ANORDINANCEAMENDINGCHAPTER5.44 OFTHEMOSESLAKEMUNICIPALCODEENTITLED"PRIVATESECURITYBUSINESS"
THECITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 5.44 of the Moses Lake Municipal Code entitled"PrivateSecurityBusiness"isamendedasfollows:
0 5.44.040 License -Application -Generally:Application for any IIcense or identificationcard required bythischaptershallbemadetotheFinanceDirectoruponsuchformastheFinanceDirectorshallrequire.Such applicationshall showthereon the applicant's name,age,date of birth,and previousresidence and occupationfora periodofnot less than five years immediatelypriortosuchapplication,the address of his place ofbusiness,and the name of his employer,ifany;and shallstate whether or not the applicanthas ever been convicted of a felonyorforfeitedbond.The applicationshallbe filedand verifiedby the applicant.Ifthe applicant is
a firm or corporation,the applicationshall be signed by a dulyauthorizedofficer ofthe firm
or corporationand shallgive the local address and place of business of such firm or corpora-tion.
Allapplicationsfor licenses shall be forwarded to the Police Chieffor investigation and report.The Police Chiefshall requirethat each applicant be fingerprinted and his photograph taken;and an investigation shall be made into the background of the applicant.
5.44.060 Business License:
A.Each private security business willbe requiredto obtaina business license as set forth inMosesLakeMunicipalCodeChapter5.04
B.Alllicenses shallexpireon the thirty-firstday of December of each year and no reductioninfeeforsuchlicensesshallbemadeforanypartialyear.No license shallbe transfer-able.Alllicenses willbe renewed throughthe FinanceDirector with the paymentoftheyearlyfee.
5.44.070 License-Issuance Prerequisites -Bonds and Insurance:
A.No license shallbe issued nor applicationacted upon bythe PoliceChiefunder thischapterunlesstheagencyapplyingforthelicenseflieswiththecityasuretybondexecut-ed by a surety companyauthorizedto do business inthis state in the sum ofanamountnotlessthantenthousanddollars,conditionedto recover against the principal,Itsser-vants,officers,agents,and employees,by reason of its wrongfulor illegal acts or omis-slons in conducting such business licensed under the provisions of this chapter.SaldbondistobefliedwiththeFinanceDirectoronaformapprovedbytheCityAttorneyandwithsuretyapprovedbythecityFinanceDirector.The bond requiredby this chaptershallbemadepayabletothecity,and anyone so injuredbythe principal,its officers,agents,and employees,shall have the rightand shallbe permittedto sue directlyuponthisobligationintheirownname;andthis obligation shall be subject to successive suitsforrecoveryuntilcompleteexhaustionofthefaceamountthereof;and the agency apply-ing for the licenseestablishes that it has ineffecta publicliabilityinsurance policy in atleastthefollowingamounts:propertydamage offiftythousand dollars per occurrence;bodilyinjuryofone hundred thousand dollarsper person;witha combined liabilityofthreehundredthousanddollarsperoccurrence.Said policyshall name the cityas anadditionalinsuredparty.In lieu ofprovidingsuch bond or other financial security,theapplicantmayprovideproofoferrorsandomissionsinsuranceinsuringtheactionsoftheapplicantinanamountequaltoorgreaterthanfiftythousanddollars($50.000).
B.The insurance requiredby this section shallcontain a clause within the insurancecontractwhichwillcleadystatethattendays'notice of cancellation or nonrenewalwillbe giventothecîty,and any license issued pursuant to this chapter shall be automatically suspendedforanyperiodduringwhichtherequirementsofthissectionarenotcompliedwith.
5.44.080 Identification -Costs of Spreening:Every owner,manager,administrator,privatesecurityofficer,and other employeeofa privatesecurityagency shallat alltimes have in his posses-slon an identification card in a form approved bythe Police Chief.Such card shallhavethereon,in additionto such other informationas may be required bythe Police Chief,thephotograph,right index print,employer,and signatureof the person being identifiedand dateofexpirationofthecard.

The Police Chiefshall charge a one time fee of fiftydollars($50)to help defraythe costs of
screening any applicantfor an Identification card and license,and he mayin additionto any
other fees charge theapplicanttheactualcost ofthe card.Fingerprintingcosts are included
inthe fiftydollar ($50)applicantreviewfee.Allidentificationcards shallexpireon the thirty-
firstday of December of each year.
All identification cards shallremain the property of the city.When a holder of an identification
card leaves the employmentofa securityagency,said holder shall Immediatelysurrender his
identification card and forwardit immediately to the Police Chief.The former employee may
then reapply for an identification card upon employmentwith another securityagency li-
consed bythe city.
Section2.This ordinanceshalltake effectand be in force five (5)days alter its passage and publication
as providedby law.
