ANORDINANCECREATINGA NEWCHAPTER12.10 OF THE MOSESLAKEMUNICIPALCODEENTITLED"DRIVEWAYCONSTRUCTION STANDARDS"
THECITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 12.10 of the Moses Lake MunicipalCode entitled"Driveway ConstructionStandards"is created as follows:
12.10.010 Driveway Set Back and Separation:Alldrivewaysshall be in compliancewith the followingminimumsetbackandseparationstandards:

12.10.020 Deviations:
A.The CityEngineer may approve a reduction ofthe minium driveway set back and separa-tiondistance standards.Reduction ofthe driveway set back and separation distancesOshallnotexceedtwenty-fivepercent (25%)of the set back and separationdistancesstandardsasstipulatedinSection12.10.010 ofthis chapter.Atrafficstudy prepared byanengineerlicensedbytheStateofWashingtonmustaccompanytherequest.ThetrafficstudymustconfirmthatanyproposedreductionInthedrivewaysetbackorsepa-rationdistance standards would have no adverse impact uponvehiculartraffic.
B.The CityEngineermay requirean increase indrivewayset back and separation distancesinhighvolumetrafficareasorhightrafficgeneratingdevelopmentsasmaybewarrantedbyatrafficstudywhichmayberequiredbytheCityEngineer.Trafficstudies must bepreparedbyanengineerlicensedbytheStateofWashington.
12.10.030 CondletingOrdinances or Standards:Where there is a conflictbetweenthe provisions ofthisordinanceandothercityordinancesorconstructionorcommunitystandardstheprovisionsofthisordinanceshallpreval.
12.10.040 SeverabHity:Ifany provisionof thisordinanceor its applicationto anyperson or circum-stance is heldinvalidtheremainder of thisordinance or the appilcation ofthe provisionstootherpersonsorcircumstancesisnotaffected.
Section 2.Thisordinance shalltake effect and be in force five (5)days after its passage and publicationasprovidedbylaw.
