AN ORDINANCEAMENDINGCHAPTER 8.28 OF THE MOSESLAKEMUNICIPALCODEENTITLED"NOISECONTROL"
THECITYCOUNCIL OF THECITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 8.28 of the Moses Lake Municipal Code entitled "Noise Control"Is amended as
8 40 Public Nuisances and DisturbanceNoises:
A.Publîc Nuisance Noises:It is unlawfulfor any person to cause or allow to be emitted
a noisewhich has been determined to be a public nuisance nolse as defined herein.
B.Public Disturbance Noise:It is unlawfulfor anyperson to cause or any person inpossessionofpropertytoallowtooriginatefromtheproperty,sound that isa publicdisturbance.No soundsource specificallyexempted from this chapter shall be apublicnuisancenoiseorpublicdisturbancenoiseinsofarastheparticularsourceisexempted.The following source ofsound shallbe publicdisturbance noises:
L Frequent,repetitive,or continuous noise made by anyanimalwhichunreason-ably disturbs or interfereswith the peace,comfort,and repose of propertyownersorpossessors,except that such sounds made by animalshelters,orcommercialkennels,veterinary hospitals,pet shops,or pet kennels IIcensedunderandincompliancewithMLMC6.05.050 shall be exempt from thissubsection,provided,that notwithstandingany other provisionof thischapter,ifthe owneror other person having custody of the animalcannot,withreason-able inquiry,be located bythe investigatingofficer,or ifthe animalis a repeatviolatorofthissubsection,the animalshallbe impoundedbythe AnimalControlOfficerorhisdesignee,subjectto redemption in the manner provided byMLMC6.05.090;
2.The frequent,repetitive,or continuous sounding of any horn or siren attached
O to a motorvehicleexcept as a warning of danger or specificallypermitted orrequiredbylaw;
3.The creationof frequent,repetitive,or continuousnoise in connection withthestarting,operation,repair,rebuilding,or testingofany motor vehicle,motorcy-cle,off-highwayvehicle,or internal combustionengine in any residentialzone
so as to unreasonablydisturb or interferewith the peace,comfort,and reposeofownersorpossessorsofrealproperty;
4.The use of a sound amplifieror other device capable of producing or reproduc-ing amplifiedsounds upon public streets for the purpose of commercialadvertisingorsalesorforattractingtheattentionofthepublictoanyvehicle,structure,or property or the contents therein,exceptas permittedby law,andexceptthatvendorswhosesolemethodofsellingisfromamovingvehicleshallbeexemptfromthissubsection;
5.The makingofany loudand raucous noise whichunreasonablyinterferes withtheuseofanyschool,church,hospital,sanitarium,or nursingor convalescentfacility;
6.The creation by use of a musical instrument,whistle,sound amplifier,stereo,jukebox,radio,television,or other device capable of reproducing sound and
raucous noises which emanate frequently,repetitively,orcontinuously from anybuilding,structure,or property,such as sounds originating from a bandsession,tavern operation,or social gathering.
O 7.Any soundfrom a motor vehicle audio systemsuch as tape players,radios,andcompactdiscplayers,operated at volume and under conditions,so as to beaudiblegreaterthanseventy-five feet (75')from the vehicle itself.
8.Anysound from portable audio equipment,such as a radio,tape player,orcompactdîscplayer,whichis operated at such a volumeso as to be audibleatadistanceofseventy-fivefeet (75')fromthe source of thesound.
8 28.090 Violation:
A.Punishment:Anyviolation ofthe provisions ofthis ordinanceshall be punishableassetforthbelow:
1.First violation In any 12 month period C-14
2.Second violation in any 12 month period C-9
3.Third and subsequent violations in any CA
12 month period
B.Evidence In Proceedings:In any proceeding under this chapter,evidence of sound
level through the use of sound level meter readings shaî\not be necessary toestablishthecommissionoftheviolation.
Section2.The CityCouncildeclares that an emergency exists and this ordinance shalltake effectand be
inforce five (5)days after its passage and publicationas provided by law upon one reading if2/3 ofthe
entire CityCouncilpresent vote infavor of passage.
