AN ORDINANCEAMENDINGCHAPTER13.12 OF THEMOSESLAKEMUNICIPALCODEENTITLED"WATERAND SEWERRATES"
THECITYCOUNCILOFTHECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section I.Chapter 13.12 ofthe Moses LakeMunicipal Code entitled'Water andSewerRates"is amendedasfollows:
13.12.090 Water 1,)sage -Fire Hydrants:Water deliveredthroughfire hydrants associated with the city'swatersystemshallbebilledasfollows:
A.Fire hydrant meters provided by the city shall be used,when available,to measure theamountofwaterbeingdellveredthroughthefirehydrant.Anyone receMngwater deliveredthroughafirehydrantshallpayfourdollars($4)per day for the water receivedthrough afirehydrantplusthirty-sixcents($.36)per hundred (100)cublofeet ofwater deliveredifafirehydrantmeter,providedbythe city,is used to measurethe amount ofwater delivered.Ifno firehydrantmeter isavailablefromthe city,anyonereceiving water from a firehydrantshallpaysixdollars($6)per day for the water receivedthrough a fire hydrant.
B.The cityshall pay,from its current expense fund to the water and sewerfund,the sum oftwodollars($2)per fire hydrant per year as payment for water deliveredthrough the firehydrantswithinthecitylimits.
Section 2.This ordinance shalltake effectand be in force five(5)days after its passage and publicationasprovidedbylaw.

2.FINDINGSOF FACTBY THEPLANNINGCOMMISSION.
Based upon the evidence presented to them,the Commissionmakes the followingfindings of fact:
2.1 The proponent is the ownerofthe property.
2.2 The property is currently zoned C-2,GeneralCommercialand Business.
3.CONCLUSIONSBYTHE PLANNINGCOMMISSION.
Fromthe foregoing findings of fact the Commissionmakesthe following conclusions:
3.1 The PlanningCommissionof the Cityof Moses Lake is vested with the authorityto recommend
to the CityCouncilthe advisabilityof approvinga preliminaryplat.
3.2 The plat is properly before the Commissionfor its recommendation.
3.3 Itis proper at this timefor the Planning Commissionto makea recommendation on this prelimi-
nary plat.
3.4 The Planning Commissiondeclared this preliminaryplat,if granted,to have a non-significant
adverse impact on the environment onFebruary 28,1991 providedthat a trafficstudy is done at
the time a specific development is proposed for the area.Therefore,there should be no
undesirableenvironmental problemscreated.
3.5 It is in the best interests and welfare ofthe city'scitizensto platthe property as proposed.
4.RECOMMENDATIONOF THE PLANNINGCOMMISSION.
Onthe basis of the foregoing findings offact and conclusions,it is the recommendation of the Planning
Commissionof the CityofMosesLake to the CityCouncilofthe Cityof Moses Lake that the preliminary
plat be approved.
5.FURTHERHEARINGBEFORE THE CITYCOUNCIL
5.1 Dgg.A publicmeeting was held upon proper notice beforethe Councilon April 23,1991.
5.2 Proponent.Patrick MolitorIsthe proponent ofthis plat.
5.3 Purpose.The proponent has submitted a preliminaryfinal plat for property legallydescribed
above.
5.4 Evidence.TheCouncilconsidered the following materialsin reaching its decision:
A.The submittedplat.
B.Testimony from the proponent.
C.Written comments fromvariousparties.
6.FURTHERFINDINGSOF FACTBYTHECITYCOUNCIL.
Based uponthe evidencepresented to them,the Councilmakes the followingfindings offact:
6.1 The proponent is the owner of the property.
6.2 The property is currentlyzoned C-2,GeneralCommericaland Business.
7.FURTHERCONCLt)SIONSBYTHE CITYCOUNÇIL.
From theforegoingfindings of fact the Councilmakes the following conclusions:
7.1 The CityCouncilof the Cityof Moses Lake is vested with the authorityto make a decision on apreliminaryplat.
7.2 The plat is properiybeforethe Councilfor its decision.
7.3 It is proper at thistime for the CityCouncil to make a decision on this preliminaryplat.
8.DEÇISION.
The City Councilof the CityofMoses Lake agrees with the recommendation ofthe Planning Commission
and approves the preliminary plat.
