject to a chargeforInterestattherateabovereferenced,and a penaltyas set byMosesLake Municipal Code 3.50.020.Thecollectionofsuchdelinquentinstallmentsshallbeenforcedinthemannerprovidedbylaw.
Section 4.This ordinance shall take effectand be inforce five (5)days after its passage and publicationasprovidedbylaw.
