ANORDINANCECREATINGA NEW CHAPTER16.56 OF THE MOSESLAKEMUNICIPALCODEENTITLED"UNDERGROUNDINGOF UTILITIES"
THECITYCOUNCIL OF THECITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 16.56 of the Moses LakeMunicipalCode entitled"Undergroundingof Utilities"isestablishedasfollows:
0 16.56.010 Underground UtilityPolicy:With the increased use of the properties and streets withinthecity,the health,safety,and welfare of the residents of the city require that electrical,tele-phone,andTVcable facilitiesbe located or relocated underground as soon as practical.
16.56.020 Definitions:For the purposes ofthis chapter,the term electricalor communicationfacRiesmeanselectricpower,telephone,telegraph,and cable televisionfacilities,provided,howeverthatthetermsshallnotincludethefollowingfacilities:
A.Electricutilitysubstations,surface mounted transformersand switchingfacilities;
B.Street lighting standards;
C.Telephonepedestals and other equivalentcommunicationfacilities;
D.Policeand fire sirens or anysimilarmunicipalequipment,including traffic controlequip-ment.16.56.030 I)nderground InstallationRequired:
A.Allelectricaland communicationfacilitiesotherthan electrical or communicationserviceslocatedonprivatepropertyshallbeinstalledundergroundbytheutilityowningsaidfacilityinthefollowingcases:
1.When it becomes necessary to remove existing overheadfacilities for a distance offiehundredfeet(500')or more because of a roadway wideningproject or other similar
reason.
2.When existing overheadfacilities for a distance of over five hundred feet (500')are tobereplaced,provided,however,this provisionshall not apply to replacements duesolelytocasualtydamagenortoreplacementofwireorcableonly.
3.Whenany electricalor communicationfacilitiesare extended beyond those facilitiesexistingontheeffectivedateofthischapter.
4.When another utilityhaving facilities along the same street oreasement places itsfacilitiesundergroundforadistanceofoverfivehundredfeet(500').
B.AIIundergrounding of facilities initiated by utilitiesmust have approval ofthe CityCounciloritsrepresentativespriortoundertakingsuchproject.
C.Allelectricaland communicationserviceslocated on privatepropertyshall be installedundergroundbytheownerofthepropertyinthefollowingcases:
1.AIInew electricaland communicationservicesfrom an overhead or undergroundfaellitytoserviceconnectionsshallbeInstalledunderground.
2.Allrebuilt or relocated electricalor communication servîce lines froman overhead orundergroundfacilitytoserviceconnectionsshallbeinstalledundergroundunlesssuchrebuildingorrelocationinvolvesachangeintheoverheadservicelineonlywithoutachangeinthecorrespondingserviceentrancefacilities.
3.Allexisting electricaland communicationservices shall be converted to undergroundbytheownerorownersofthepropertyuponwhichsaidservicesarelocatedwithinOninety(90)days after notificationby the cityin accordance withRCW35.96.050 thatundergroundfacilitiesareavailable.
15.56.040 Cost:The cost and expense ofrelocating the existingfacilities,or installing new facilities,underground,shall be borne by the servingutilitiesand/or the owners ofthe real propertyservedand/or persons applyingfor such undergroundservicein accordance withtheapplicablefiledtariffs,or the rules and regulations,or the published policiesoftherespectiveutilitiesfurnishingsuchserviceorasmaybecontractuallyagreeduponbetweentheutilityandsuchownerorapplicant.

16.56.050 Variances:
A.A variance from the undergroundInstallation requirements of this chapter may be granted
by the Moses Lake CityCouncilupon applicationofthe utilityor propertyownercon-comedifitis demonstrated to the satisfactionofthe Moses LakeCityCounclithat the
variance is in the interests ofthe general health,welfare,and safety ofthe residents of the
Cityof Moses Lakeand traveling publicand one of the followingconditionsexists:
1.It is technologicallyunsound to require undergroundingof a particularfacilityor inaparticularlocation;or
2.That the costs of the underground installation,when compared to overhead installa-
tion,is disproportionate in comparisonto the benefit to be gained by the property
and/or publicand is dîsproportionately high when comparedto other properties orlocations;or
3.Where the area in which undergrounding is required has notestablished a sufficient
growthpattem to permitthe determinationof ultimatefacilityrequirementsto major
transmissionroutes.
B.When grantinga variance,the Moses LakeCityCouncilmay attach conditionsto the
granting of said variance including placinga timelimit on the durationofsuch variance.
Section 2.This ordinance shall take effect and be Inforce five (5)days afterits passage and publication
as provided by law.
