ANORDINANCEAMENDINGCHAPTER5.24 OF THEMOSESLAKEMUNICIPALCODEENTITLED"PRIVATEDETECTIVES"
THE CITYCOUNCILOF THECITYOF MOSESLAKE,WASHINGTONDOORDAINASFOLLOWS:
Section 1.Chapter 5.24 of the Moses Lake MunicipalCode entitled "Private Detectives"is amended asfollows:
O 5.24.040 Identincation Card:Each privatedetectivewho is selfemployedor working for a privatedetectiveagencyorprivatedetectivebusinessmustapplyforanIdentilloationcard.Applica-tion forthe identificationcard required by thischapter shall be made to the Finance Director
upon such forms as the FinanceDirectorshan require.Such applicationshallshow thereontheapplicant's name,age,date of birth,and previousresidence and occupation for a periodofnotlessthanfive(5)years immediately priorto such appication,the address of his placeofbusiness,and the name of his employer,ifany;and shallstate whetheror not the appli-cant has ever been convictedof a felonyor forfeited bond.
AIIapplications for Scenses shallbe forwarded to the Police Chieffor investigation and report.The Police Chiefshallrequire that each applicantbe lingerprinted and his photograph taken;and an investigation shallbe made into the background ofthe applicant.
5.24.060 Business License:
A.Each private detectivewho is self employedand each detectiveagency or privatedetec-tive business willbe requiredto obtaina business license as set forth in Moses LakeMunicipalCodeChapter5.04.
B.Alllicenses shaH expire on the thirty4irst day of Decemberof each year and no reduction
in fee for such licenses shall be made for any partialyear.No license shallbe transfer-able.AIIlicenses willbe renewedthrough the Fînance Directorwith the payment oftheyearlylicencefee.
5.24.070 License-Bond:
A.Nolicense shallbe issued nor applicationacted upon by the Police Chiefunder thischapterunlesstheapplicantfileswiththecityasuretybondexecutedbysuchapplicantbyasuretycompanyauthorizedtodobusinessinthisstateinthesumoffivethousanddollars,or such other financial securityas may be approved by the CityAttorney,condi-tioned upon the careful,faithful,and honest conduct of the servicesto be performedbytheapplicant,or his or its employees.Such bond shallbe approved by the CityAttorney
as to form,execution,and sufficiencyofsureties.In lieu of providingsuch bond or otherfinancialsecurity,the applicantmayprovideproof of errors and omissions insuranceinsuringtheactionsoftheapplicantinanamountequaltoorgreaterthantwenty-fivethousanddollars($25,000).
B.The bond or approved securityrequired Inthis section shall be taken inthe name ofthepeopleofthecityandeverypersoninjuredbythenegligent,willful,malicious,or wrongfulactoftheprincipal,his agent,servant,or employee,in the conduct of business of privatedetective,may bring an action on the bond in his own name to recover damages for suchnegligent,willful,malicious,or wrongfulact.
C.Notice of CanceUation.The bond or other approvedfinancial security required by thissectionshallcontainaclausewhichwillclearlystatethattendaysnoticeofcancenation
or nonrenewalwillbe givento the city.Any Insurance required bythis section shallcontainaclausewithintheinsurancecontractwhichwillclearlystatethatten(10)daysnoticeofcancellationornonrenewalwillbegiventothecity.
D.The PoliceChiefshallsuspend any license when the bond or other approved financialsecurityorerrorsandomissionsinsurancerequiredinthissectionhaslapsedorisre-duced by reason for a judgment thereon,or for any other reason it is no longer in fullforceandeffect.
5.24.090 Identifiçation -Costs of Screening:Every privatedetective shallat alltimes have in hispossessionanidentificationcardinaformapprovedbythePoliceChiefandsuchcard shanhavethereon,in additionto such other information as may be required by the Police Chief,the licensee's photograph,thumbprint,and signature.Uponthe revocationor suspension ofanysuchlicense,such identification card shallbe surrenderedto the Police Chief.The PoliceChiefshallchargeaOnetimefeeoffiftydouars($50)to helpdefray the costs of screening

any applicantforan identification card and IIcense.If such card is issued,the Police Chief
may,in addition,charge the applicantthe actual cost ofthe card.Fingerprintingcosts are
included in theapplicant review fee.Thiscard willexpireon December thirty-firstofeach
year and must be renewed throughthe PoliceDepartmentby payingtheappropriate cost of
the card.
5.24.120 Exemptions:The provisions ofthis chapter shall not applyto:
A.Any officer or employee of any department or agency of the UnitedStates or ofanystate,
county,city,or municipal corporationwhile engaged in the performanceof his official
duties:
B.Firmsor corporations commonlyreferredto as credit bureaus or credt reportingagen-cies;
C.Private detective whose principleplace ofbusiness is not in the city;provided,that his
business in the cityis of a temporary nature only,and that he shallhave,before engaging
in his activitiesin this city,registered withthe Police Chief.
Failure to comply withanyprovisionof this chapter is a misdemeanor and punishable by
a fine of five hundred dollars,ninety days in jail,or both.
Section2.This ordinance shalltakeeffectand be inforce five(5)days after aspassage and publication
as providedby law.
