1431_00001ORDINANCENO.1431 AN ORDINANCEAMENDINGCHAPTER 18.32 OF THEMOSESLAKEMUN1CIPALCODEENTITLED"C-2,GENERALCOMMERCIALAND BUSINESS2ONE" THECITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDO ORDAINASFOLLOWS: Section 1.Chapter 18.32 of the Moses LakeMunicipalCode entitled"C-2,GeneralCommercialandBusinessZone"is amended as follows: 18.32.040 ConditionalUses:The following specific and generallydescribed uses shallbeOpermittedintheC-2 Zone onlyas a conditionaluse subject to the approval ofthe Planning Commission in compliance with the provisions of this chapter and Chapter 18.57 ofthis titleentitled"Conditionaland Unmentioned Uses." A.Churches B.Schools C.Hospitals D.Temporaryor seasonal uses exceeding 7 days in durationexcept as provided bythischapter E.Bulk storage of hazardous,combustible or explosive substances F.Manufactured home parks G.Airports,landing strips,heliports,and air transportationfacilities H.Recreational vehicleparks I.Keepingof livestock,poultry,rabbits,or bees for commercial or privatepurposes J.Anycommercial use not on city sanitary sewer. K.Locating steel sea or ocean-goingcontainers marked with the American Bureau ofShipping'sEmblem or meeting the International Standard Organization'sstandardswhichcanbedetachedfromatrailer,chassis,or frame and,which were formerly used for transporting sea or ocean-goingcargo when intendedtobeusedasstoragefacilitieswiththefollowingconditionsbeingrequiredasaminimum: 1.Be used as an appurtenance to the primaryuse;such primaryuse beingsituatedinanenclosedadjoiningbuilding. 2.Be placed on concrete,asphalt,or level,compacted,hard surfaceat all times. 3.Be painted so as to blend in withthe building to which it is associated. 4.Not be visibleto the motoringpublic or from residential neighborhoodsimmediatelyadjacenttothepropertywhereitislocatedunlessother measures are employed to mitigatethe visual impacts of the containersformerlyusedfortransportingseaoroceangoingcargo,which measuresshallbeapprovedbythePlanningCommission,provided,that the PlanningCommissiondoesnotneedtorequiremitigationmeasuresifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted. 5.Have a maximumallowable square footage of container storage area not toexceedthreepercent(3%)ofthe gross floor area ofthe building with whichthecontainer(s)is associated.In no event shallthe numberof containersallowedasappurtenantstoragefacilitiesexceedthree(3)in number. 6.Be located on premises as an appurtenant storage facility. 7.Not be stacked. 8.Abide by allset back requirements applicableto the zone in whichit islocated. 9.The recipientof the conditionalusepermitis the onlypartyallowed to usethecontainer. 1 L.Other unmentioned uses ruled by the Planning Commission to be a conditional use or uses permitted byspecific provisionof this chapter as a conditional use. M.Site built and factory built,detached housing units,whether occupied by the owner,rented,leased,or occupied by a residentwatchman,custodian,orattendant,when set back according to Moses Lake Municipal Code 18.32.220. N.On-sitehazardous waste treatment and storage facilities in compliancewiththeperformancestandardsoftheStateofWashingtonsitingcriteriaforon-sitehazardouswastetreatmentandstoragefacilitiesandtherequirementsofthischapter;providedthat,on-sitehazardous waste treatment and storage facilities are accessory to and subordinate to a primaryuse whichis a generator ofha2ardouswaste. O.Manufactured detached housing units whetheroccupied by the owner,rented,leased,or occupied by a resident watchman,custodian,or attendant when setbackonehundredandfiftyfeet(150')from any arterialstreet. P.Residential uses as an accessory use to a commericalstructure,whetheroccupiedbytheowner,rented,leased,or occupied by a resident manager,watchperson,custodian,or attendant.Accessory use shall be definedas a use of a portionof a bulldingwhich is incidentaland subordinate tothe principaluse ofthebuilding. Q.Multi-lamilyresidential uses (apartments) Section2.This ordinance shall take effectand be in force five (5)days after its passage and publication as provided by law.
