AN ORDINANCEAMENDINGCHAPTER12.12 OFTHEMOSESLAKEMUNICl-PALCODE ENTITLED"SIDEWALKCONSTRUCTION"
THE CITYCOUNCILOFTHE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter12.12 of the Moses Lake MunicipalCode entitled"SidewalkConstruction"is amendedtoreadasfollows:
12.12.010 Sidewalk Specifications-Residential Zones:All publicsidewalksin the residentialzones ofthecityshallbeconstructedofnaturalcoloredPortlandcementconcreteunlesstheCouncilhaspreviouslyapprovedtheusageofaltematecolorsormaterials.Sidewalksshallbe a mini-
mumfour inches (4")in thicknessand fivefeet (5')inwidthand shallbe constructed on gradeandinaccordancetospecificationsissuedbytheCityEngineer.Allsidewalksconstructedinresidentialzonescurbedwithrolledcurbandguttershallbeaminimumofsixinches(6")In thickness and five feet (5')in width.Public sidewalks in all residential zones shall beconstructedadjacenttothecurb.In existingdeveloped areas sidewalkshallbe constructedinaccordancewithexistingsidewalkimprovementsunlesstheCouncilhaspreviouslyapprovedavariationinconformity.
12.12.015 Bike Path Specifications:AIIbicyclepaths in the CityofMosesLake shallbe constructedwith
a minimum of four inches (4")of Portland cement concrete in Type A curbed streets and sixInches(6")ofconcrete In rolledcurb constructionareas or a minimum oftwo inches (2")ofasphaltcementconcretewithaminimumcrushedstonebaseofthreeinches(3")or asapprovedinstructuraldesignbytheCityEngineer.The width of bike paths shall be inaccordancewithWashingtonStateDepartmentofTransportationstandards.Designs shallbe
as approved by the City Engineer and construction shall be consistent with the minimumrequirementsoftheCommunityStreetandUtilîtyStandards.Bicycle pathsshallbe construct-ed where designated bythe city bicycleroute map and may be constructed in otherareas ifapprovedbytheCouncil.Drivewaysacross bicycle paths shall be constructed for the typeoftrafficusingthedrivewayandasapprovedbytheCityEngineer.Bicycle paths in theCentralBusinessDistrictshallbeconstructedwithconcretepaversasdescribedinSection12.12.050.
12.12.020 Curbs in Residential2ones:AIIcurbs in the residential zones shall be constructed ofgFaynaturalcoloredPortlandcementconcreteunlesstheCouncilhaspreviouslyapprovedtheusageofalternatecolorsormaterials,be builtto the established grade,and be constructedaccordingtotheCommunityStreetandUtilityStandards.
12.12.025 Curband SidewalkReplacementfor the Handicapped:Newcurb constructionor curb radiusreplacementshallbeaccomplishedwiththeinstallationofadepressedcurbandsidewalkforhandicappedramps.Theconstructionofa handicapped ramp at one comer ofan Intersectionforhandicappedaccesstotheintersectionwillrequiretheconstructionofahandicappedexit
ramp at the other side of the street intersection if one does not exist.No more than onehandicappedexitrampshallberequiredtobeconstructedatanintersectionwhereahandi-capped access ramp has been constructed and the constructionofa handicapped exit rampshallnotrequiretheconstructionofanadditionalhandicappedexitrampatthesamestreetintersection.Depressed curb and sidewalks shall be constructed in accordance with theCommunityStreetandUtilityStandards.Handicapped areas shall be provided as required inRCW35.68.75 and 35.68.76.
12.12.030 Rolled Curbs -Where Permitted:Rolledcurb and gutter may be installedin all residentialzonesuponapprovalbytheCityEngineer.Rolledcurb shallnot be constructed ondesignat-ed arterialstreets.Rolled curb and guttershall be constructed in accordance with the Com-munity Street and UtilityStandards as approved by the Council.
12.12.050 SidewalkSpecifications-Commercial Zones:AIIsidewalksinthe commercial zones ofthe cityshallbeconstructedofgrayconcreteunlesstheCouncilhaspreviouslyapprovedtheusageofaltematematerialsandinaccordancetospecificationsissuedbytheCityEngineerexcepttheCentralBusinessDistrictwhichisdefinedastheareaboundedbythesouthsideofPioneerWayfromFifthAvenuetoChestnutStreet;the northwestside of Broadway AvenuefromChestnutStreettoDogwoodStreet;the northeast side of Dogwood from Broadwayto9FifthAvenue;the southeast side of FourthAvenue from Dogwood to Balsam;the northeastsideofBalsamfromFourthtoFifth;the northwestside ofFifthAvenue fromBalsam to PioneerWay;the southwest sideof Ash Street fromFourth Avenueextending50 feet southeast,asshownontheattachedmapwhichisincorporatedbyreferenceandmadeapartofthîsordinance.AIIsidewalks in allcommercialzones shall be builtto the full dimension betweenthebackofcurbandtheabuttingpropertyline.Sidewalksshallbe constructed so as to avoldphysicalobstructionsunlesstheCouncilhaspreviouslyapprovedtheplacementofphysicalobstructionssuchas,but not limited to,light poles,fire hydrants,planter boxes,trees,ortreewellsinorontheareareservedforsidewalks.
The sidewalks in the Central Business District shall be constructed of concrete brickpaversintheredDecorpattemmanufacturedbyTrendsetorapavermanufacturedbyanothercompanywhichisequaltothespecificationsoftheTrendsetRedDecorpatternbrickpaver.

Drivewayand alleyapproaches shall be constructed ofconcrete brick paverinthe black Decor
pattern manufactured by Trendset or a paver manufactured by another company which is
equal to the specificationsoftheTrendset Black Decor pattern brickpaver.The sidewalk shall
be constructed according to the city's Community Street and UtilityStandards as adopted
by reference by MosesLakeMunicipalCode 12.08.The sidewalk standards,as referenced by
Moses I.ake Municipal Code 12.08,shall Includebut not be limited to specificationsfortheinstallationofsidewalks,tree wells,trees,irrigation system,electrical conduit for decorative
and/or functional/pedestrian street lightingand sidewalkfurniture (benches,garbage cans,planters,etc.).
Section2.This ordinance shalltakeeffectand be in force five (5)days after its passage and publication
as provided by law.
