1434_00001ORDINANCENO.1434 AN ORDINANCEAMENDINGCHAPTER 5.44 OF THE MOSESLAKEMUNICIPALCODEENTITLED"PRIVATESECURITYBUSINESS" THE CITYCOUNCIL OFTHECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section1.Chapter5.44 ofthe MosesLake Municipal Codeentitled"Private SecurityBusiness"is amendedasfollows: 5.44.070 License -Issuance Prerequisites -Bonds and Insurance: A.No license shall be Issued nor applicationacted upon by the Police Chiefunderthischapterunlesstheagencyapplyingforthelicensefileswiththecityasuretybondexecutedbyasuretycompanyauthorizedtodobusinessinthisstateinthesumofanamountnotlessthantenthousanddollars,conditionedto recover against theprincipal,its servants,officers,agents,and employees,by reason of its wrongful orillegalactsoromissionsinconductingsuchbusinesslicensedundertheprovisionsofthischapter.Said bond is to be filed withthe CityClerkon a formapproved bytheCityAttorneyandwithsuretyapprovedbythecityFinanceDirector.The bondrequiredbythischaptershallbemadepayabletothecity,and anyone so injured bytheprincipal,its officers,agents,and employees,shall have the right and shall bepermittedtosuedirectlyuponthisobligationintheirownname;and this obligationshallbesubjecttosuccessivesuitsforrecoveryuntilcompleteexhaustionofthefaceamountthereof;and the agency applyingfor the license establishes that it has ineffectapublioliabilityinsurancepolicyinatleastthefollowingamounts:propertydamageoffiftythousanddollarsperoccurrence;bodily injury of one hundredthousanddollarsperperson;with a combined liabilityof three hundred thousanddollarsperoccurrence.Said policy shall name the cityas an additional insuredpaity.Inlieu of providingsuch bond or other financial security,the applicant mayprovideproofoferrorsandomissionsinsuranceinsuringtheactionsoftheapplicantinanamountequaltoorgreaterthanfiftythousanddollars($50,000). B.The insurance required by this section shall contain a clause withinthe insurancecontractwhichwillclearlystatethattendays'notice of cancellation or nonrenewalwillbegiventothecity,and any license issued pursuant to this chapter shall beautomaticallysuspendedforanyperiodduringwhichtheregulrementsofthissectionarenotcompliedwith. Section 2.This ordinance shalltake effectand be in force five(5)days after its passage and publicationasprovidedbylaw. Adopted bythe CityCounciland signed by itsMayoron June 12,1990.
